DISCUSSION a)Whispering Fields 2nd Addition Final Plat D.R.Horton,Inc.-Minnesota has applied for final plat for Whispering Fields 2nd Addition. The development is located directly south of Farmington High School off of Flagstaff Avenue.The 2nd Addition completes the Whispering Fields subdivision and consists of 56 single-family lots on 13.229 acres which is part of the 119 overall single-family development.The lot sizes within the 2nd Addition final plat vary from 6,500 square feet up to 16,163 square feet in size. Lot widths vary from 49 feet up to 80.10 feet. Flanders Way,Fleming Street and 209th Street W will be extended with the 2nd Addition. Five-foot-wide sidewalks will be constructed on the east side of Fleming Street,south side of 209th Street W and on the south and west side of Flanders Way.An eight-foot-wide bituminous trail will be constructed along Flagstaff Avenue to the northern boundary of the 2nd Addition where the trail will then extend west through Outlot B Whispering Fields 1St Addition and connect to the southern road on the High School property. Debra from D.R Horton.Inc.gave an update on the current construction of Whispering Fields 1St Addition.D.R.Horton Inc.has not opened the development for sales yet.They plan on starting that process at the end of May or early June 2022.They are waiting for more homes to be built before selling. Commissioner Tesky is excited about the development coming to completion as well as trails and sidewalks being tied together.Commissioner Windschid asked about Outlot B and if it will be paved.Planning Manager Wippler stated it will be a 24'wide section of paved road.Chair Rotty inquired about who will be able to use this temporary space.Debra from D.R.Horton,Inc.answered that it will be public so there will be a public roadway,drainage, and utility easement over the space which will get vacated when the lots get platted with future development.The city will maintain and plow it for now since it is public. Commissioner Lehto inquired if D.R.Horton,Inc.has decided on sale prices for these single- family homes in the development.Debra from D.R.Horton, Inc.anticipates the homes starting around$450,000,but the prices may increase close to$500,000. Planning Commission Minutes Pagel of 2 Regular Meeting April 12,2022 Chair Rotty asked if there were any updates on the resident located outside of the Whispering Fields development in the southeast corner located at 20993 Flagstaff Avenue. Both D.R.Horton and the City of Farmington have not heard anything from the resident and if they are looking to sell. MOTION by Tesky,second by McAbee to recommend approval of Whispering Fields 2°d Addition final plat with two contingencies,the satisfaction of all engineering comments related to the construction plans for grading and utilities and a Development Contract between the applicant and City of Farmington shall be executed,documents submitted,and security fees and costs shall be paid,and forward that recommendation to the City Council. Existing Zoning: R-1 (Low Density Residential) DISCUSSION Jessica Mastey has applied for an Urban Chicken Permit. The permit is requesting the keeping of 3 hen chickens on the property located at 5447 188th Street W. The coop and run are existing structures that are being brought the property from the applicant's previous property. The coop is 16 square feet(4'x 4') in size with a height of 5 feet. The proposed fenced in run is 100 square feet in size(10'x 10')with a height of 6.5 feet. Code requires that any fenced in chicken run must not exceed twenty(20)square feet per chicken and fencing must not exceed six feet(6') in total height. The proposed run exceeds maximum area by 40 square feet and exceeds the overall height by 6 inches. The run will have to be modified to meet these standards if the permit is approved. As shown in the attachments,the coop and run are proposed to be located in the northwest portion of the lot. Code requires that all coops and runs shall be setback a minimum of 10 feet from all property lines and also be a minimum distance of 25 feet from any principal structure on an adjacent lot. It appears that the placement as shown in the attachments meets these requirements. Lot coverage with the coop of 16 square feet would be approximately 22.36%. The maximum lot coverage allowed in the R-1 zoning district is 30%. Section 10-6-29(k)6 states that any chicken coop or run must be screened from view with a solid fence or landscape buffer with a minimum height of 4 feet. The property is not currently fenced. The applicant has indicated that no additional perimeter fencing will be added with the coop and run. Staff believes there is adequate natural/landscaped screening along the perimeter of the backyard (see attached aerial). That in combination with the subject property being substantially higher in elevation than the properties adjacent to the north, additional screening is not necessary. ACTION REQUESTED Approve the Urban Chicken Permit subject to the following conditions: 1. A renewal permit shall be applied for and administratively approved every year after the Urban Chicken Permit has been approved that chickens are kept on the property. 2. The run must be modified to be in compliance with City Code and cannot be more than 60 square feet in total area and 6 feet in height. 