COUNCIL MEETING
SPECIAL
AUGUST 28, 1.995
1. Mayor Kuchera called the meeting to order at 7:00 P.M..
Members Present: Kuchera, Ristow, Gamer, Galler, Fitch.
Members Absent: None.
Also Present: Administrator Thompson, Planner Tooker, Administrative Assistant
Finstuen.
2. The purpose of the meeting was to consider approving the plats of Deer Meadow
and Nelsen Hills Farm 4th Addition, and to approve a subdivision waiver for
Marlene Halstead. Councilmember Ristow asked if he could discuss the swimming
pool operations.
3. Swimming Pool Closing
Councilmember Ristow asked when the pool was scheduled to close. Parks and
Recreation Director Bell indicated that the pool closed the week before Labor Day
weekend due to staffing concerns.
4. Deer Meadow Plat
Planner Tooker presented an overview of the plat noting the following:
a) buildable lots plus 2 lots for ponding.
b) Request is to approve the entire plat but develop it in two phases. The
reason for phasing is for grading purposes.
c) PARAC requested a walkway along 180th Street and for the City to acquire Lot
10 for a play area.
d) SWCD indicated there may be buried toxins.
e) The Planner was requesting a "T" intersection at the transition between
Eventide Way and Euclid Avenue.
f) The Engineer requested a 20 foot easement along the south side of the Halstead
property to convey surface water.
g) Need for a wetlands alteration permit.
h) Need for a twenty foot separation from private property with a 3:1 slope for
ponding and a 10:1 bench.
i) Right turn lane on CSAH #31.
j) Developer pays City share of traffic signal at 180th and CSAH 31.
k) Utility service and access to 5 acre exception.

1) Trunk main to be extended and credit given.
m) Lakeville was not requesting any stubs.
Questions/Comments:
em. Ristow:
Is the cost of the right turn lanes to be borne by
the developer?
Planner Tooker:
Yes.
em. Ristow:
Is this consistent?
Planner Tooker:
Yes.
em. Ristow:
The City's share of the traffic signal is to be
borne by the developer?
Planner Tooker:
It is recommended by the Engineer and the Planning
Commission. The Developer disagrees.
em. Ristow:
Why is there a 70 foot stub street?
Planner Tooker:
So the proposed lot split by Marlene Halstead will
have sufficient frontage on a street.
em. Ristow:
Will Outlot B be a dry or wet pond?
Bob Wiegert:
It will mostly be dry. The NURP pond will be 3 to
4 feet deep.
Cm. Ristow:
How safe would that be for kids?
Planner Tooker:
The lot would have to be redesigned because there
isn't a sixteen and one half foot separation from
the wetlands.
em. Ristow:
How would the property be purchased?
Planner Tooker:
Through park dedication fees.
em. Galler:
The NURP pond will be wet?
em. Gamer:
Can it be fenced?
em. Fitch:
I don't think the City should pay for a fence,
because we can't protect everyone.
em. Ristow:
Why would the developer have to pay for the entire
street light?
(There was a lengthy discussion regarding the rationale.)
em. Galler: I have no problem requiring the developer to escrow
for the cost of one leg, but not for both legs. I
would recommend the City escrow $27,500 for the light until December 31, 1998.

Tim Giles:
Could we get certificates of occupancy if we can't
blacktop this Fall due to frost?
Adm. Thompson:
I don't have a problem with it as long as the City
monitors that the developer is trying to get the
blacktop down this Fall.
em. Galler:
It would be okay as long as the City Engineer can
order the developer to place additional gravel if
the road gets rough.
Diane Keyes:
When is the fence going to be pulled out?
Tim Giles:
Very soon.
Dennis Keyes:
The stump and the fence are going to be pulled out?
Tim Giles:
The area will be cleaned up.
MOTION by Ristow, second by Gamer to close the hearing. APIF, MOTION CARRIED.
MOTION by Ristow, second by Kuchera to adopt RESOLUTION NO. R95-95 approving the
preliminary plat and authorizing the signing of the final plat with the
conditions noted in the August 8, 1995 Planning commission minutes and the
aforementioned Planner's comments. APIF, MOTION CARRIED. MOTION by Gamer,
second by Fitch to adopt RESOLUTION NO. R96-95 approving the developer's
agreement for Deer Meadow with the following changes:
a) Developer to escrow $27,500.00 for the traffic light until December 31, 1998.
Escrow to be refunded if the traffic light isn't installed.
b) Certificates of Occupancy to be issued before blacktop is installed provided
adequate base is installed. The City Engineer can order the developer to
install gravel as deemed necessary.
APIF, MOTION CARRIED.
5. Halstead Waiver of Platting
MOTION by Fitch, second by Galler to approve the subdivision waiver for Marlene
Halstead's property. APIF, MOTION CARRIED.
6. Nelsen Hills Farm 4th Addition
Planner Tooke~ noted it was a standard agreement with the exception that the
developer would be getting a credit of $18,750.00 for water main improvements.
John Dobbs requested language relating to a park dedication credit.
Councilmember Galler suggested that as long as the minutes noted the park
dedication credit, it should be taken care of. MOTION by Gamer, second by Fitch
to adopt RESOLUTION NO. R97-95 approving the developer's agreement as presented.
