7:00 P.M. - Dakota County Wetlands Alteration per.mit Request - County Road 50
The most illuminating information included within this packet is the map which shows
how impacted wetland will be mitigated on the Stella Hammer land, plus the maps
identifying the impacted wetland and the City Engineer's recommendations (second
page) on final improvements to the created wetland. The permit process in Section
lO-9-6{E) of the City Code requires that the City follow procedures specified for
processing conditional use permits which is why the hearing is scheduled before the
Planning Commission. As such, the Commission is authorized to establish terms and
conditions that it deems necessary to protect the public health, safety and welfare.
It would be the recommendation of the Planning staff to make the advisory comments of
the City Engineer mandatory.
Recommendation
Approve the mitigation plan and authorize the permit subject to following the plan as
submitted as amended to reflect the comments of the City Engineer.
4. DISCUSSION
a. Request from Heritage Development to Increase the Density of Development
Adjoining County Road 31 within Nelsen Hills Far.m POD
The attached concept plan indicates the proposal of Heritage to develop eight duplex
units rather than four townhouse units at the southwest corner of the intersection of
Euclid Path and Pilot Knob Road. The two elevations provide a visual comparison
between the two options. Of the two, the townhouse concept is more attractive, but
development experience in Farmington suggests that middle units in row houses are
more difficult to sell.
One limitation of the site is that a fifty foot (50') setback along pilot Knob Road
is required, which makes the row of duplexes appear more rigid than appealing. On
the other hand, the Draft Comprehensive Plan shows this entire site as a medium
density area and Farmington does have a deficiency in non-single family detached
housing. One of the main reasons the Developer has decided to pursue additional
units on this site is to make a homeowners association feasible.
If the Commission agrees that a series of four duplexes is desirable at this site,
the next decision is to evaluate if this is a minor or major amendment to the PUD.
Section lO-7-3 G. 6{a.2) suggest that this is a major PUD plan amendment which must
be authorized by the City Council.
. Recommendation
Forward a concept to the City Council which includes eight duplex units but in a plan
that provides more variety in architectural detail and layout than the submitted site
plan recommending a change in the PUD plan.
b: Request from Kwik Trip - Service Station Reorientation

The plans for the long awaited Kwik Trip service station/convenience store have been
resubmitted showing the building and pump islands fronting along Third Street. The
reason for this change is the reluctance of the County to allow any additional curb
cuts along Elm Street. The plan will need to be revised showing additional tree
cover on site (currently there is one) plus an illumination plan which indicates that
on site lighting will not infringe upon adjoining property.
The change is station orientation is likely to benefit the downtown since the
building will relate better with the City Center, which also has a building which
Ubacks" onto the railroad right of way. Kwik Trip has assured the staff that without
a conditional use permit and hearing, construction will start in late October.
Recommendation
Notify Kwik Trip that a new conditional use permit will not be required.
c. Draft of Background Population Household and Employment Data

The enclosed contract looks possible to achieve but, possibly, should only be
authorized for a three to five year period subject to renewal periodically to cover
the l4 year time span. It appears that the City has done a reasonably good job at
providing affordable housing and the one area that needs work is in non-single family
rental housing. With some effort this will also be achievable. Think about the
goals that the Planning Commission might be willing to recommend to the City Council.
e. Fence for More 4 Service Court at City Center
Enclosed is a detail of a fence being proposed at the top of the retaining wall on
the west side of the More 4 Service Court. This detail was not implemented during
the construction phase of More 4. To date, there have been no complaints about the
lack of a fence. In many ways, the landscaping and store wall will be more
attractive without the fence. However, it is included as a note on the plan that was
approved. The Developer will proceed with this fence if the Planning Commission
agrees.