3. All other requirements specified in Section 10-6-29 of the City Code shall be abided by. The applicant is requesting a rezoning of the subject property from R-4(High Density Residential)to B-3 (General Business). DISCUSSION Mr. Colin Garvey is the owner the property located at 100 5th Street. Dakota County Lumber has entered into an agreement with Mr. Garvey to purchase the property for the future expansion of their business. The property was rezoned to R-4 (High Density Residential) as part of the 2040 Comprehensive Plan, which had guided the property as High Density Residential. Rezoning the property to B-3 (General Business)will allow for the expansion of Dakota County Lumber as Supply Yards are listed as a permitted use within the B-3 zoning district. Rezoning of the property will also require that the 2040 Comprehensive Plan be amended to reflect the zoning(change from High Density Residential to Commercial). In the coming months staff will be starting to review the 2040 Comprehensive Plan and will be looking at specific corridors throughout the community to update and amend the comprehensive plan as appropriate. Staff would include the change for this property with that process. Farmington 115 LLC is the owner of the property of 115 Elm Street. DISCUSSION The property at 115 Elm Street currently consists of two lots (please see aerial with current parcel configuration). The larger parcel, shown as parcel A on the attached aerial, contains the former grocery store building, retail strip center, and parking area. Parcel B contains the additional parking area. The applicant is proposing to clean up the parcel lines with the attached final plat. The Great Oaks Academy final plat consists of two parcels. Lot 1, Block 1 would contain the former grocery store building and a portion of the parking located directly south and east of the former grocery store building. Lot 2, Block 1 will contain the strip center and the remaining parking area on site. The property is zoned B-2 (Downtown Business) and both lots meet the minimum requirements for lot size and width. The property is adjacent to County Road 50 (Elm Street) and is therefore subject to the Dakota County Contiguous Plat Ordinance. The Dakota County Plat Commission met on April 27, 2022 and approved the plat with the condition that a right turn lane be installed in the existing right-of-way of Elm Street due to the redevelopment of the site. The developer, Lennar, has recently submitted the 1st Addition Final Plat for review by the Planning Commission and City Council. The entire site contains 75.78 acres with the developer platting 76 units in the 1st phase. DISCUSSION The developer is proposing 76 townhome units in this first phase of the Vermillion Commons development. Vermillion Commons is a private townhome development that will be maintained by a homeowners association. The approved preliminary plat for Vermillion Commons proposes 276 townhome units over the 75.78 acres yielding 6.7 units/acre(this calculation excludes the area of the subject property that is guided as Park/Open Space within the city's comprehensive plan). The property is zoned R-3 (Medium Density Residential) and guided as medium density residential in the 2040 Comprehensive Plan. This land guidance allows for 6- 12 dwelling units per acre. Vermillion Commons is being developed as a Planned Unit Development in large part due to the use of private streets. Additionally, a deviation that will be addressed through the PUD will be the side corner setback requirement. Code requires a 25 foot side yard setback on a corner, 15 feet is being proposed with this development. I n addition to the 76 townhome lots,this final plat consists of 19 outlots (labeled A-S). Outlot A is 56.17 acres and consists of a mixture of future development,floodplain/open space as well as easements for four(4) natural gas pipelines. Outlot B is 1.88 acres and will contain a stormwater facility. Outlot J consists of the private roads within the first phase. All remaining outlots consist of common areas around the townhome lots. Access to the site is provided off of Denmark Avenue and 220th Street W, via the extensions of 218th Street W and Denton Avenue, respectively. 218th Street W consists of a 70 wide right-of-way with a 38.92 foot wide roadway. Engineering Review The Engineering Department has reviewed the Vermillion Commons final plat and recommend approval upon satisfaction of all engineering comments related to the construction plans for grading and utilities as well as the applicant entering into a Development Contract with the city and all security and fees and costs paid. ACTION REQUESTED Recommend approval of the Vermillion Commons final plat and PUD contingent upon the following, and forward that recommendation on to the City Council: 1. The plat should be revised to show ten (10')foot wide drainage and utility easements around the perimeter of Outlot B instead of the coverall easement currently indicated on the plat. 2. The satisfaction of all engineering comments related to the construction plans for grading and utilities. 3. A Development Contract between the applicant and City of Farmington shall be executed and security fees and costs shall be paid.
