Highway 50 Commercial/Industrial Corridor
A discussion regarding potential land use designations took place for the
properties located generally in the southwest corner of the City. Staff
will prepare a map based on the EDA members' comments to bring to
the November EDA meeting for further discussion.
Mission Statement (see attached)
The EDA adopted a mission statement (see above).
McVicker Lot - Heinen
Mr. Heinen has requested that the timeline in the Development Contract
for developing the McVicker lot be modified. At the EDA's direction,
staff will contact the City Attorney to request that an addendum be
prepared for the EDA to take formal action on at its next meeting.
JIT Powder Coating
JIT will hold its open house, October 24, 2006, from 2pm to 5pm to
showcase its expansion. JIT is located in the Industrial Park at 21020
Eaton Avenue.

Sorry I haven't been in touch lately - this week has been difficult wi the
transition. Today is my first day up on the ICMA system - tomorrow promises
to be my first day wi the new mobile number. The good news is that I've met
with the Peer team and we are busily making plans, etc. We plan to make
contact with everyone on the list you supplied for the background interviews.
Everyone on the list should expect a call within the next few days to set up a
time for interviews. Mark Nagel and Richard Fursman will be conducting
many of them, although Craig Waldron and I will also be involved.
The bus trip and route has been mapped out. Ideally, we'd like to leave
Farmington at approximately 8:00 am on Sat. Nov. 18th and return about
2:00pm. We will visit the following cities for extended observation and
discussion - Elk River,Anoka, Andover, Oakdale and Rosemount. In addition,
we will observe and briefly discuss Ramsey and New Brighton as we drive our
route.
Elk River, Anoka and Rosemount all have both a traditional downtown and
significant industrial park development. Andover has a 'new' downtown that
was created, and Oakdale has significant office and industrial development
that was initiated and directed by the City. Our team has direct experience in
each of these cities, and will be providing details of what it took to develop,
and the lessons they learned. The cities we will visit are also somewhat
similarly situated in relation to the metro to Farmington.
We will arrange to have box lunches for the group.
Now that I am situated, I will be in contact more regularly. I wanted to get
this update to you so you could inform the EDA at their meeting on Monday.

The August 28, 2006 Minutes were not recorded due to technical difficulties. The
attached minutes were created from staff notes from the meeting. Community
Development Director Carroll indicated that in the future the Minutes will be
more summarized and concise than they have been in the past.

Unfinished Business
a.) 305 3rd Street (Former Liquor Store Building)
A Lease Agreement with Broadband Solutions has been reached. The original
Agreement has been revised with regard to taxes. Due to the fact that the property
will eventually lose its tax exempt status, there will be property taxes due in 2008.
The taxes will be based on the building's use during 2007. Staff is recommending
removing the payment of taxes from the Lease Agreement entirely, but leaving a
definition of taxes in the document for future reference. The County has indicated
that there would not be a mid-year adjustment of the building's tax status, so there
would not be taxes due during the initial lease period. The Lease Agreement also

requires that the tenant, Broadband Solutions pay for any building maintenance
and repair while they are renting the space. The tenant will provide signage to
indicate their presence in the space. Broadband Solutions has indicated that there
will be adequ"ate parking to meet their needs.
Member Collignon stated that he is concerned that this type of business does not
generate foot traffic to draw customers into the downtown area. He stated that
this tenant may not be the best fit for the space and would rather wait to find a
tenant that better compliments the plan for the downtown area. Member Hardt
indicated that he agrees that this tenant might not be the best fit but he would be
in favor of going ahead with the lease and focusing on finding a tenant that will
draw more foot traffic in the future.
MOTION by Hardt, second by McKnight to approve the Lease Agreement with
the revisions. APIF, MOTION CARRIED.
b.) Exchange Bank Building
Photos were distributed to the Members showing the status ofthe construction
work being done to the building. The fire escape is under construction and the
fire sprinkler system is nearly complete. The progress is satisfactory at this time.
The Members were pleased with the work being done.
c.)
Mission Statement
Each ofthe Members has submitted preliminary ideas for the EDA Mission
Statement. Member Hardt indicated that he would like to review the suggestions
at tonight's meeting and then continue this item to a later date for completion.
Member Collignon stated that he wanted the Mission statement to be broad
enough to not limit the focus of the EDA. Member Fogarty felt that the Mission
Statement needs to be flexible as well. The Members agreed that housing
redevelopment should be included in the EDA's Mission Statement because they
are still the HRA as well. There was discussion regarding how surrounding areas
impact the City of Farmington's growth and development as well. The Economic
Growth Committee should be a valuable tool with regard to EDA cooperation
with the surrounding areas. Each of the Members will review the submitted ideas
and there will be further discussion on October 9,2006.
8. New Business
a.) Workshop Date (October 9,2006)
The date of October 9,2006 at 7:00 p.m. for the EDA Workshop was convenient
for all of the Members. The Workshop will be held in the Round Bank
Community Room.
b.)
"Bioscience Zones"
The City Council approved the proposed resolution on September 18, 2006. Staff
will be preparing information for Dakota Future for Farmington's inclusion in the
application submitted to the State of Minnesota. The item will also be reviewed

