PUBLIC HEARINGS 8:00 P.M. - Conditional Use Request for 1000 square foot gar~ge. a. . The Commission, in its review of this request during the special meeting held on October 25th, indicated that past policy dealing with oversized buildings in residential areas prevents the Commission from granting a conditional use unless all of the existing accessory buildings are re- moved. Mr. Thompson wishes to retain the existing two car garage. He has indicated that the property, when purchasedJ was two lots. However, it does have one PID number and is currently zoned R-l. Because the adjoining land is a PUD with an R-2 density, the property, as an isolated R-1 District, could be rezoned R-2 and split as it contains 120 feet of frontage with both the existing house and garage being contained within one lot. Once split, the oversized garage could be approved on the smaller lot provided that a new house is also built. The ordinance requires a principal use before an accessory use can be approved. If the existing garage continues to be importantJ the appli- cant could be better served by finding a location that can accommodate his storage needs. Recommendation Based upon previous discussion, approve the requested conditional use provided that all other accessory buildings are removed. 4. DISCUSSION a. Susan poirot - Request to consider expanding commercial zoning north of Budget Mart on TH 3 . The 1990 Draft Comprehensive Plan indicates that the land area immediately north of Budget Mart is recommended to be commercial. At the timeJ this site was being talked about as an expansion area for Budget Mart. Some of the proposed uses included a restaurant and car wash which, coincidentally, Budget Mart is still talking about. In essence, the commercial node illustrated on the Comprehensive Plan map was anticipated to be an integrated development rather than two isolated uses. That still would be the preferred option. However, it is difficult to see how a veterinary clinic would related to a convenience store/gas station plus an associated restaurant/car wash. The biggest question currently is access to the site which could be difficult depending upon the permit process the State will follow with respect to East Farmington. Assuming that access remains as it is currently designed from the frontage road, would the Commission feel comfortable expanding business use along Highway 3 at the present time. In the past, when the extension of utilities was a major question, .. Planning Agenda Report - 11/8/94 - Page 2 . there was reluctance on the part of the City Council to expand business zoning along Highway 3. It appears that the highest and best use of this property would either be multiple family housing or some form of business service. Probably, the applicant would be wedl advised to hold off on the development of plans until the whole issue of the prairie Waterway/East Farmington has been settled and construction is under way. Without East Farmington or a subsequent development, utility service to this site is impractical. Reconunendation Investigate the site and be ready to ask questions about the ultimate relationship between this site and Budget Mart plus the architectural character of the proposed structure. . b. Definition of Mineral Extraction in the Zoning Ordinance Currently, the Zoning Ordinance lists mineral extraction as a con~ ditional use in the two Agricultural Districts. At one time the Planning Commission was directly involved in the permit process but that was changed some time ago by the City Council. It has been suggested that a revised definition of mineral extraction would be useful to eliminate small or minor excavations from the conditional use hearing process whereas the large scale/long term excavations would be reviewed by the Commission. Currently, mineral extraction is defined as: The excavating digging or removing of earth from the land involving more than one thousand (1000) cubic yards of material. The following is an attempt to reduce the threshold for public hearings to only significant mining operations: Mineral Extraction: Any part of the process in the extraction of minerals by removing the overburden and extracting directly from the mineral deposits exposed involving 75,000 cubic yards in a calendar year or if the activity of re- moval will last more than one year. c. Resolution endorsing Land Use in Proposed Soil Condition District No. 1 The attached resolution is drafted to indicate that the land use activity proposed in the Tax Increment District is consistent with the City Comprehensive Plan. t?f~ 1} 1J,~ .
