April is Fair Housing Month, which is an appropriate time to highlight the significance of the Fair
Housing Act that was enacted on April 11, 1968. The Fair Housing Act prohibits discrimination in
housing based on race, color, religion, sex, familial status, sexual orientation, national origin, and
disability - providing equal housing opportunities for all.
The Saint Paul Area Association of Realtors (SPAAR) is a professional organization of over 8,000
realtors in 12 Minnesota Counties and 200+ cities and townships. SPAAR is committed to working
with cities to strengthen communities through home ownership, fair housing, and sustainable
community development. A strong and fair housing market that provides equal housing
opportunities for all, can be the foundation for a lively and healthy community. During the month of
April, communities are asked to join SPAAR in continuing to uphold fair housing laws by signing on
to the attached Fair Housing Month Proclamation.

WHEREAS, The Fair Housing Act, enacted on April 11, 1968, enshrined into federal law the
goal of eliminating racial segregation and ending housing discrimination in the
United States; and
WHEREAS, The Fair Housing Act prohibits discrimination in housing based on race, color,
religion, sex, familial status, national origin, and disability, and commits
recipients of federal funding to affirmatively further fair housing in their
communities; and
WHEREAS, the City of Farmington is committed to the mission and intent of Congress to
provide fair and equal housing opportunities for all; and
WHEREAS, our social fabric, the economy, health, and environment are strengthened in
diverse, inclusive communities; and
WHEREAS, more than fifty years after the passage of the Fair Housing Act, discrimination
persists, and many communities remain segregated; and
WHEREAS, acts of housing discrimination and barriers to equal housing opportunity are
repugnant to a common sense of decency and fairness.
NOW THEREFORE, I, Joshua Hoyt, Mayor, on behalf of the Farmington City Council, do

The City of Farmington has been designated as a Tree City USA for the last 32 years. A requirement of the
program is to proclaim Arbor Day within the city and hold an annual observance or celebration.
The City will observe Arbor Day with a tree planting celebration at Evergreen Knoll Park from 10 to 10:30
a.m. on Wednesday, April 26, 2023. This event is open to the public and City Council Members along with
members of the community are invited to come and participate in the celebration.
There is no impact to the City budget.

WHEREAS, The health and longevity of Minnesota's trees and forests are being affected by increased
pressure from pests and diseases, changing temperature and precipitation, and other extreme
weather events due to climate change; and
WHEREAS, Arbor Day provides people in Minnesota the opportunity to celebrate the importance of trees
and forests to our economy, culture, history, and future of the state; and
WHEREAS, Minnesota's forests are at risk from invasive species, such as emerald ash borer, that impact
carbon storage, habitat, and air and water quality; and
WHEREAS, Trees are of great value as they provide clean air and water, shade and energy savings,
wildlife habitat, recreational opportunities, wood products, and jobs while capturing and
storing carbon from the atmosphere, thereby offsetting greenhouse gas emissions; and
WHEREAS, Trees that are resilient to pests, diseases, and the impacts of climate change can live longer,
thereby capturing and storing carbon from the atmosphere and offsetting greenhouse gas
emissions; and
WHEREAS, Properly planting and caring for a diverse mix of trees makes community forests more
resilient by minimizing the impacts of diseases, insects, and other stressors such as climate
change and providing long-term community and environmental benefits; and
WHEREAS, A healthy, resilient tree canopy decreases summertime temperatures in neighborhoods,
enhances property values, improves air quality, and reduces stormwater runoff; and
WHEREAS, Thoughtfully choosing, planting, and caring for a diverse mix of trees now supports resilient
communities into the future.
NOW THEREFORE, I, Mayor of the City of Farmington, do hereby proclaim Wednesday, April 26, 2023,
as Arbor Day and the month of May 2023, as Arbor Month in Farmington.

Paul Werner 20917 Capri Street shared concerns about pedestrian safety near Highway
3 and the intersection of 209t" Street and requested the City work with the State to
install a marked crosswalk. He also shared concerns regarding the sidewalks along 209tn
Street from Catalina Way to Highway 3 from Farmington townhouses to Bourbon
Butcher where the snow does not get cleared and a downed utility pole exists. He also
is asking for more lighting along Highway 3 and for the City to adopt a zero tolerance
speeding policy.

Gorski: Council meeting agenda software will be changing to (Compass effective April
17th.
Elvestad: Easter Egg hunt is this weekend.
Kuennen: Community Vision and Comprehensive Plan update kick off begins this week
and consent agenda held final steps to move apartment project in downtown forward.
Powell. Crews were in at 3:00 am on Saturday to begin snow removal efforts. It was
challenging due to weight of snow. Emerald Ash Borer task force meeting this week.
Charissa Youngs began employment today in the Engineering Department and works at
the front desk.
Omlid: Crews moving trees that have fallen over trails from this weekend's snow. City
is still looking for seasonal staff. Thank you to Councilmember Porter for assisting with
last weekend's bunny event.

Mayor Hoyt called the work session to order at 5:00 p.m.

3. Discussion Items
a. Park Dedication Study Presentation — Parks and Recreation
This is a joint work session with the Parks & Recreation Commission and the
Planning Commission.
All attendees introduced themselves. Omlid introduced the item and explained the
history of the City's Park Dedication Ordinance and amendments, developer
questions raised over recent years and recent study work done by HKGI.
Rita Trapp from HKGI explained the purpose of this meeting, expectations, and what
to expect in an upcoming work session. Trapp provided the background of park
dedication, applicable statutes, reasons for park dedication, how fees can be
determined, nexus and demonstrated need for fees, open space/comprehensive
plan requirement, how park dedication fees can be collected and used and the City's
existing ordinance. She also discussed the option of taking cash in lieu of land and
the status of a current court case which may impact how the City moves forward.
Trapp went into detail about City's comprehensive plan park and recreation chapter,
types of land included, and level of park land city has determined necessary. She
discussed how the City will establish the essential nexus, totality of master plans and
studies conducted in City, how those plans will demonstrate need for park
dedication fees. Next the City's current ordinance and current process was
discussed in detail. Trapp showed examples of how other cities handle park
dedication, various methods used and effect land value has on process.

