MINUTES
COUNCIL MEETING
REGULAR
JUNE 3, 1991
1. Mayor Kuchera called the meeting to order at 7:00 P.M.
Members Present: Kuchera, Mayer, Orr, Derington, Galler.
Members Absent: None.
Also Present: Administrator Thompson, Attorney Harmeyer.
2. MOTION by Orr, second by Mayer to approve the agenda with the following changes:
a. Remove Item 6c - County CIP.
b. Remove Item lId - Arena Capital Outlay Request from Consent Agenda for
general discussion.
c. Remove Item 11f - Industrial Park - from the agenda.
d. Remove Item 11g - Capital Outlay Request - Administration Laser Printer
from the Consent Agenda for general discussion.
APIF, MOTION CARRIED.
3. MOTION by Orr, second by Derington to approve the minutes of the May 16, 1991
special meeting. VOTING FOR: Orr, Kuchera, Derington, Galler. ABSTAIN: Mayer.
MOTION CARRIED.
4. MOTION by Galler, second by Mayer to approve the minutes of the May 20, 1991
regular meeting. APIF, MOTION CARRIED.
5. A number of Dakota County Estates residents were present to question why the
16 unit apartment building had not been deleted from the Dakota County Estates PUD
and why the City sold the 30 foot strip behind their houses for $1.00. Administrator
Thompson stated these items had been discussed during a 1988 public hearing that
was well attended by Dakota County Estates residents and that it was explained that
the 16 unit apartments were not being considered and that it was a private individual,
not the City, that sold the strip of land to the developer. Charles Hanson requested
a copy of the pertinent minutes.
6. Mayor Kuchera opened the following public hearings:
a. Consider various zoning amendments (continued from May 20, 1991);
b. Consider various zoning amendments (continued from May 20, 1991); and
c. Consider the Middle School Improvement Project.
The hearings were continued until later in the meeting.
7. MOTION by Mayer, second by Galler to adopt RESOLUTION NO. R51a-91 opposing the
relocation of the Regional Airport in Dakota County. APIF, MOTION CARRIED.
8. Mayor Kuchera reopened the public hearing to consider various zoning amendments
recommended by the Planning Commission. City Planner Tooker explained the proposed
ordinance which addressed the following:
a. Notification for Conditional Use Permits (housekeeping).
b. Radio/Television towers as a conditional use in the F-3 Zone.
c. Front yard fence setbacks (housekeeping).
9. Mayor Kuchera opened the public hearing at 7:30 P.M. to consider the proposed
Middle School preliminary plat. The meeting was continued until later in the meeting.

10. A lengthy discussion followed focusing on the radio/television towers. Most
comments related to notification requirements, specifically that the notification
should extend beyond the 350' statutory requirement. No consensus was reached
regarding the extent of the notification. MOTION by Mayer, second by Orr to close
the hearing. APIF, MOTION CARRIED.
11. MOTION by Galler, second by Mayer to adopt ORDINANCE NO. 091-247 as presented
with the exception of the sections relating to the radio/television towers, and to
refer the television/radio tower matter back to the Planning Commission. APIF, MOTION
CARRIED.
12. Councilmember Derington left at 7:45 P.M. to attend the MAC Regional Airport
meeting.
13. Mayor Kuchera opened a continued public hearing (from May 20, 1991) relating
to zoning density requirements. City Planner Tooker recommended the proposed ordinance
be amended to set 30% as the maximum density in the R-4 Zone. MOTION by Galler,
second by Mayer to close the hearing. APIF, MOTION CARRIED.
14. MOTION by Galler, second by Orr to adopt ORDINANCE NO. 091-248 relating to housing
densities as proposed except that the maximum density in the R-4 Zone by 30%. APIF,
MOTION CARRIED.
15. Mayor Kuchera opened the public hearing to consider the proposed Middle School
plat. Administrator Thompson presented an overview of the proposed developer's agree-
ment and fees, and noted the dispute with ISD #192 relating to stormwater fees. It
was the consensus that the credit for stormwater fees would be $2000/acre. Planner
Tooker reviewed the preliminary plat, noting that the complete preliminary plat had
not been submitted at this time. Mr. Tooker noted the only major change from the
original preliminary plat was the curving of 208th Street to the north to align with
TH 3 and CSAH 66. The following testimony was given.

