COUNCIL MEETING
REGULAR
MARCH 7, 1983
1. The Mayor called the meeting to order at 7:00
Present: Mayor Akin, Counci lmembers Cook, Kelly,
Absent: None

2. The minutes of the February 22, 1983 Council meeting and the
February 28, 1983 Council meeting were approved by the consensus of Council.

3. During the open time with the audience, Darwin Mesner, representing
NaCwral ~as Company, stated they have purchased a 30,000 gallon high-pressure
vessel located north of town on the Co-op property. At the present time,
there is some anhydrous ammonia in the vessel, but this will be sold to
farmers this spring. It is Companyls intentions to relocate
the vessel within six months to two years. Mayor Akin stated the City
needs a letter stating the Companyls intent. ~\(o ~~

4. Elayne Donnelly and Jerry Zimmer requested that Flagstaff Avenue be
graveled. Mayor Akin stated the gravel is budgeted for in the 1983 budget
and will be put on when the road dries out.
5. Babe Kuchera stated he is receiving pressure from the Grannis and Grannis
law firm for payment of their charges in his defense in the case regarding
the Open Meeting Law. He stated that it would cost the City more if he has
to take the City to court to receive payment. An immediate answer was requested.
Jerry Gorgos stated he has no answer from the Attorney General IS office at
this time. He will contact the Attorney General IS office and request them
to expedite the decision and wi II contact Grannis and Grannis to give them
an update.
6. Ernest Darflinger reported to Council on his progress in finding a
consultant for the downtown revitalization project. The consultant would be
able to present to the City a package consisting of the fiscal plant, the
type of business that could survive, and means of financing. The Task Force
should discuss the full package. He has drafted a letter to be sent to
the consultants. The consultants would copy material to the Task Force
stating what they can do. The Task Force would see what it needs from this
material, and at that time ask for costs. Motion by Sprute, second by
Kelly to sent the letter out to the consultants. APIF, motion carried.
7. The current status of the Surface Water Management project was discussed.
Apple Valley presented a number of points to the committee that must be
worked out. City Engineer Rosene will be working with Apple Valley planners
and engineer. City Engineer Rosene will present a report at the April 4,
1983 Council meeting.
8. Councilmember Sprute reported to the Council that there is possible
encroachment onto City property by Farm Service at the fertilizer plant
site. The Acting Administrator was directed to have the City Building
Inspector check out the situation.

9. Motion by Akin, second by Sprute to adopt Ordinance No. #083-141,
an ordinance amending Title 3, Chapter 21, Section 8, regulating Bingo
licenses. APIF, motion carried.
10. Motion by Kelly, second by Cook for the granting of a Sunday Liquor
License, an Off-Sale Non-intoxicating Malt Liquor License, and an
On-sale Liquor License to Garold E. Barney for the operation of the
Grain Exchange, Inc. APIF, motion carried.
11. The Council discussed Union Negotiations. Mayor Akin stated that we
have been in negotiations since April of 1982. The police, at the present
time, are not working under a contract. It is time for the City to make
its stand and go straight into arbitration. Motion by Akin, second by
Orr to have a date set for mediation services. APIF, motion carried.
12. Motion by Akin, second by Orr to pay the bi lls. APIF, motion carried.
13. Police Chief Whittingham explained to Council what has been done
at the intersection of Hwy. 50 and Hwy. 3 to make it safer; and other
possible remedies to the problem.
14. Attorney Gorgos stated that he has checked into the operations of the
auto business located on Hwy. 31. This business has had its license since
1957, and its non-conforming use has never been abandoned. It is a legitimate
use of the property.
15. Letters of commendation were received by the City for acts done by
Officer Daniel Siebenaler and Officer Warren Steigauf in the line of duty.
16. Motion by Cook, second by Sprute to authorize Gerald Bauer, Dave Dahl,
and Benno Klotz to attend a traffic control school on March 30, 1933 at
the Thunderbird Motel in Bloomington. APIF, motion carried.
17. Council discussed the practice of Councilmembers getting involved
in day-to-day operations of the City.
18. Motion made and seconded to adjourn at 9:00 P.M.
