MINUTES
COUNCIL MEETING
REGULAR
MAY 16, 1994
1. Mayor Kuchera called the meeting to order at 7:00 P.M.
Members Present: Kuchera, Ristow, Orr, Rotty, Galler.
Members Absent: None.
Also Present: Administrator Thompson, Attorney Grannis.
2. The Mayor led the audience in the Pledge of Allegiance.
3. MOTION by Galler, second by Orr to approve the agenda with the
following changes:
a. Remove item 5f - Liquor Store security system.
b. Remove item 5h - Liquor Store electrical work.
c. Remove item 5j - Hiring of Parkkeeper.
d. Remove item 5q - Ash Street Improvement Agreement with Dakota
County.
e., Remove item 5w - pine Knoll MUSA - from Consent for general
discussion.
f. Remove item 5a - Approval of May 2, 1994 minutes - from Consent
for general discussion.
g. Remove item 5m - ROW condemnation - East Farmington PUD - from
Consent for general discussion.
h. Remove item 5v - Nelsen Hills Farm PUD - from Consent for
general discussion.
APIF, MOTION CARRIED.
4. Citizen Comments
a. Dick Graelisch commented that people were driving around with
loud radios. Mr. Graelisch was told to contact the police
Department.
b. Emily Rahn noted that nothing had been done about the
construction debris, but the developer had indicated he was
going to have a meeting with all of his builders.
c. Mayor Kuchera presented a plaque to James Harms for his service
on the Farmington HRA.
5. Consent Agenda
MOTION by Galler, second by Rotty to approve the Consent Agenda as
follows:
a. Approve minutes of April 25, 1994 special meeting.
b. Adopt RESOLUTION NO. R58-94 awarding 1994 Certificate of
Indebtedness to Marquette Bank of Lakeville.
c. Adopt RESOLUTION NO. R59-94 requesting VRWMC to undertake the
SEASS project south of TH 50 and requesting Castle Rock
Township and the Fairboard to participate financially.

d. Approve capital outlay request - Arena - ice resurfacer sensor
- $570.00.
e. Approve capital outlay request - Liquor - computer - $8,488.42.
f. Adopt RESOLUTION NO. R60-94 accepting bids for miscellaneous
liquor store equipment - AA Equipment Company - $36,230.67.
g. Approve hiring of part time liquor store employees per
Manager's 5/13/94 memo - Donna Born, Anthony Wenner, Christina
Paaske.
h. Blanket approval to attend LMC Annual Conference.
i. Adopt RESOLUTION NO. R61-94 approving a policy on pending
assessment search requests and amending Resolution R1-94 - Fees
and Charges - by adding pending assessment search charges.
j. Approve agreement for appliance disposal on Clean Up Day with
J.R.'s Appliance, Inc.
k. Set Fire Marshal's salary per May 12, 1994 memo.
1. Approve final payment for Project 92-8 - 195th Street
Improvements to Ryan Contracting for $52,999.52.
m. Adopt RESOLUTION NO. R62-94 approving developer's agreement for
Limerock Ridge.
n. Approve solid waste route revision per May 12, 1994 memo.
o. Approve capital outlay request - Solid Waste - two 10.4 cy
rolloff boxes and fifty 60 gallon containers - $6,549.75.
p. Adopt RESOLUTION NO. R63-94 awarding the contract for Pine
Knoll Improvements per the May 12, 1994 memo.
q. Adopt RESOLUTION NO. R64-94 approving the final plat and
developer's agreement of Akin Park Fourth Addition.
r. Adopt RESOLUTION NO. R65-94 approving the revised developer's
agreement for prairie Creek Second Addition (revised credit
amounts) .
s. Adopt RESOLUTION NO. R66-94 amending Resolution No. R125-93 -
vacating street and utility easements in City Center Plat
(housekeeping) .
t. Adopt RESOLUTION NO. R67-94 approving a gambling premise permit
application - Farmington Youth Hockey at Farmington Lanes - 27
5th Street.
u. Approve payment of the bills as submitted.
APIF, MOTION CARRIED.
6. MOTION by Orr, second by Rotty to approve the May 2, 1994
regular meeting minutes with the following changes:
a. #13 - g. Interest rates are "1" 1/2% over the bond rate.
b. #13 - Councilmember Galler clarified his vote noting that he
was in favor of the project but felt the City should have stuck
to its assessment policy.
c. #21 - Councilmember Ristow abstained on the motion.
APIF, MOTION CARRIED.
7. Right of Way Condemnation - East Farmington PUD. Administrato
Thompson noted the developer could not post the necessary surety
and was requesting that the City not proceed with "Quick Take" but
to proceed with normal condemnation and he agrees to reimburse the
City for costs. Attorney Grannis noted there was some risk in that