Bituminous is half the cost of concrete, but not as durable.
The sidewalk should be on the south side. Do Pine Street
properties abut the plat?

Adjacent to the east side of the Weierke property.
Adm. Thompson: The Pine Street residents should be aware that at this time
the School District is proposing to use Pine Street as a
temporary construction road.

For how long?
For approximately 3 months.
I've been in construction and they will drag their feet as
long as they don't have to build a temporary road to the north.
I doubt that a temporary road would be built to the north.

Could you do a feasibility report for looping the water main
past the Pine Street properties?
Councilmember Derington arrived at 9:30 P.M.

208th Street should not curve to the north. It will devalue
my property.
It has to curve to the north to avoid the Vermillion River
flood plain. The road would require SWCD, DNR and Corp of
O.T. Nordseth:
Engineer permits.

Why weren't we notified?
Adm. Thompson: The City has been dealing with the School District and they
have never indicated that it would be a problem acquiring
the 1.5 acre strip from you.

The road should be shifted to the south.
I would strongly recommend against it.
Will there be any problem obtaining the railroad crossing?
It will be a fully improved crossing. It should not be a
problem obtaining permission.
Adm. Thompson: The School District is not represented this evening because
I indicated that without the complete preliminary plat, the
Council would probably not act on the plat tonight.
Cm. Orr:
Would it help to get a letter from the School District requesting
the road be shifted to the south?
The Council will not change the alignment without a request
by the School, but the Council has to look beyond just their

It would not change my recommendation.
What should we do?
I would recommend you reconcile your differences with the
School District first.
Again, just because you get the request from the School to
change the alignment, it does not mean the Council will agree.
What happens when our wells go dry during dewatering?
We will make arrangements in the plans and specifications.
How much extra would the road to the south cost?

Just the extra fill to bring it above the 100 year flood elevation.
It's not the cost, but the permits that concern me.
There is no parkland dedication because the property already
dedicated its share in the vacated Riverside plat.
Pine Street properties are meeting with School representatives
on Thursday.
The Council directed Engineer Kaldunski to attend the meeting.

MOTION by Orr, second by Mayer to continue the hearing until June 17, 1991 at
7:15 P.M. APIF, MOTION CARRIED.
16. MOTION by Orr, second by Mayer to direct staff to prepare a developers agreement
under the terms listed in the agenda information packet. APIF, MOTION CARRIED.
17. Mayor Kuchera opened a public hearing to consider the proposed Middle School
Improvement Project. Administrator Thompson noted additional concerns as outlined
in the May 29th memo. Administrator Thompson added that it appeared unlikely the
City would receive MSA designation on 208th Street but that FAD funding was still
a possibility. Ralph Day asked a number of questions relating to the water main
loop adjacent to his property (Austin Products). Administrator Thompson stated that
the cost for his property had not been broken out of the Elm Street project. MOTION
by Kuchera, second by Orr to close the public hearing. APIF, MOTION CARRIED.
18. MOTION by Orr, second by Kuchera to adopt RESOLUTION NO. R51-91 ordering an
addendum to the Middle School feasibility report relating to water main loop along
Pine Street. APIF, MOTION CARRIED.
19. MOTION by Galler, second by Orr to adopt RESOLUTION NO. R52-91 ordering the
Middle School Project and authorizing the preparation of plans and specifications.
APIF, MOTION CARRIED.
20. The Council directed staff to invite comments from the Army Corps of Engineers,
Department of Natural Resources and Soil and Water Conservation District relating
to 208th Street alignment.
21. MOTION by Orr, second by Derington to adopt RESOLUTION NO. R53-91 approving
the application for conveyance of tax forfeited property #14-77000-061-23 and
14-77000-086-23 (McVicker property). APIF, MOTION CARRIED.
22. Administrator Thompson was directed to negotiate the HRA's share of assessment
for the aforementioned property.
23. MOTION by Orr, second by Derington to adopt RESOLUTION NO. R54-91 urging the
Dakota County Board to adopt the local option sales tax. APIF, MOTION CARRIED.
24. Councilmember Derington updated the Council on the MAC Regional Airport meeting,
noting that the meeting had been sparsely attended.
25. The Council next considered a traffic report dated May 29, 1991. MOTION by
Orr, second by Mayer to adopt RESOLUTION NO. R55-91 requesting MnDOT consider installing
traffic signals at the intersections of CSAH #31 and TH #50 (first priority) and
TH #50 and 3rd Street (second priority). APIF, MOTION CARRIED.
26. The Council directed staff to present a "traffic route" ordinance designatirlg
a minimal amount of truck routes to be presented by January 1, 1992 and to install
stop signs per the report as the budget allows. The Council also directed staff
to submit a seasonal parking ordinance by August 1, 1991.
27. The Council next discussed the Ristow sod restoration (Project 87-7). The Council
directed the City Engineer to contact Mr. Ristow to determine if he would correct
the problem himself and, if so, how much it would cost, and to ask the contractor
what reduction in final payment he would accept.

