Present: Chainnan Shirley, Members Endres and Hanson Absent: Members Hoyer and Nelson Also Present: Administrator Ford I 2. The Planning Commission dealt with the request of Mr. Elliot Halstead at 18061 Pilot Knob Road for a building penni t for a commercial building to be used in conjunction with maintaining blacktop equipment used in his business conducted at that address. It was pointed out that a letter had gone out to Mr. Halstead dated December 10, 1976 from the City Administrator indicating the problems presented by this application. He is presently located in an R-1 zoning district and such a land use would not be pennitted in that zoning district. This led to a general discussion on the part of the Planning Com- mission as to these types of land use and ,the consensus that a restricted land use of this type in large open areas, usually family owned and occupant operated, would not do serious damage to the intent of the ordinance nor would it be in- compatible with the surrounding area. It was further pointed out that the zoning ordinance had been amended earlier to pennit equipment maintenance and repair non-commercial in the C-l. It was the consensus of the Planning Commission that a similar amendment would be appropriate in and R-A district. Motion by Endres, second by Hanson that the Planning Commission recommend to the City Council that the zoning ordinance be amended by inserting as a special exception in the R-A zoning district the following "Equipment Maintenance and Storage; Non-Commercial" and further that the area presently zoned R-1 between the present Hill Dee Subdivision and the North boundary of Fannington be zoned R-A. Ford City Administrator WJF/kf I 73 I MINUTES PLANNING COMMISSION REGULAR FEBRUARY 15, 1977 The meeting was called to order by the Chairman at 7:30 P.M. Present: Chairman Shirley, Members Endres, Hanson, Hoyer Absent: Member Nelson Also Present: Administrator Ford and Planner Tooker 2. Motion by Endres, second by Hanson that the minutes of December 21, 1976 and January 18, 1977 be approved. APIF, motion carried. 3. The primary purpose of this meeting was to receive from City Planner Charles Tooker his memorandum and a copy of the Metropolitan Systems Statement as it affects Farmington and which further discloses the manner in which the existing City Comprehensive Plan must be revised. It was agreed among the members that they would take the memorandum and the copy of the systems statement, study it on their own and meet informally on February 28, 1977 at 7:30 P.M. to prepare a list of their impressions and suggestions concerning the statement which would then be forwarded to the City Planner. I 4. The Commission discussed informally with a representative of Farm Service Association and real estate agent Harvey Snyder, the status of the parcel of land on Trunk Highway 3, which is being vacated by the Farm Service Association and presently zoned R-l with a continuing non-conforming land use. The Planning Commission asked the City Administrator to meet with owners of undeveloped pro- perty in the area for input which would be considered by the Planning Commission in formulating their recommendations to the City Council. 5. After considerable discussion the following public hearings were set by the Commission in the following matters. Motion by Hoyer, second by Hanson that a public hearing be set for 7:30 P.M., March,' 15, 1977 to consider the request for variance by Fredrick-Willys at 508 Willow Street for minimum lot area, minimum front yard set-back, and minimum side-yard set back and further to consider re- commendations to the council regarding subdivision waiver. APIF, motion carried. 6. Motion by Shirley, second by Endres to set a public hearing for 7: 45 P.M., March 15, 1977 to consider the request of the Farmington Fire Department for a height variance for the construction of a radio antenna at 325 Oak Street. APIF, motion carried. 7. Motion by Hoyer, second by Hanson to set a public hearing for 8: 00 P.M. March 15, 1977, to consider the request of a variance for Off-Street parking for Housing for the Elderly and Handicapped on Spruce Street between Third and Fourth Streets. APIF, motion carried. I 8. Motion by Hoyer, second by Endres that the request of Fredrick-Willys, Inc. for variances for minimum lot area, minimum front yard set-back, and minimum side yard set-back hereby be approved at 508 Willow Street. APIF, motion carried. 3. Motion by Hoyer, second by Nelson that the request of the Farmington Fire Department for a height variance for a Class #3 pole at 325 Oak hereby be approved. APIF, motion carried. 