Public Hearings a. 7:00 P.M. - Variance Request from Far.mington Fire Department for an Expanded Driveway Width at the Existing Fire Station on Denmark Avenue The Commission has previously discussed options that would eliminate the need for an 84 foot wide driveway on the west side of Denmark Avenue. The only though that came to the surface was that the original building should have been constructed with a setback sufficient to handle all turning movements on site with one access that would function more like a normal street intersection. The Commission determined very quickly that an island in the paved apron adjacent to Denmark Avenue would become a safety problem as well as a great inconvenience to the Department. A staff request for a planting plan to accompany the variance was responded to with a site plan showing existing tree and shrub cover. Both from a fairness point of view and setting a good example point of view, it would appear to be reasonable to ask for a foundation planting plan on the north side of the building to correspond with the one on the south side and to add at least 2 shade trees to the north sideyard. Recommendation Approve the variance as requested. b. 7:10 P.M. - Variance Request from Dennis and Edna Sue Perro to build a storage shed 11 1/2 feet tall at 5370 190th Street West The subject property is one of four large lots on the north side of 190th Street. It is adjoined by one lot on each side and three lots at the rear. The problem structure was built without an understanding of height limits much like other in the past. One such two story shed was defined as a garage when it was discovered that it had garage doors and a motorcycle stored inside. This particular storage shed has had no neighborhood complaints. However, a similar shed in Dakota County Estates will be discussed next month, and there is an upset next door neighbor. The difference between these requests appears to be the maturity of the plantings on the lot. In Dakota County Estates, the concern is that the shed blocks a neighbor's view of the Dakota County Estates stormwater pond. In this request, tree cover appears to have kept the building from becoming a neighborhood irritant. In addition, this lot is reasonably large, whereas the Dakota County Estates lot is not. Recommendation view the site to gain an understanding of the problem. Will a 2 1/2 foot variance maintain the spirit and intent of the zoning ordinance? ... . . . c. 7:20 P.M. - Variance Request from Donald and Brenda Hunter to extend a garage four feet into a utility easement and one foot from a property line at 613 Heritage Way This property adjoins the Farmington Presbyterian Church property and the Church has indicated to Mr. Hunter that it does not have a problem with the proposed garage addition. Because of the unique circumstances, a five foot variance would not appear to be a problem. However, the drainage and utility easement appears to be another problem. One way to remedy it would be for Mr. Hunter to ask the Church if it would also accept an increased five foot width of utility easement adjoining the Hunter property, or for Mr. Hunter to be responsible for contacting all utilities that supply service to the area to see if at least 5 feet of the easement can be abandoned. The staff will contact the City Attorney prior to the meeting to find out if either of the two suggested alternatives have merit. Recommendation Grant the variance if the utility easement question can be answered. d. 7:30 P.M. - Variance Request from South River Homes, Inc. to allow the house on Lot 7, Block 5 of Dakota County Estates 8th Addition to remain as as constructed, 5 feet from the property line. For some reason, the contractor located a house five, rather than six, feet from the west property line. The street address is 18444 Eldorado Way. Unless a variance is officially on record, every lending institution will have a problem each time the property needs to be financed. It would appear to come under the category of a bothersome mistake but not one in which the house size should be reduced or moved.
