MINUTES
COUNCIL MEETING
REGULAR
SEPTEMBER 15, 1980
1. The meetinq was called to order by the Mayor at 7:00 P.M.
Present: Mayor Akin. Councilmen Cook, Kuchera, Orr and Whittier
Absent: None
Also Present: Administrator Ford and City Attorney Gorgos
2. Motion by Kuchera, second by Whittier that the minutes of September 2
and September 8. 1980 be approved as presented. APIF, motion carried.
3. Motion by Kuchera, second by Akin that St. Michaels Church be granted
a temporary 3.2 On-Sale Beer License for October 25, 1980, at 421 Walnut,
Farmington and that a gamblinq license be granted to St. Michaels Church
at 421 Walnut St. APIF~ motion carried.
4. The Counci 1 then held a general discussion concerning their opinions
after having read the various reports which they had received concerning the
police disbursal of a private party on June 29, 1980. Some members of the
Council expressed their opinion that they felt a party of that maqnitude
was inappropriate in a residental area. Some members of the Counci 1 also
were critical of individual actions taken by some officers present, especially
concerning two incidences, one in which an automobile was damaged by a night
stick and one in which the film from a privately owned camera was confis-
cated and destroyed. There seemed also to be a consensus that the partv per-
haps should have been disbursed upon the first call put to the Police Depart-
ment. One member of the Council suggested that a standard operating ~rocedure
and along with the appropriate training be instituted in the Police Department
on how to disburse private party groups which constitutes a nuisance. There
was a motion by Akin, that Officer Siebenaler be suspended for three days
without pay, that Officer Wacker be susoended one day without pay, and that
the Council recommend to the Dakota County Sheriff that appropriate action
be taken involving his deputy's where appropriate. Motion died for lack of
a second.
5. Motion bv Akin, second by Orr that a subdivision waiver be granted to lots
16 and 7 in Block 1 of Hill Dee 2nd subdivision for the purposes of exchanging
approximately twelve feet of ground. APIF, motion carried.
6. Motion by Akin, second by Kuchera that the new rates of charges to the
Engineering Firm of Bonestroo, Rosene and Anderlik, as set forth in the
Deputy Treasurer's memorandum dated September 10, 1980, hereby be approved.
APIF, motion carried.
7. Motion by Kuchera, second by Cook to approve a budget adjustment and
a capital outlay purchase authorization for General Services, which includes
a parts washer in the amount of $355, and a battery charger in the amount of
$305.40. APIF, motion carried.
8. The Council received and took under advisement a preliminary proposal of
the Farmington Fire Site Committee dated September 15, 1980.
9. The Council took note of the contribution made by the Lakeville Hockey
Boosters in the amount of $256, which had been used for equipping the up-
stairs team rooms work which had now been completed, and directed the Recre-
ation Manager to express the City's gratitude.
10. The Mayor reminded those present of a previously scheduled special
meet i ng of the Counc i 1 for the fo 11 ow i ng week on Monday: Seotembe r 22, 1980,
at 7:00 P.M. primarily for the purpose of a public hearing concerning use of
revenue funds and completion of budget meetings.
11. The Council was informed that the City had successfully petitioned for
an adjustment in its tax levy base, the result of which would be to increase
the 1981 tax levy limit from $282,783 to $524,550.
12. There was a motion by Kuchera, second by Orr to adoot ORDINANCE NO.080-96
which repeals in its entirety Title 3, Chapter 5 of the City Code entitled
Rubbish HAulers. The effect of said repeal to make illegal the collection
of rubbish by any parties other than by the City refuse collection service
itself. Voting fo~ Kuchera, OrG Akin, voting no; Whittier and Cook. Motion
carried.
13. Motion by Akin, second bv Orr that the bills be approved as presented.
APIF, motion carried.
14. Motion made and seconded to adjourn at 10:30 P.M.