4. Motion by Nelson, second by Endres that the request of the Farmington Housing and Redevelopment Authority for anoff~street,parking variance from 120 spaces to 15 spaces at the site of the proposed Housing for the Elderly hereby be approved with these stipulations: That if in the future the COllllCil determines that additional off street parking is necessary, the owner will provide same by con- verting green space. APIF, motion carried. 5. Motion by Endres, second by Nelson to set a public hearing for 7: 30 P.M.) April 19, 1977, to consider the request of Dakota County Electric for a special exception, public utility land use in the 1-1 zoning district at 4300 220th Street. APIF. Motion carried. 6. There was some discussion as to whether or not construction was taking place on County Road #31 north of the Hill Dee subdivision without a permit. 7. Motion made and seconded to adjourn at 8:45 P.M. The meeting was called to order by the Chairman at 5:15 P.M. Present: Chairman Shirley, Members Endres, Hanson, Hoyer, Nelson Also Present: Administrator Ford and Gil Gilbertson and Elliot Halstead 2. Mr. Halstead presented his request for a special exception at 18061 Pilot Knob Road to permit an Equipment Maintenance and Storage; Non-Commercial land use in an R-A zoning district. The Commission noted that the zoning ordinance had recently been amended to allow this type of special exception. Motion by Endres, second by Nelson to set a public hearing in this matter for 7:45 P.M., April 19, 1977. APIF, motion carried. 3. The Commission also advised Mr. Halstead that with the proposed location of the new building he would not comply with the 25 ft. side yard set-back re- quirement and suggested to him that he secure a subdivision waiver from the council and add a portion of the land to the south on which the building sits to the existing parcel on the north. They further suggested that at this time he create a separate parcel on which the buildings belonging to his Mother-in- law belong. It was also pointed out that he had an eroneous legal description. 4. The Administrator informed the Planning Commission that negotiations had been proceeding between the staff and Mr. Gil Gilbertson for municipal easements in support of project 77-1 which would bring municipal sewer and water through Westview acres to Ash Street. The Administrator informed the Planning Commission that the results of these negotiations had not been brought yet to the council but in anticipation of presenting them to the council he suggested that the Planning Commission review the need for a subdivision waiver and rezoning and perhaps make recommendation to the council. Motion by Hanson, second by Hoyer that the Planning Commission recommend to the council that the necessary sub- division waiver be granted to facilitate the acquisition of said easement. APIF, motion carried. 5. Motion by Endres, second by Nelson that the Planning Commission recommend to the City Council that the necessary rezoning be effected in order to facilitate the acquisition of the above easment. APIF, motion carried. 6. The Planning Commission reviewed the request of Dakota Electric Association to the County for turn-offs on Ash Street into the driveways for their proposed new building. Motion by Nelson, Second by Endres that the Planning Connnission recommend to the City Council that it support Dakota Electric in their request for turn-offs to the County Engineer and that further, they recommend to the council that they support any request for similar turnoffs that might be needed in the future by the developers of Westview Acres. Present: Chainnan Shirley, Members Endres, Hanson, Hoyer, Nelson Also Present: Administrator Ford 2. Motion by Nelson, second by Endres that the minutes of 2/15/77; 3/15/77 and 3/28/77 be approved as present. APIF, motion carried. 3. The Chairman opened the public hearing at 7: 30 P.M., notice of which had previously been published in the matter of the request of Dakota County Electric Association for a special exception at 4300 220th Street which would permit a public utility building in the I-I zoning district. No variances required. Motion by Endres, second by Hanson that the above special exception be granted. APIf, motion carried. 