PLANNING COMMISSION MINUTES
REGULAR MEETING
September 13,2022
1. CALL TO ORDER
The meeting was called to order by Chair Rotty at 7:00 p.m.
Members Present: Ratty,Lebto,McAbee,Tesky,Windschitl
Members Absent: None
Staff Present: Tony Wippler,Planning Manager
2. APPROVAL OF MINUTES
a)Approve Planning Commission Minutes
MOTION by Windschitl,second by Lehto to approve the Regular Meeting minutes of the
Planning Commission from July 12,2022.APIF,MOTION CARRIED.
3. PUBLLIC HEARINGS
Chair Rotty opened the public hearings.
a)An Ordinance Amending Section 10-5-17 (Industrial) of the Zoning Code Allowing
Offices as a Permitted Use
Planning Manager Wippler introduced the proposed ordinance amendment. The
amendment adds offices as a permitted use within the I (Industrial) zoning district.
Currently office showroom and office warehouse uses are allowed as permitted uses within
the I (Industrial) district so it seems appropriate to allow offices as a permitted use within
this zoning district as well.
MOTION by McAbee,second by Lebto to close the public hearing. APIF,MOTION
CARRIED. MOTION by Lehto,second by Tesky to recommend approval of the ordinance
amendment allowing offices as a permitted use within the I (industrial) zoning district and
to forward that recommendation on to the City Council. APIF,MOTION CARRIED.
4. DISCUSSION
a) Empire Township/Farmington Orderly Annexation Agreement Update
Planning Manager Wippler updated the commission on the status of the incorporation of
Empire Township. The city and Empire,rownship entered in to an Orderly Annexation
Agreement in 2008. The agreement encompassed 574 acres of land within the Township
that could be annexed into the city of Farmington upon petition of the property owners.
The agreement also included language regarding the possible incorporation of the
Township and that the city of Farmington would support that effort. The Township filed its
petition for incorporation with the State of Minnesota this past April. On August 31,2022
and Administrative Law Judge issued an order approving the incorporation of Empire
Township along with a separate order transferring(annexing)all parcels identified in the
OAA to the city of Farmington. The incorporation of the Township will not be official until a
special election is held in February to elect its 5-member council and mayor. The
annexation of the 574 acres of land to the city of Farmington is effective as of August 31,
2022. A joint letter is being prepared to send to the property owners of the annexed areas
to inform them of this order and to provided updated election and polling locations as they
will now vote within the city of Farmington. Chair Rotty inquired about future

Comprehensive Plan amendments and rezonings for the newly annexed areas. Planning
Manager Wippler stated that as part of the 2008 agreement,the Township granted the city
zoning and land use authority over the annexation area. These areas have already been
zoned and guided as part of that agreement.