28. HRA Executive Director Henricks presented an overview of the proposed Elm Park
TIF plan which is to be discussed at the June 17, 1991 public hearing. No action
was taken.
29. The Council next considered the advertisement for a Park and Recreation Programmer
as funded in the 1991 Operating Budget. Councilmember Derington expressed concern
over hiring a new person with the cutbacks in State funding. Administrator Thompson
noted this item had been debated at length during the budget deliberations and that
the Council would have better information regarding the 1992 budget before the position
was actually filled. MOTION by Orr, second by Galler to approve the job description
and rating for the Park and Recreation Programmer, amend the Organizational Chart
and advertise for the position. APIF, MOTION CARRIED.
30. The Council received the following bids for the 1991 Seal Coat Project:

Engineer Kaldunski recommended accepting the bid of Bituminous Roadways and approving
Change Order #1 adding $3,569.64 as funded in the 1991 Budget. MOTION by Kuchera,
second by Derington to adopt RESOLUTION NO. R56-91 accepting the bid of Bituminous
Roadways and approving Change Order #1 adding $3,569.64. APIF, MOTION CARRIED.
31. MOTION by Kuchera, second by Galler authorizing the Administrative Assistant
to seek bids on the City Hall lunchroom. VOTING FOR: Galler, Mayer, Orr, Kuchera.
AGAINST: Derington. MOTION CARRIED.
32. MOTION by Orr, second by Galler to approve the Consent Agenda as follows:
a. Approve Temporary 3.2 Beer License - Dunham's Fast Pitch Softball Team.
b. Adopt RESOLUTION NO. R57-91 establishing Annexation Fund #406.
c. Adopt RESOLUTION NO. R58-91 relating to review of the Superfund.
d. Approve Payment No. 1 (Project 91-4) - McVicker Property Demolition - $9,680.88
to Diamond 5 Wrecking.
e. Approve Capital Outlay Request - Administration - $10,731.00 - Building Inspector's
Pickup - Farmington Ford.
f. Approve payment of the bills as submitted.
APIF, MOTION CARRIED.
33. Councilmember Mayer stated that due to the large discrepancy in bids for the
ice arena flooring and the Park and Recreation Director's recommendation to accept
the higher bid, the Council should discuss the matter. It was the consensus that
the higher bid was of superior quality and it included a 10 year warranty. MOTION by
Orr, second by Kuchera to approve the Capital Outlay Request awarding the bid to
Holmsten for 2,132 square feet at $6.21 per square foot. APIF, MOTION CARRIED.
34. Finance Director Henneke noted that the Capital Outlay Request for a laser printer
included an error. The original budget amount should have stated $369 instead of
$-0-. MOTION by Orr, second by Mayer to approve the Capital Outlay Request for $1,909
and budget adjustment for the purchase of a laser printer. APIF, MOTION CARRIED.
35. The following items were discussed during roundtable:
a. Upcoming Met Council breakfast.
b. Turn alleged former City dump on A&K Grain property over to the MPCA.
c. Mayor Kuchera received a commitment from the County and Fair Board to
purchase $3,700 worth of No Parking Signs.

d. Further annexation/southeast area storm sewer meetings with townships
will be scheduled.
e. Dave Harmeyer is taking over the City's legal services. A retainer will
be forthcoming.
36. MOTION by Orr, second by Mayer to adjourn at 12:45 P.M. APIF, MOTION CARRIED.