4. The commission then took up the matter of Park and Recreation matters dealing with general policy which had been referred to the Planning Commission from the City Council. Motion by Hanson, second by Hoyer that the council be informed that it be the recommendation of the Planning Commission that the policy as stated in the memo dated March 11, 1977, be approved in general with the following comments: a) that in the policy dealing with fencing on park property that more emphasis be given to a 50-50 share of cost with requesting private property owners. b) again regarding the fencing policy, the subject of future maintenance should be spelled out. The commission then opened the public hearing, previously published, at 7:45 P.M. to consider the request of Elliot Halstead for a special exception at 18061 Pilot Knob Road, or adjacent thereto, for an Equipment Maintenance and Storage; Non- Commercial land use, in an R-A zoning district. Motion by Shirley, second by Nelson that the special exception be granted with the following stipulations: a) This special exception does not in any way include any activity connected with automobile, automotive sales and service open to the public. b) Mr. Halstead will furnish a survey and will legally replat as shown in the drawing attached to the special exception. c) Mr. Halstead agrees to install satisfactory screening the length of the new shop which is not paralleled'by the existing chicken coop on the south line toward the west end of the shop. APIF, motion carried. 6. A request by Robert J. Kane, 5815 Upper 183rd St. for a side lot variance for the construction of a garage was deferred to allow the commissioners to view the property themselves. 7. The commission then discussed the possible rezoning from R-l to B-1, the land formerly owned by Farm Service Association on T.H. 3. It was noted that invitations had been sent to owners of large undeveloped parcels in the immediate area asking them to attend the meeting and to give the conunission the benefit of their input in this matter. Considerable discussion followed. It was noted that Farm Service had sold the land to Leibfried Construction who intended to move his headquarters from Lakeville to this site. It was further noted that present land use by Farm Servic€ had been "grandfathered" in prior to the adoption of the zoning ordinance 80 and that failure of the city to legitimatize the commercial use of that land could result in substantial capital loss to Farm Service. In the discussion I it was further brought out that a parcel of this size consisting of 1.1. acre would probably not be subject to the challenge of spot zoning. Motion by Hoyer, second by Nelson that the Planning Commission recommend to the City Council that this area be rezoned from R-1 to B-1, Highway Business. APIF, motion carried. 8. In anticipation of the council's action, the Planning Commission set a public hearing for 7:30 P.M., May 17, 1977, to consider the request for a special exception from the new owners of the above site to pennit a warehouse, bulk oil, office land use in the B-1 zoning district. 9. The meeting was called to order at 7: 30 P.M. by the Chainnan Present: Chainnan Shirley, Connnissioners Endres and Hanson Absent: Corrnnissioners Hoyer and Nelson 2. The Chainnan opened the public hearing, notice of which had previously been published at 7:30 P.M., to consider the request for special exception from Liebfried Construction for office and warehouse in the B-1 zoning district at 701 8th Street. Mter those in the audience had been given ample opportunity to voice their opinion and after a thorough discussion among the corrnnissioners themselves, Motion by Hanson, second by Endres that: 1) The bulk oil tanks and distribution pumps located on applicants property are hereby designated as accessory uses to the main business conducted there and not open to the public. 2) That the required 50 off-street parking spaces do exist. 3) In accordance with the authority granted under Title 2, Chapter 4, the following special exceptions are hereby granted: a. Title 10, chapter 7, section 1CE) 5. Office b. Title 10, chapter 7, section 1CE) 7. Wholesale Business c. Title 10, chapter 7, section 1CE) 8. Supply Yards 4) In accordance with the authority granted the corrnnission under Title 2, Chapter 4, section 3 of the City Code the following variances are in- cluded in the granting of the special exception: a. Side Yard - North 1. Driveway - the west 170 feet; from 20' to 3' 2. Building - the east 130 feet; from 30' to 15' except. 3. Building - the easterly 30 feet; fram 30' to 3' b. Rear Yard - East 1. Building - the north 170 feet; from 30' to l' 2. Building - Bulk storage facility; fram 30' to 25' APIF, motion carried. 