by the Dakota County Board in early October. Staff indicated that Bioscience
Zones will not cost the City of Farmington anything and there are benefits to
having Zones located here. There are financial benefits to businesses that utilize
those areas and this may offer incentive for companies to build facilities in
Farmington.

9. City Staff Reports/Discussion
City Administrator Herlofsky stated that he is hopeful that the EDA will be
pleased with the consultant that was chosen for the Workshop.
Member Collignon said that he has noticed recently that there seems to have been
an increased interest in business expansion in this area. He feels that ifthe subject
of industrial space is not addressed soon, we may lose businesses.
Member Fogarty stated that she feels that some of the properties still zoned
Agricultural Preserve may need to be designated industrial in order to increase the
amount of developable land that we have available. She feels that it may be
appropriate to start conversation with the property owners to try to initiate this
transition.

Administrator Herlofsky indicated that there will be a sewer interceptor coming
through on the southern portion ofthe City in the next few years. He feels that
dealing with the two Townships to the south of Farmington may also be critical in
addressing this issue.
Community Development Director Carroll stated that he has been communicating
with the Devney family regarding the properties in question and he feels that the
property owners are inclined to sell the property as residential. He thinks that
they may be slowly warming up to the idea of industrial uses. He stated that they
have allowed for the extension of20gth street through their property.
Member Collignon stated that there needs to be more financial resources made
available to businesses to increase development.
Member Fogarty indicated that she would like more information about the
potential rezoning ofthe properties in question. Administrator Herlofsky stated
that we should gather our information before we make contact with property
owners. This discussion also relates to the upcoming Comp Plan Update and the
EDA's portion of that process.

At the EDA's regular meeting in September, a brief discussion occurred regarding the need to
eventually designate more land in Farmington for future industrial development. Most of that
discussion focused on properties adjacent to CSAH 50, which is currently the City's primary
east-west corridor and the location of most of the City's industrial development to date.
Attached hereto is a staff-prepared map that identifies the current zoning classifications for
certain properties located within and near the relevant portion of the CSAH 50 corridor in
Farmington and Lakeville. The owners of record for the Farmington parcels, the acreage of those
parcels, and any parcels currently enrolled in the Metropolitan Agriculture Preserve Program are
shown as well. At the September meeting, a question, regarding the process for removing
property from the Agriculture Preserve Program was asked. Please see the attached
informational sheet for more information regarding that process.
RECOMMENDED ACTION:
Discuss various locations for future industrial development.

What is the Metropolitan Agricultural Preserve Program?
"Agricultural Preserve" is governed by Minnesota Statute 473H.01.
The Agricultural Preserve Program is designed to value and tax qualifying agricultural
property located in the metropolitan area, in a manner similar to out-state Minnesota.
Market Values for Agricultural Preserve property is based on sales of similar
agricultural property not located in a metropolitan area.
What is required to enroll in the Agricultural Preserve Program?
The property must be zoned long-term agricultural by the local community, with a
maximum residential density of one house per forty acres.
The parcel must (normally) be forty acres in size, however, smaller tracts may qualify
in certain instances. Contact the County Assessor or the City/Township authority for
information.
The owner(s) apply for Agricultural Preserves with the Local City/Township.
The owner signs an eight-year perpetual convenantlagreement to leave the property
in agricultural use, and farm using acceptable practices as approved by the County
Agricultural Service.
The Agricultural Preserve application must be filed with the County Recorder.
Who can qualify and who has approval authority?
All owners of qualifying agricultural property may apply regardless of homestead
status.
The Local City/Township approves or denies the application.
The Agricultural Preserve agreement transfers with the land if it is sold, and does not
remain with the owner.
What are the property tax benefits of Agricultural Preserves?
There is no deferred tax like there is in "Green Acres."
Special assessments cannot be levied on Agricultural Preserve property.
Annual property taxes are based on the agricultural market value only.
An additional property tax credit of $1.50 per acre is applied; or
The tax calculated using 1 05% of the statewide average tax rate is used if that tax is
less than calculated using the $1.50 per acre credit.

