Public Hearings a. 7:00 P.M. - Front and Side Yard Variance - Gordon and Twy1la Chant - 621 Oak St. Section 10-4-1 (G) of the City Code reads as follows: In older residential neighborhoods, where structures on adjacent lots or parcels have front yard setbacks different from those required, the minimum front yard setbacks shall conform with existing adjacent structures and an addition to an existing building may be extended utilizing whatever setback has been established. However, the Board of Adjustment may permit front yard setbacks to be reduced up to five feet (5') as long as the setbacks are never less than twenty feet (20') from the right of way line. The issue of the front yard setback along Seventh Street is that front yard setbacks in this block were established at thirty feet (30') when the neighborhood developed. The proposed deck will extend into this yard ten feet (10') but will not be closer than twenty feet 920/) to the public right of way line. The height of the deck is three feet (3') above grade and, with railing, will be six and one half feet (6 1/2') above the ground. In essence, the reason for setback regulations is to prevent corner lots from blocking the interior lot street view. Provided that there is no deck cover, the proposed extension into the front yard will not block street views from the house situated immediately to the north. The steps in the side yard are being proposed to avoid interference with the outside steps to the cellar which are between the back door to the house and the carriage shed. This request was discussed informally by the Commission during the August meeting and was not found to be objectionable. Reconunendation Approve the front and side yard variances as drawn in the submitted plans subject to no future consideration being given to an added cover to the deck. b. 7:15 P.M. - Garage Moving Request from Robert Hyde - 719 Centennial Circle The accompanying site plan shows the house, pool, single stall garage and storage shed as they currently exist. Mr. Hyde intends to remove the existing single stall garage and replace it with a two stall 28' x 24' garage being purchased from the airport expansion neighborhood. The site plan indicates that the existing paved deck adjoining the pool is 44 feet from Centennial Drive which means that a 24 foot garage can be placed on site and maintain a 20 foot front yard setback. Mr. Hyde also plans to move the existing storage shed to the other side of his yard which will eliminate an encroachment into the front yard area. Mr. Hyde has spoken with neighbors who . . . Planning Agenda Report - 9/12/95 approve of the change. In addition, this request has followed the new procedure of notification to adjoining property owners. Recommendation Approve the moving permit subject to surety from the applicant, established by the Finance Director, being placed on deposit and a certificate of insurance supplied by the mover and the understanding that all work involving the garage exterior be completed within 60 days. 4. DISCUSSION a. Setback on Minor Arterial Streets - Section 10-4-1 (J) The recent public objections to realignment of County Road 31 focused upon two lots within Akin Park 2nd Addition and possibly one lot in Fair Hills Addition that do not maintain sufficient setbacks from the proposed right of way. In spite of the fact that this alignment has been proposed within Farmington's Comprehensive Plan since 1982, Section 10-4-1 (J) was not applied to those lots in the development process. In an effort to prevent a similar mistake from occurring, it is recommended that the entire paragraph under 10-4-1 (J) shall be replaced with the following: (J) The minimum front yard setback for all districts adjacent to minor arterial streets included in the Thoroughfare Plan of the Farmington Comprehensive Plan, except for those within Section 31, shall be fifty feet (50') from the planned right of way line. b. Draft Assets and Liabilities - Farmington Comprehensive Plan The enclosed list represents a first draft attempt to focus upon a specific community identity early in the planning process. The list should be expanded without being generic. c. Draft Housing Characteristics - Farmington Comprehensive Plan The Tables that are enclosed come from US Census data that will need some interpretation before being incorporated into a housing policy plan. The timing of this discussion leads directly to the next discussion for which the Metropolitan Council needs an official response by November 15, 1995. The emphasis on this discussion will ultimately lead to the ability of Farmington to accommodate "Life Cycle Housing". d. Metropolitan Livable Communities Act - Farmington Comprehensive Plan The attached information is likely to raise more questions than it answers, but it has been selected from a flood of materials distributed by the Metropolitan Council. In effect, the program is intended to call attention to the fact that each community has a wide range of housing needs and that each one should address these needs in a comprehensive way. Staff members from the Metropolitan Council will meet with the Development Committee on September 19, 1995 at 10:00 A.M. to further explain the program and help provide direction for future action. e. Roger Randall House Moving Review Roger Randall would like to have an opportunity to address the Commission informally about a location on the east frontage road of Highway 3 on which the Hed house can be located.