3. The next item on the agenda was a reactivated request of Robert J. Kane of 5815 Upper l83rd Street West for a side lot variance originally submitted at the meeting of J\pril 19, 1977. No one appeared in regard to this request. No action taken. 4. The meeting was called to order by the Chainnan at 7:30 P.M. Present: Chairman Shirley, Members Hanson and Hoyer Absent: Members Endres and Nelson Also Present: Administrator Ford 2. Motion by Hanson, second by Hoyer that the minutes of April 19 and May 17, 1977 be approved as presented. APIF, motion carried. 3. Mr. Don Feely discussed with the Commission informally the possibility of removing an existing Quonset Hut at the site of his elevator on 2nd & Spruce St. and building a new grain storage facility. The Planning Commission determined that such a facility would probably qualify for special exception as a wholesale supply yard. Mr. Feely was informed that this area was within the HRA Development District and that he should meet with the HRA at their meeting of July 6, 1977. Motion by Hoyer, second by Hanson that the Commission set a public hearing for 7:30 P.M., July 19, 1977, to consider the granting of a special exception to Mr. Feely regarding the above. APIF, motion carried. 4. The Administrator relayed to the commission the intentions of the new owner of the Townsedge Shopping Center, which at this time, primarily involved the condo- miumizing of the existing Townhouses for sale to independent parties. The Planning Commission authorized the City Administrator to prepare and amendment to the zoning ordinance to allow for zero lot set backs for condomium townhouses. 5. The Planning Commission also requested that the City Administrator prepare a sample ordinance which would require visual screening by a developer within an R-3 or nonresidentially zoned development which abuts any residential zoning dis- trict boundary, and to recommend a minimum boundary separation and minimum square footage. 6. Present: Chainnan Shirley, Members Endres, Hanson, Hoyer, Nelson Also Present: Administrator Ford 2. Motion by Hoyer, second by Hanson that the minutes of June 21, 1977, be approved as presented. APIF, motion carried. 3. Mr. Dennis Madden appeared before the corrnnission in regard to the matter which had been discussed by the corrnnission at their previous meeting involving the possible replatting of Townsedge Replat, lot line variances and other matters. Mr. Madden reiterated his desire to replat the Townhouses in such a way as to accorrnnodate the condominiumizing of the structures for private ownership and to replat the lot on which the apartment house now sits to incorporate within that lot line the existing garages which are associated with the apartment houses. Mr. Carey and Mr. Gustafson, residents in the area, were in the audience and directed several questions to Mr. Madden and to the commission. It was pointed out that Mr. Maddens current request did not deal in any way with the elimination of the ponding area now located on the shopping center portion of the property nor with the request or construction of a free standing building on that property. Motion by Hoyer, second by Shirley that the Planning Corrnnission express its consensus as being in agreement with the general concept of Mr. Madden's request and instructing him to prepare a more detailed drawing showing the existing lot lines, the proposed lot lines, existing buildings and proposed new construction. Mr. Len Novitzki then discussed briefly with the corrmission the request which the Downtown businessmen had made to the council concerning off-street parking provided for on an area of Railroad right-of-way previously leased by the City. It was agreed that the City Administrator would search the files and provide to Mr. Novitzki, all of the data available concerning off-street parking, on-street parking, and parking leases with the Railroad. 5. The City Administrator infonned the Planning Commission that a previously scheduled public hearing which was to be held on the 19th of July, 1977, at the request of Mr. P. H. Feely for a special exception at 420 2nd Street, had been cancelled as a result of Mr. Feely's request that his petition be withdrawn and the public hearing not be conducted until after he had cleared through with the HRA with whom he had met on July 6, 1977. 