the developer may not reimburse the City and that the proceeding
could be switched to a "quick take". MOTION by Ratty, second by
Galler to support the agreement for conventional condemnation with
the stipulation that the developer reimburse the City for its
costs. VOTING FOR: Orr, Kuchera, Rotty, Galler. AGAINST:
Ristow. MOTION CARRIED.
8. Nelsen Hills Far.m POD. Planner Tooker presented the proposed
PUD with the changes recommended by the Council. Mr. Tooker noted
that the PUD may have to be changed slightly (187th Street
entrance) if Williams Pipeline filed a formal objection. MOTION by
Galler, second by Kuchera to adopt ORDINANCE NO. 094-333 approving
the Nelsen Hills Farm pun as presented. APIF, MOTION CARRIED.
9. Pine Knoll MUSA (memo dated 5/16/94) planner Tooker indicated
that the Metropolitan Council staff had indicated they would
recommend against approving the expansion.
10. Mayor Kuchera opened the following public hearings at
7:30P.M.:
a. 1994 Street Improvement Project - Oak Street.
b. 1994 Seal Coat Project.
The hearings were continued until later in the evening.
11. Pine Knoll MUSA (continued) - A lengthy discussion regarding
efforts to obtain the expansion. It was suggested that the Met
Council committee members be invited to view the area.
12. Oak Street Improvement Public Hearing. City Engineer
Kaldunski presented an overview of the proposed project, giving a
cost breakdown for each improvement. The following comments and
questions were received:
Mayor Kuchera:
Are you taking most of the boulevard
from the south?
Eng. Kaldunski:
It will be balanced at approximately
3 1/2 feet per side.
Cm. Orr:
Why go to 44 feet instead of 38 feet?
Eng. Kaldunski:
Traffic counts indicate that between
4th and 5th Street it should be 44
feet.
Mayor Kuchera:
will there be sidewalk on both sides?
Eng. Kaldunski:
Yes.
Cm. Rotty:
Why were some notifications listed as
"information only"?

Eng. Kaldunski:
Per City policy, they are in the
project vicinity but will not be
assessed.
Cm. Ristow: Are all streets in bad shape?
Eng. Kaldunski: Some parts of 5th, 6th and 7th
Streets are in pretty good shape and
could be eliminated. They were built in the mid 1960's.
Cm. Rotty: Why are the street costs so high?
Eng. Kaldunski: Concrete removal.
Adm. Thompson: Also, the north half blocks add to
the costs. The Council may consider
doing those portions with the turnback projects on Elm Street.
Cm. Orr:
Please explain the assessment policy.
(Explains policy) Some 9f the lots

and will have to be adjusted.
Lynn Hoffman:
Adm. Thompson:
Why dO we have to go 56 feet and 44
feet? I think it should be narrowed.
Also, a 10 inch line should be put in on 5th Street.
Eng. Kaldunski:
We are putting in a 12 inch line.
Lynn Hoffman:
Don't build a 44 foot street. It
will eliminate trees. Right now
it slows down traffic.
Audrey Rademacher:
Are we required to hook up to the
main on 5th Street?
Eng. Kaldunski:
Probably will be stubbed but not
required until your existing service
fails.
Richard Cole:
Was Oak Street "shrunk" in the past?
Eng. Kaldunski:
I believe Oak Street was wider at one
time. It was reduced in the 1940's
because of lack of funds.
Richard Cole:
300 cars per day down Oak Street or
down 5th and 6th Street?
Eng. Kaldunski:
Oak Street.
Amy Deegan:
The counts were skewed because of
Motor Parts and the dance studio.

