COUNCIL MEETING
SPECIAL
AUGUST 23, 1993
1. Mayor Kuchera called the meeting to order at 7:00 P.M.
Members Present: Kuchera, Ristow, Orr, Rotty, Galler.
Members Absent: None.
Also Present: Administrator Thompson, Attorney Harmeyer.
2. The purpose of the meeting was to consider the following
issues:
a. Public Hearing - City Center/1st Street
b. 1994 Budget
c. Update on 1994 Street Improvement Project.
3. Mayor Kuchera opened a public hearing at 7:00 P.M. to consider
Project No. 91-6 - City Center/1st Street. Assistant Engineer
Matthys presented an overview of the project noting:
a. upgrading 1st Street;
b. sidewalks on west side of 1st Street and north side of Elm;
c. replacing sanitary and storm sewer on 1st Street and looping
water on Main Street and railroad right of way;
d. replacement of private sewer west of 1st Street.
The following testimony was given:
Leon Orr:
How many homes are served by the
private line on Elm Street?

Asst. Eng. Matthys:
Three. Hoffman's, Wagner's and
Schuette's. Richardson's is tied
into First Street.
Darrel Franke:
How much is it going to cost?
Asst. Eng. Matthys:
Private sewer is $5,160.00.
Pam Wagner:
Why do we have to replace the
existing sewer?
Asst. Eng. Matthys:
You don't have to have it replaced.
It was included because we are
working in the area.
Mike Wagner:
Why doesn't the City take over the
private line?
Adm. Thompson:
It does not meet City standards.
Mike Engelking:
I haven't had any problems with the
sewer.

Cm. Galler:
If it isn't replaced now, it probably
will be replaced in the future at a
much higher cost.
Mrs. Richardson:
Why has the price gone up so much
from the last hearing?
Asst. Eng. Matthys:
I'm not certain.
Adm. Thompson: It was proposed at that time to
assess 25% of the costs. The City
has revised its assessment policy since then.
em. Orr:
If we did not order the public line,
would it be stubbed out?
Asst. Eng. Matthys:
Yes.
Cm. Rotty:
It appears most of the people are
opposed to the private line
replacement.
Mayor Kuchera:
not proceed.
It could be that we are considering
this project and the developer may

the City Center developer.
We would not order the project until
a developer's agreement is signed by
Cm. Rotty:
Should we wait on our decision until
the Planning Commission makes its
decision?
Cm. Orr:
Will the 1st Street property owners
be charged for the Elm Street stub
out?
Asst. Eng. Matthys:
A manhole would cost approximately
$2000.
Cm. Orr:
Is the cost to be split between the 3
owners? 35% or 100%?
Adm. Thompson:
I'm not sure.
Darrel Franke: There should be 5 properties on 1st
Street because John Richardson's
property is connected to 1st Street.
John Richardson:
What would my assessment be?
Asst. Eng. Matthys:
$1,800 plus or minus.
Pam Wagner:
We would be assessed $4,660 even if
sewer were not installed?

Asst. Eng. Matthys:
If it is rejected, you would not be
assessed.
Cm. Galler:
Except for the potential cost of the
manhole and stubout.
Cm. Rotty:
Refiguring the First Street sewer, it
would be approximately $1,400.
Darrel Franke:
Is the HRA property being assessed?
Asst. Eng. Matthys:
$14,810.
Darrel Franke:
I don't think I benefit from the
sidewalk.
Pam Wagner:
What is the main access to City
Center?
Asst. Eng. Matthys:
The main entry way is on Elm Street.
Skip Moench:
I am opposed to a cul-de-sac. Why is
the Main Street crossing being
abandoned?
Cm. Orr: It would be tough getting a signal
crossing and if it were allowed, it
would cost several hundred thousand dollars.
HRA Dir. Henricks:
Presented an overview of City Center.
Cm. Rotty: Could the staff put together costs
for minimal railroad crossing? Also,
staff should look at curb cuts on the north for turn lanes.
Peggy Schmidtke:
Why are we considering this if we
don't know if it's going to be
replatted?
Adm. Thompson:
It's a chicken/egg situation. You
have to start at some point of the
overall project.
Peggy Schmidtke:
We don't benefit from the project.
Pam Wagner:
Why is it a 9 ton road?
Adm. Thompson:
To serve Erickson's. The second
proposal does not include street
assessments.
Darrel Franke:
Is 1st Street going to be upgraded as
an MSA road and connect to 208th
Street?
Cm. Galler:
No.

Pam Wagner:
Will we be notified of the plat
hearing?
Adm. Thompson:
Yes.
Darrel Franke:
Why isn't the clinic paying for
sanitary sewer services?
Asst. Eng. Matthys:
They just installed a sewer service.
Cm. Orr: Would it ever be the intention of the
of the Richardson's to hook on to the
Elm Street line? It appears you would have to stub into 1st Street
if Elm Street isn't ordered.
John Richardson:
(Explains situation with private
sewer.) Could we just wait and see
what happens?
Cm. Rotty:
I would propose we delete the sewer
along Elm Street but stub out to the
property lines.
MOTION by Rotty, second by Kuchera to continue the public hearing
until September 7, 1993 at 7:30 P.M.. APIF, MOTION CARRIED.
4. The Council next considered the 1994 Street Improvement
Project. City Engineer Kaldunski presented an overview of Main
Street and Oak Street improvements. A lengthy discussion followed
regarding financing the projects and how much debt the City should
incur. Order of preference:
a. Pine Knoll (if MUSA is obtained)
b. Oak Street.
c. Main Street.
5. 1994 Budget. Finance Director Henneke presented an overview of
the budget noting the following:
a. debt levy,
b. general levy,
c. tax capacity rate (uncertain at this time),
d. sanitary sewer/solid waste not handed out at this time.
The following comments were made:
a. Federal mandates/costs.
b. CPI and growth.
c. Impact of Council action on taxes.
d. School liaison officer - possibly eliminating part time
clerical and asking for school assistance. Also, townships and
Lakeville paying for it. Police Chief to review the issue with
the School District.
6. The levy will be presented at the next regular meeting.

7. MOTION by Orr, second by Rotty to adjourn at 10:00 P.M.. APIF,
MOTION CARRIED.