6. Ford --, City Administrator APPROVED WJF/kf I I I 87 MINUTES PLANNING COMMISSION SPECIAL EXECUTIVE SESSION AUGUST 9, 1977' 1. The meeting was called to order by the Chairman at 7: 00 P.M. Present: Chairman Shirley, Members Endres, Hanson, Hoyer and Nelson Also Present: Administrator Ford, Attorney John McBrien and Associate McCormick, Planner Tooker, Engineer Blaisdell and sitting in as observers Cotmcilmen Kuchera and Whittier. 2. The Chairman entered into the record, a notice which had been mailed to members of the Planning Commission, setting this special meeting for 7:00 P.M., August 9, 1977 at the request of Special Counsel John McBrien, to discuss in executive ses- sion, the legal strategy to be used preparatory to the upcoming Minnesota Mlmicipal Board hearings scheduled for August 17, 1977. The Administrator informed the Planning Commission, for the record, that the press had been notified that the meeting was taking place. 3. Mr. McBrien, for the benefit of those present, reviewed the history and back- ground of the present annexation action culminating in a scheduled hearing for August 17, 1977, before the Mlmicipal Board. A general discussion between the attorney and the Planning Commission insued followed by technical input from the planner and the engineer. 4. This meeting was conducted as an executive session, the press was notified and a record of the proceedings have been kept and filed with Special Counsel John McBrien. The Chairman called the meeting to order at 7:30 P.M. Present: Chairman Shirley, Members Hanson, Nelson Absent: Members Endres and Hoyer Also Present: Administrator Ford, Planner Tooker 2. The City Administrator informed the Commission of a letter received from Dennis Madden dated August 15, 1977, asking that the matter involving his request for review of an amended plat be deferred to the next meeting of the Planning Commission. 3. The balance of the meeting was devoted to a discussion among members of the commission and City Planner, Charles Tooker, reviewing the proposed work plan to be used in updating the comprehensive plan as required by recent State Law. Motion by Hanson, second by Nelson that the work plan presented by the City Planner, as amended be adopted and that the City Planner be instructed to pro- ceed in accordance therewith. And further, to recommend to the City Council that a resolution be submitted to the Dakota County Board requesting $1,000.00 in allocated planning funds. APIF, motion carried. 4. The meeting was called to order at 7:30 P.M. by the Chairman Present: Chairman Shirley, Members Hanson, Hoyer, Endres Absent: Member Nelson 2. Motion by Hanson, second by Endres to approve the minutes of August 9, 1977 as presented. APIF, motion carried. 3. The minutes of August 16, 1977 were deferred pending clarifi- cation of paragraph #3. 4. The Planning Commission requested the City Administrator to prepare and submit to the City Council, an amendment to the Zoning Ordinance which would, in effect, put a time limit on special exceptions and variances granted by the Board of Adjustment. 5. The Commission took note that the meeting of September 20, 1977 had been postponed and that a representative of the commission was in the room to inform any interested parties that the meeting of 9/20/77 was postponed to October 18, 1977. I 6. An agenda item for this meeting included the appearance of Mr. Wayne Barseness 505 8th Street, with an advisory inquiry concerning the possibility of a home occupation, special exception at that address. The Chairman wished to note that Mr. Barseness did not appear at this meeting. 7. Motion made and carried to adjourn at 8:10 P.M. Respect~u~l~~ William J. Present: Chairman Shirley, Members Endres, Hanson, Hoyer and Nelson 2. Motion by Hoyer, second by Hanson to amend the minutes of August 16, 1977 paragraph #3 to read: "Motion by Hanson, second by Nelson that the work plan presented by the City Planner, as amended, be adopted and that the City Planner be instructed to proceed upon approval of the City Council". APIF, motion carried. 3. Motion by Endres, second by Shirley to approve the minutes of October 18, 1977 as presented. APIF, motion carried. 