Lynn Hoffman:
There was double dipping.
Bob Brownawell:
I would agree that Motor Parts has
the traffic, but the residential
portions much less traffic.
Earl Cook: Oak Street is a dead end street laid
in 1923. I should get assessed
$6,000 for a 3 1/2 foot widening? I don't have any traffic on my
street.
Marty Clough: Why widen it at all? I like the
neighborhood because of the wide
boulevard. My sidewalk is good. Please explain the 65/35 split.
I hope the "dip in the road" stays to slow down traffic.
Adm. Thompson:
If the City assessed 100%, the
assessment would be approximately
$15,000 per lot.
Eng. Kaldunski:
The dip would be replaced by a cross
cutter.
Cm. Orr:
The total project cost is
approximately $813,000 with $284,000
being assessed.
Sharon Olziewski:
will you correct the bump in front of
my house?
Gordon Chant:
I don't want the street widened
because it will increase traffic
count and speed.
Lynn Hoffman:
Are you going to dump a 15 inch line
into a 10 inch line?
Eng. Kaldunski:
The 12 inch line will be connected
to a 15 inch line.
Lynn Hoffman:
My neighbor was served off of Oak
Street.
Eng. Kaldunski:
I assume it is one of the properties

Cm. Orr:
The Engineer has just presented a
Feasibility Report. The Council may
adjust parts of the project.
Terry Quehl:
We have complained often about
traffic. It took years to get

I stated that the additional streets
would take some of the traffic off of
Elm Street.
Dave Quehl: We've been here before and promises
were broken. There are too many
assumptions about existing conditions.
Cm. Galler: There have been no assumptions
regarding existing conditions, only
what has been proposed to be installed.
Marty Clough:
Decorative lights should be thrown
out. Didn't some of the newer sewers
collapse?
Eng. Kaldunski:
No.
Cm. Rotty:
Explain 1/1.
Eng. Kaldunski:
(Explains - Costs approximately
$250,000).
Marty Clough:
What about damage to trees?
Eng. Kaldunski:
We have a good track record. The
widening shouldn't impact the trees.
Cm. Galler:
We'll know more when we stake.
Bob Brownawell:
I am opposed to widening the street
because of changing the charm and
historical significance.
Doc Cook:
It should have been widened years ago
when it was busier. Now it doesn't
make any sense.
Jim White:
I am in favor of widening the streets
because of safety.
Doug Haas:
How far will we have to park from our
homes?
Eng. Kaldunski:
We try to accommodate.
Ruth Cook:
Don't widen our street, but fix the
street and gutters.
Twylla Chant:
Many people think Oak Street is
pretty. I like wider boulevards.
What type of pipe?
Eng. Kaldunski:
PVC.

Chuck Logan:
I think it would be a shame to widen
that beautiful street.
Terry Quehl:
What if we own the land the street is
on.
Eng. Kaldunski:
We would have to buy it.
Terry Quehl:
The people want to be heard. Why
don't you listen?
Jim White:
If you keep the street narrow, then
according to Ms. Quehl, you're not
listening to me.
David Girardi:
I'm considering buying 501 Oak
Street; would you lower the sewer?
Eng. Kaldunski:
There is some possibility.
Lynn Hoffman:
Are there mains going down 6th and
7th Streets?
Eng. Kaldunski:
No.
Cm. Orr:
It appears the main topic is widening
the street. Does anyone have an on
street parking problem?
(General Response - No!)
Cm. Orr:
If we leave it in a configuration
with no parking, what would be the
minimum width?
Eng. Kaldunski:
29 feet.