The owner(s) may file an "Expiration Notice" at any time and file the Expiration with
the County Recorder and Assessor.
The local city/township may file an 'Expiration Notice" with the County Recorder and
Assessor.
Eight years after the Expiration Notice is filed, the property is out of Agricultural
Preserve.
A waiver of the eight-year requirement may be granted only by action of the Governor
due to some emergency.

I write this letter to you (and at the same time other members of City staff, including the
EDA) to address the status of the McVicker project. As you are aware, the deadline for
construction plan submission has elapsed, however, I remain enthusiastic for completing
this exciting project and wanted to offer the following points of discussion as to the
"delay" and also provide a revised timeline for moving forward:
.
1. Delay in obtainine: title on the 4th & Main lot. As you and I have discussed, my
expectation was to complete the physical transfer of the house (#315 Elm) to the
4th & Main lot prior to making a substantial investment in the McVicker project. I
am pleased to have "closed" on the purchase of the lot, however, the process took
quite a lot longer than we expected due to the complexities in dealing with Dakota
County, MPCA and clearing the multitude of environmental hurdles. Having said
that, we're nearing the physical move of house and offer the following timeline
for its completion:
a. Planning docs / approval. Completed.
b. Excavation: Week of 11/13/06
c. Physical transfer: 12/1/06
Due to the size of the overhead electrical wiring on Elm Street that has to be temporarily
disabled, Xcel Energy cannot accommodate our request until December 1 st. The funding
is in place and the contractors are set to complete the work.

2. Timine: of Elm Street Reconstruction Proiect ("ESRP"), As an owner of
commercial property in the Downtown area, I am certainly supportive of the
ESRP and feel that it is necessary and will provide long term value to local
business owners. However, the implementation of the ESRP improvements - as
we all would expect-will provide some level of disruption to Downtown
businesses and residents. I have dealt first hand with this issue in talking to
.
prospective tenants about leasing space in the Downtown area. Most prospective
tenants simply decide to "look elsewhere" until such time as ESRP completion.
To be candid, I did not incorporate the significance of this issue into the initial
planning for the McVicker project. Indeed the timeline for the ESRP was
uncertain when we drafted the development contract. For this reason, my strong
preference would be to construct the McVicker building under a timeline that
broadly coincides with that of the ESRP. This will allow a "grand opening" of the
new building at the approximate time of the reopening of Elm Street in late fall
2007.
.
3. Meanineful Proeress Has Been Made. Please recognize that I have already
invested over $10,000 in planning documents and a site survey. These planning
documents have included conceptual renderings and detailed floor plans that have
been made more complex as we've attempted to deal with the challenges involved
in "tying" into the structure on the North side. As you know, we've spent
considerable time exploring whether it was feasible to incorporate this structure
into our design and I believe we now have resolution to this issue.
4. Revised Timetable for Completion of the McVicker Site. Given the points
raised above, I would propose the following revised timeline as to the completion
of the McVicker site:

I also wanted to let you know that we will begin marketing the property for lease,
beginning with the installation of a site sign that will include an image of the proposed
elevation. I expect to have this up by the first week in November.
As a related matter, once the #315 house is moved to 4th & Main, I will be placing a
"build to suit" sign promoting the idea/elevation that I earlier shared with the EDA
regarding a potential two-story addition to the 301-305 building.
Kevin, I do not mean for any or all of these points to represent an "excuse" for the delay
in "breaking ground". My hope is that we can recognize the broader context in which
this project is occurring and amend our plans to move forward as I've indicated above. I
remain excited to be a property owner in Farmington and look forward to pushing this
project (and others) ahead.