4. The commission considered the petition of Allen Brosseth for a variance of a front lot set back from 30 ft. to 20 ft. at 200 4th Street. The commission re- viewed their past policy of waiving the maximum 30 ft. set back when a lessor set back would conform, in general, with other houses on each side of the applicants property. The commissioners had viewed the site relative to this application and agreed that the policy would apply in this case. Motion by Nelson, second by Hanson that the commission make a finding of fact that a set back of 20 ft. in this instance instead of the 30 ft. would be in general compliance with the previously expressed policy of the Planning Commission. Present: Chairman Shirley, members Endres, Hanson, Hoyer, Nelson Also Present: Administrator Ford, Asst Executive Director of HRA Anderson 2. The purpose of the meeting was to consider the request of the Farmington HRA for a special exception and a variance for the Housing for the Elderly proposed at 300 Spruce Street. Motion by Endres, second by Nelson that a public hearing be set in the matter for 7:30 P.M., Tuesday, December 6, 1977. APIF, motion carried. 3. The Planning Commission also decided that in that this special meeting would take place, that the regular meeting of December 20, 1977 would not be held and that the newspaper should be informed. 4. Present: Chainnan Shirley, Members Hanson, Hoyer, Nelson Absent: Member Endres Also Present: Administrator Ford 2. The Chainnan opened the previously published publiC:~hearing to consider the request of the Fannington HRA concerning the proposed Housing for the Elderly Facility at 300 Spruce Street. The requests were as follows: a) Request for Special Exception for Housing for the Elderly and Handicapped in a B-2 Zoning District in accordance with Title 10, chapter 7, section 1(f)10 of the city code. b) Request for variance at the same address of a land to building ratio of from 2.5:Lto 2.08:1. Motion by Hoyer, second by Nelson that a special exception for Housing for the Elderly and Handicapped at 300 Spruce St. hereby be approved. APIF, motion carried. Motion by Hoyer, second by Nelson that all other requirements of title 10, chapter 8, section 5, having been complied with concerning housing for the elderly facility that a variance be granted reducing the required land to building ratio from 2.5:1 to 2.08:1. APIF, motion carried. 3. The Planning Commission then discussed with representatives of the Ken-Rich Company their proposed new business to be operated out of a building presently owned by Mr. Al Fischer at 201 Spruce Street. Mr. and Mrs. Sauser infonned the Planning Commission that their business involved no manufacturing and no direct retail sales. It did involve fabricating drop cloths, excelsior corner pads, tapered packaging bags and other items of that sort made from pre-manufactured plastic and packaging material. They infonned the commission that their operation involved no noxious fumes, no loud noises, no odorous smells or night operation. They further infonned the Planning Commission that no modification to the structure would be necessary and on behalf of the owner, Mr. Al Fischer, they forthwith requested a special exception for a warehouse land use at that address in a B-2 zoning district in accordance with Title 10, chapter 7, section 1(s)6. Motion by Hanson, second by Nelson that a public hearing in this matter be set for 5:15P.M. December 27, 1977, in council chambers, and that publication of notice of same, not be later than December 15, 1977. APIF, motion carried. 4. Motion by Hanson, second by Shirley to approve the minutes of July 19, 1977, November 15, 1977 and November 21, 1977. APIF, motion carried. 5. The Planning Commission then discussed a discussion paper prepared by the City Administrator dealing with the proposed amendment to the Zoning Ordinance which would provide for two new types of special exceptions - (a)Portional and (b) Transitional. After considerable discussion the Planning Commission agreed that the ordinance did need amendment and that amendment should be made along the lines suggested in the discussion paper. Motion by Hoyer, second by Hanson, that the proposed amendment to the zoning ordinance, as described in the discussion paper dated 12/6/77, be recommended to the council for adoption. The meeting was called to order at 5: 15 P.M. by the Chainnan Present: Chainnan Shirley, Members Endres, Hanson, Hoyer Absent: Member Nelson Also Present: Administrator Ford 2. The minutes of December 6, 1977, were deferred. 3. The purpose of this meeting was to consider the application of Mr. Al Fischer for a Special Exception, Wholesale Business in a B-2 zoning district at 201 Spruce Street. Publication of notice of which was made in the Dakota County Tribune on December 15, 1977. The Administrator infonned the Board of Adjustment that no complaints had been filed in his office or connnents of any kind. Motion by Hoyer, second by Hanson that the special exception, above described, be approved. APIF, motion carried. 4. A short general discussion followed.
