MINUTES
COUNCil MEETING
REGULAR
SEPTEMBER 21, 1981
1. The meeting was called to order by the Mayor at 7:00 P.M.
Present: Mayor Stegmaier, Councilmembers Cook, Kelly, Kuchera, Orr
Absent: None
Also Present: City Attorney Gorgos, Deputy Clerk Finstuen, and
Deputy Treasurer Henneke
2. Motion by Kuchera, second by Kelly to approve the minutes
of September 8, 1981 as presented. APIF, motion carried.
3. At 7:00 P.M. the Mayor opened the previously advertised
public hearing concerning the requirements of Federal Revenue
Sharing and the proposed use of Federal Revenue Sharing Funds.
There were no comments from private citizens in the audience.
There was a consensus of the Council, after a brief discussion on the
use of these funds, that they should be used to reduce the general
fund levy. Motion by Kuchera, second by Cook to set a public hearing
for 7:00 P.M., October 5, 1981 concerning the adoption of the 1982
budget which includes the uses to which Federal Revenue Sharing
Funds shall be put. APIF, motion carried.
4. Motion by Kuchera, second by Kelly to adopt Resolution No. R62-81
Stating Their Opposition to a Sludge Ash landfill in the City of
Farmington. APIF, motion carried.
5. Mr. & Mrs. Dennis Riste were in the audience and requested a Display
and Consumption license and an On-Sale Beer license at 209 Oak Street.
Motion by Kelly, second by Kuchera to approve the Display & Consumption
license for the period ending June 30, 1982 at an annual fee of $300.
APIF, motion carried.
6. Motion by Kelly, second by Kuchera to approve an On-Sale Beer license
at 209 Oak Street for the period ending December 31, 1981 at an annual fee
of $100. APIF, motion carried.
7. The Riste's also questioned the Council as to whether they would
hold a liquor license to be issued at some future date to the Riste's
at 209 Oak Street. Motion by Cook, second by Kelly that it would be
the intention of the City Counci 1 to approve a Liquor License Appl ication
'if the following contingencies were met prior to March 1, 1982:
a) That the property owners comply with all State laws and City
ordinances.
b) That the 100 restaurant seating requirement and $100,000
va 1 ue be met.
c) That remodeling of the building meet all Uniform Building
Code requirements. APIF, motion carried.
8. Motion by Kuchera, second by Orr to grant a Display and Consumption
license to Lawrence Schweich for the period ending June 30, 1982 at
309 Third Street and at an annual fee of $300. APIF, motion carried.
9. Motion by Kuchera, second by Orr to grant an On-Sale, Off-Sale
Beer License to lawrence Schweich for the period ending December 31,
1981 at 309 T~ird Street and at an annual fee of $115. APIF, motion
ca r r i ed .
10. Motion by Orr, second by Kelly that the City Attorney prepare
a 10 foot construction easement for repair work to the building located
at 309 Third Street owned by lawrence Schweich with the stipulation
that any damage done to City property would be repaired. APIF, motion
carried.
11. Motion by Cook, second by Kuchera that as of October 6, 1981
Benno Klotz, Maintenance Worker I I, be made a permanent employee as
per memorandum dated August 31, 1981. APIF, motion carried.
12. Motion by Kuchera second by Cook that as of October 7, 1981,
SanrdraZe'llmer,' Clerk Typist I be made a permanent employee as per
memorandum dated September 8, 1981. APIF, motion carried.
13:, Motion'by KeLly, second by Kuchera to approve the bills for payment
~s-presented. APtF~ motion carried.
14,; The'C1ty Attorney discussed with the City Council a situation
th~t:h~djbeen broright Op-receritly',regardtng the City zoning map. The
[)epartmenebf~atural Resourceschadwritten a letter to the CiV{
stating that it was their opinion that the Flood Plain area differed
between the Flood Study maps and the City zoning map, which had been
initially approved by them. Motion by Kuchera, second by Kelly directing
staff to look into the matter and report back to the Council. APIF, motion
carried.
15. The Council again discussed the proposed Benefit Equivalent Charge
assessment roll for Riverside Plat. A special Council meeting was set
for 7:00 P.M., Thursday, October 8, 1981. Motion by Orr, second by Cook
to adopt Resolution No. R63-81 authorizing the preparation of an assessment
roll for the proposed Benefit Equivalent Charges for Riverside Plat in
the amount of $26,282, to be spread over a period of 13 years at an
interest rate of 8% and to set a public hearing in the matter for 7:00
P.M., October 8,1981. APIF, motion carried.
16. Motion by Kuchera, second by Cook to approve an application for
a temporary exhibition permit for the 1981 Homecoming parade to be held
Friday, September 25, 1981. The fee of $15.00 was waived. APIF,motion
ca r r i ed .
17. The Council received a letter from Steele and Adkins, Inc.,
requesting that their property at 3283 220th Street which is located in
Castle Rock Township, be annexed to the City of Farmington. The matter
was turned over to the City Attorney.
18. The Mayor continued this meeting upon the suggestion of the City
Attorney and the Council went immediately into closed session for the
purpose of discussing, on a Lawyer-Client basis, the upcoming trial
of Siebenaler vs. the City of Farmington, and the legal aspects of the
recently obtained injunction against picketing by the PATCO Union at the
site of the FAA Center.

19. The Mayor reconvened the Council meeting and discussed budget matters.
20. Motion by Kelly, second by Kuchera that an expenditure of $2,000
authorized at a previous meeting for a Brush loading Fork be used
instead for the costs incurred by lengthening the body of the 1968
Chevrolet truck and directed Bill Hince, General Services Superintendent,
to receive quotes and authorize the work done. APIF, motion carried.
21. The Council discussed the Administrator's review'and~setit off
to a later date.
22. A special budget meeting was set for 9:00 P.M., Monday, September
28, 1981.
23. Motion made and seconded to adjourn at 10:40 P.M.
