MINUTES
COUNCIL MEETING
REGULAR
MARCH 17, 1980
1. The meeting was called to order by the Mayor at 7:00 P.M.
Present: Mayor Akin, Councilmen Kuchera, Orr and Whittier
Absent: Councilman Johnson
Also Present: Administrator Ford and Attorney Gorgos.
2. Motion by Kuchera, second by Whittier to approve the minutes of March 3, 1980,
with the following corrections: In paragraph 16 add, "including: D. F. Akin House,
19185 Akin Road; Chicago, Milwaukee, St. Paul & Pacific Railroad Depot, 400 - 2nd
Street; Exchange Bank Building, 3rd and Oak; Episcopal Church of Advent, 412 Oak
StreeL" APIP, motion carried.
3. The Mayor then opened the Public Hearing previously advertised for 7:00 P.M.,
concerning proposed amendments to the Zoning Ordinance as they relate to home
occupations and the holding of public hearings for granting the variances and special
exceptions. Motion by Akin, second by Kuchera that ORDINANCE NO. 080-85 an Ordinance
amending the zoning ordinance at it relates to home occupations hereby be adopted
with the following change: ParagraphC-l be chanyed to read,"the home occupation
special exception is the only one in the principal structure and the principal
structure is either a single family 'or two fami'ly'dwelling." APIF, motion carried.
4. The Council instructed the Administrator to discuss with the Planning Commission
the CouncilJs desire that some advertising be permitted in connection with a home
occupation and that the Planning Commission submit to the Council their recommendations
as to the limitations on the advertising signs, and so on. It would then be the
intention of the Council at a later date to amend paragraph c-6 in this regard.
5. Motion by Akin, second by Orr to adopt ORDINANCE NO. 080-86 an Ordinance
amending the zoning ordinance at it relates to public hearings and special exceptions.
APIF, motion carried.
6. The Council deferred unti I a later meeting consideration of Public Alert Siren
Systems.
7. Motion by Akin, second by Kuchera to approve the attendance of Police Chief
Robert Metcalf at the Spring Training Institute tor Police Chief's, March 24th -
26th, 1980, in Brooklyn Park. APIF, motion carried.
8. The Council earlier had considered the possibility of installing sidewalks on
certain portions of Spruce Street and citizen comment had been invited. The Admin-
istrator informed the Council that the school was no longer interested in proceeding
with the project and that a letter had been received signed by six property owners
indicating that they were not in favor of the project proceeding. Motion by Whittier,
second by Kuchera that the project be dropped. APIF, motion carried.
9. The Council was informed that the City had received word from the Metropolitan
Waste Control Commission that the grant had been approved for the Phase 2, Design
Stage, of the Infiltration Inflow Grant Project, and that the City could proceed
with the ordering of plans and specifications from the City1s consulting engineer.
Mr. Glen Cook, consulting engineer, was questioned very closely by the Council
concerning the amount of time it would take to prepare plans and specifications.
It was pointed out that a recent letter received from the MWCC, informed the City

that the City was facing an additional $42,000 in sewer charges for 1979 due to
excessive infiltration and that it was urgent that the problem be corrected. Mr.
Cook informed the Council that he could prepare plans and specifications in final
form suitable for the taking of bids by the Council meeting of May 5, 1980. Motion
by Akin, second by Kuchera to adopt RESOLUTION NO. R6-80 authorizing the execution
of a contract with the consulting engineer for the preparation of plans and spec-
ifications for phase 2. APIF, motion carried.
10. In regard to this matter the engineer discussed with the Council the advisability
of attempting to amend the rehabi litation grant. In that if it were decided that it
was feasible to prepare such an amendment that additional televising should be done.
Motion by Akin, second by Orr that the Council hereb~authorize an expenditure of
up to $7,000, for additional sewer line cleaning and televising preparatory to
submitting a request for amendment to the grant and further, recognizing that the
City may itself be required to pay the $7,000. APIF, motion carried.
11. In regard to this matter the Council also authorized a temporary meter to be
installed at strategic points for a short period of time to verify flow rates that
were tabulated by the Metropolitan Council.
12. The Council considered a letter which had been received from the Dakota County
Engineers Office that bridges number 3271 and 3272, located on Flagstaff Avenue
south of trunk Highway 50 would be safe if; '~a) a small amount (approximately
18 inches) of gravel and dirt were removed from the surface of the bridge and;
(b) the bridges were posted for a nine ton total load capacity. The City Attorney
advised the Counci 1 that the letter received from Dakota County was, in fact, an
expert opinion and should be able to be relied on. The General Services Superinten-
dent was instructed to comply with the two conditions set forth in the engineers
letter.
13. Motion by Akin, second by Orr that the City Attorney prepare and submit along
with the necessary fee, a petition for annexation for the property formerly owned
by the City, located on Linden Street which was recently sold to a private party.
Said petition, to be submitted to the Municipal Board with copies to the Empire
Town Board. APIF, motion carried.
14. The proposed ordinance changes submitted by City Administrator Ford dealing
with Boards and Commissions was deferred to the next meeting.
15. Motion by Akin, second by Kuchera to approve the salary adjustment for the
position of clerk-typist from $3.82 per hour to $4.25 per hour, effective April
1, 1980. APIF, motion carried.
16. The Council took note of correspondence from the Farmington Fire Department
informing them that they had received a donation of a Hurst tool anonymously with a
total value of approximately $6,000.
17. The Council took note of official correspondence from the Govenor of Minnesota
dealing with Volunteer Recognition Week, April 20 - 26, 1980.
18. The Administrator was requested to extend invitations for the next council
meeting to representatives of the DARTS Organization at 7:30 P.M. and to representatives
of the Mountain Dew Days Committee for 8:00 P.M.
19. Motion by Akin, second by Orr to approve the bills with the addition of a
bill in the amount of $245.80, to Dick's Furniture in regard to City Hall remodeling.
APIF, motion carried.
20. The Council then adjourned and reconvene in a private executive session under
the attorney - client provisions of the Open Meeting Law, to discuss with the
City Attorney certain aspects of railroad abandonment and the acquisition of the
right-of-way from the railroad.
21. Motion made and seconded to adjourn at 9:50 P.M.