Next steps include evaluation of park dedication requirements, establishing the
nexus, and identifying potential ordinance and fee changes.
Council and commission discussion on timeframe on collection and use of cash, end
goal of work being done, any pending legislation, how 20 acres/1000 population
benchmark was established in 2020 and how does it compare to other cities, how
plans are arbitrary, long term planning, and what is staff hoping to have council and
commissions get from this process. Also discussed how dedication fees are
accounted for internally, ability to use park dedication funds in other areas of city or
for maintenance efforts, need for long-term vision out decades, long-term funding,
open space needs, density, average park dedication fee, how often is cash in lieu
taken, community parks vs. neighborhood parks, Jim Bell Park Survey demographics,
and how to position city to be attractive to developers.

Farmington Youth Hockey Association has applied for a Gambling Event Permit for bingo and pull
tabs during Dews Days June 22-24, 2023.
Per State Statute 349.166 and pertinent City Code, a Gambling Event Permit must be issued by the
City for this request. An application has been submitted, and the Police Department has reviewed
and is supportive of the request.
Fees are included in the 2023 budget.
Approve the attached resolution granting a Gambling Event Permit for the Farmington Youth
Hockey Association for June 22-24, 2023.

A gambling event pen -nit is required to regulate gambling activities such as raffles and bingo. Please review
Title 3 Chapter 19 of the city code for complete details. All permits are effective for the dates listed on the
permit. if you are having more than one event per year you can list all the event dates on one permit. Dates
must be on the permit at the time of submittal. Following is the process to obtain a gambling event permit:
1. Application forms and fees should be submitted to the city of Farmington at least two weeks prior to
a City Council meeting.
3. Approval is required by the City Council. Council meetings are held the first and third Mondays of
every month.
4. Upon City Council approval, a permit is issued. The entire application process takes approximately
two weeks. Upon City Council approval, the applicant should submit the proper forms and fee to the
state if required.
5. Investigation Fee: $50/year

A RESOLUTION APPROVING A MINNESOTA LAWFUL
GAMBLING EVENT PERMIT APPLICATION FOR
FARMINGTON YOUTH HOCKEY ASSOCIATION
WHEREAS, pursuant to M.S. 349.166, the State of Minnesota Gambling Board may not
issue or renew a Gambling Event Permit unless the City Council adopts a resolution
approving said permit; and,
WHEREAS, the Farmington Youth Hockey Association has submitted an application for
a Gambling Event Permit to be conducted at 325 Oak Street, on June 22 — 24, 2023 for
Council consideration.
NOW, THEREFORE, BE IT RESOLVED, that Farmington Mayor and City Council
hereby approve the Gambling Event Permit Application for Farmington Youth Hockey

Cost Share Agreement between the City of Farmington and Dakota County for Election Electronic
Pollbooks, Hardware, Software and Related Services
The current electronic pollbooks (iPads) which are used on Election Day are obsolete and do not
have hardware capable of running the latest operating system updates being pushed out by Apple.
The 2024 election year will include three elections: the Presidential Nomination Primary on March
5, 2024, the State Primary on August 13, 2024, and the General Election on November 5, 2024. In
preparation for these elections, the decision was made by Dakota County to replace our current
electronic pollbooks.
The County is bearing 50% of the total cost of replacement, while municipalities, collectively, are
being assessed 35% of the cost, and school districts the remaining 15%. The 35% that cities are
sharing is further broken down to assess each city based on the percentage of Dakota County
voters who reside in their city.
As of January 9, 2023, there are 14,145 registered voters in Farmington which equates to 5% of
registered voters in Dakota County. The shared cost to the City of Farmington is not finalized but
we believe it will be approximately $6,020.80.
Attached are the cost projections and a resolution for adoption. New electronic pollbooks will be
delivered sometime in June so we may begin the process of setting them up for testing and use in
2024.

COST SHARE AGREEMENT BETWEEN
THE CITY OF FARMINGTON AND COUNTY OF DAKOTA
FOR ELECTION ELECTRONIC POLLBOOKS,
HARDWARE SOFTWARE AND RELATED SERVICES
WHEREAS, pursuant to Minnesota Statute Section 471.59 two or more governmental
units, by agreement through action of their governing bodies, may jointly exercise powers
common to the governmental units; and
WHEREAS, under Minnesota Statute Section 201.225, the parties are empowered to
purchase, use, and maintain electronic pollbooks, also referred to in law as "electronic rosters;"
and
WHEREAS, Dakota County contracted with Knowlnk, LLC for the purchase of the
electronic pollbook system through the State of Minnesota's Cooperative Purchasing Venture
with the contract providing for future orders for products or services by purchase order ("Vendor
Contract"); and
WHEREAS, the City of Farmington and Dakota County are desirous of cooperating to
purchase a replacement for the electronic pollbook system through the State of Minnesota
Cooperative Purchasing Venture by use of funds by both parties and other cities, townships and
school districts in Dakota County who enter into separate Cost Share Agreements with the
County (collectively the "Governmental Units").
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of
Farmington that the City Council agrees to enter into a cost sharing agreement with Dakota
County for the purchase of replacement electronic pollbooks, hardware, software, and related
services to support and maintain the electronic pollbooks.