I would like to see parking on one

Cm. Orr:
The north half of 5th, 6th and 7th
Streets could be saved for Elm Street

Yes. 5th Street sanitary sewer could
be replaced without taking the whole
street out.
Cm. Orr:
If we saved it for turnback, it would
be done within 5 years?

Yes.
Cm. Rotty: Sidewalks and services going to
houses. Would the residents save
money if you stopped short of the sidewalk?
Eng. Kaldunski:
Yes.
Cm. Rotty:
Street lights?
Eng. Kaldunski:
Similar to 4th Street.
Marty Clough:
I would like to get a breakdown of
the costs of changes as made.
Mona Ostroot:
Wasn't there an appraisal done on
Pine Knoll? What was the breakdown?
Cm. Orr:
Yes. $4000 for sewer, $2000 for
street.
Gordon Chant:
You're saying by doing the project,
our assessments are going up?
Cm. Rotty:
The market value, not the assessor's
value.
Gordon Chant:
Will the Council actually go out and
look at it?
Eng. Kaldunski:
I will generally stake the project so
everyone can look at it.
Lynn Hoffman:
All the improvements are on public
property. How does that improve my
property value?
Cm. Galler:
All the improvements impact your
value.
MOTION by Rotty, second by Galler to close the public hearing.
APIF, MOTION CARRIED. A lengthy discussion followed regarding the
project. The following was noted:

1. Street widths should stay consistent - 28 feet to 30 feet (to
be staked) .
2. Sanitary sewer/water stub outs too expensive.
3. Street lights - bid as an alternate.
4. North half block - keep it in.
5. Water services - take them all the way to the property line.

MOTION by Rotty, second by Orr to adopt RESOLUTION NO. R68-94
ordering the Oak Street Project and directing the engineer to
prepare plans and specifications. APIF, MOTION CARRIED.
13. 1994 Seal Coat Project Public Hearing. Mayor Kuchera reopened
the 1994 Seal Coating Project hearing. Engineer Kaldunski reviewed
the plans and specifications. The following questions and comments
were heard:
Cm. Galler:
Does it include the $2.00 County fee?
Adm. Thompson:
No.
Cm. Rotty:
Is it a good time to do Westview with
the proposed construction?
Eng. Kaldunski:
Absolutely.
Cm. Ristow:
Even though the State is going away
from seal coating, you still feel it
is beneficial?
Eng. Kaldunski:
Yes.
Cm. Ristow:
Why has it increased from $25.00 to
$50.00?
Eng. Kaldunski:
We had more buildable units to start
out. Now we are averaging costs and
units out over seven years.
Unknown:
Please don't overlap seal coating and
the Oak Street project.
Bill Jacobson:
There's a big pothole in my
neighborhood (Hill Dee) and the road
is breaking up.
Eng. Kaldunski:
In about 5 years we will probably
reconstruct the streets.
Chuck Logan:
Could you try to schedule public
hearings on separate nights?
Doris Bower:
You are going to make Spruce Street a
through street.
MOTION by Orr, second by Ristow to close the public hearing. APIF,
MOTION CARRIED. MOTION by Orr, second by Kuchera to adopt
RESOLUTION NO. R69-94 ordering the project and authorizing
preparation of plans and specifications. APIF, MOTION CARRIED.
MOTION by Ristow, second by Orr to adopt RESOLUTION NO. R70-94
approving the plans and specifications and authorizing the

advertisement for bids for the 1994 Seal Coat Project. APIF,
MOTION CARRIED.
14. Roundtable:
a. Slow speed of trains through the City - blocking crossings.
b. Army Corps of Engineers meeting on Thursday at 1:30 P.m. at
Empire Town Hall.
c. Annexation hearings resume on Tuesday.
d. Proposed ordinance relating to construction debris.
e. Silt fence down.
f. Assessment procedures and policies in other cities.
g. Stop sign at Tom Thumb.
h. Truck parked on Walnut Street.
i. Lawns need mowing in various sections of town; HRA property
needs spraying.
j. Area Wide Enhancement Group changed to "Farmington" Area
Enhancement Group.
