The City Council met in a Work Session on Monday, October 2, 2023, at Farmington City
Hall, 430 3rd Street, Farmington, Minnesota.
1. CALL TO ORDER
Mayor Hoyt called the Work Session to order at 5 p.m.

3. DISCUSSION ITEMS
3.1 Fire Relief Pension and Vesting Request
Fire Relief Benefit Level Adjustment
President Allbee stated that the Fire Relief benefit level currently stands at
$8,500 per year of service after reaching full vesting. The Fire Relief Board is
proposing an increase to $9,500 per year for fully vested members. This
adjustment has been carefully considered by the board, taking into account
various factors, including the maximum allowable benefit level and fiscal
projections.
The rationale behind this adjustment is to ensure that the dedicated Firefighters
are provided with a fair and competitive pension amount that reflects the
challenges and demands of their profession. The proposed increase will not only

enhance the financial security of our Firefighters but also make Farmington a
more attractive place for Firefighters to serve and build their careers.
Full Vesting Requirement Change:
In addition to the benefit level adjustment, President Allbee said the Fire Relief
Board is requesting a change in the full vesting requirement from 20 years to 15.
This change aligns with evolving industry standards and recognizes the
contribution of our Firefighters who may choose to retire after 15 years of
dedicated service.
Council discussed, asked questions, and received answers. President Allbee will
set up another meeting with the Fire Relief Board for November to consider
amending the bylaws, which will need to be approved by both the Fire Relief
Board and City Council.
3.2 Review of Minnesota Statues, Chapter 429, as a Tool to Finance Fire
Suppression Systems
Director Kuennen presented. Life and safety of existing buildings, and the
occupants within those buildings, is important to the City. As buildings change
use and occupancy, there often is a code requirement to upgrade or install a fire
suppression system, which can be costly. State Statutes, Chapter 429, allows
the City Council to special assess the costs of fire protection systems upon
petition. To date, this use of Chapter 429 has not been used for this specific
allowable purpose. Recently a property owner has inquired about utilizing this
tool.
Council discussed; Attorney Koch will research this further.
3.3 Pavement Condition Index (PCI) for Trails Update
Director Omlid stated that the bituminous pavement conditions for trails are rated
the same as roadways and presented on the map included in the Council’s
packet (see Figure 1). Each segment of trail is assigned a numerical value
from 0 to 100, with 0 pavement being in extremely poor condition, and 100
representing new trail. The map identifies the trails in the worst condition in red,
orange, and light pink, and trails in the best condition and/or new tra ils in dark
green. The Feature Counts is the number of trail segments that fall in that rating
group. To maintain current and relevant data, the trail pavement conditions will
be rerated every two years. New trail segments will be added to the dat a and
map during the rerating process.

3.3 Pavement Condition Index (PCI) for Trails Update (continued)
As of today, Director Omlid said the average of all trails is 67. Most of the lower
ratings were through Rambling River Park.
Staff priorities are Rambling River Park for 2024, which may provide funding
opportunities with Dakota County; preventive maintenance of trails; adding new
trails with new developments; and incorporating trail projects into long-term
financial funding.
Discussion included map ratings, trail conditions found in the field, root barrier
not installed correctly in Meadow View Park, trail maintenance, suggestion to
changing some trails to natural trails, financing for trail maintenance and
improvements, and connecting to county trails.
Director Omlid will find out when this topic will be on the County’s agenda, and a
representative from Council may attend. The map and comments from tonight’s
discussion will be brought to the Parks and Recreation Commission. Director
Omlid will discuss with the County about taking over some of our trails and going
further north.
3.4 Cannabis Update
Due to lack of time, this item will be moved to a future meeting.
4. COUNCIL COMMITTEE UPDATE
Councilmember Lien: Dakota 911 Board of Directors met on September 28th to discuss
funds submitted by cities and counties. Funds su bmitted do not count towards the
City’s dues.
Mayor Hoyt: The Dakota Broadband Board met. There has been no clear fund balance,
so 12 months of statements have been reques ted. This was to be completed by
October 1; Mayor Hoyt will follow up with Attorney Koch next week.
5. CITY ADMINISTRATOR UPDATE

13. CITY COUNCIL ROUNDTABLE
Councilmember Lien: I attended the funeral today for Leon Orr of Farmington. He
passed away on September 24, 2023. Leon served several roles within the community
and was heavily involved in the design and development of the park system, the youth
center, the senior citizen’s center, the ice arena, and the Farmington Lutheran Church.
He also served ten years as a City Councilmember and sat in on the Park Board. Leon
had been a volunteer coach for little league baseball and has mentored several local
youth at his church. Leon’s last big project in Farmington was truly a great example of
his belief in service to the community and country. Leon worked with other dedicated
military veterans to design, fund raise for, and implement the construction of the
Farmington Veterans Memorial. He drove to several states to visit other memorials to
gain ideas and make sure this was the best possible salute to those who served our
nation. Thank you, Leon, for your service to Farmington.

Councilmember Bernatz: I had a great time at Bourbon Butcher last Friday. Twin Cities
Live was in town and did a fantastic job of letting people know what Farmington is
about. A community event at its finest. Thank you to Twin Cities Live for selecting
Farmington, to everyone coming out, and the band and its directors for performing.
This is also Homecoming Week – it will be a lot busier with kids out. Parade
Wednesday, game Friday, and the dance on Saturday. This is where we show who we
are as a community, so be mindful of the kids and the visitors, and have a good time.
Attorney Koch: The pandemic had brought a backlog of criminal cases for the judicial
system. The First Judicial District (Dakota County) has received recognition for doing
good work on that backlog and getting rid of it. Congratulations to all those city
prosecutors, people on the bench, and court administration for their good work on this.
Clerk Buecksler: The School District is in need of more Election Judges for the
November election. Contact either me or the School District for more information. We
hope to get more people involved.
Director Flaten: It’s a little bittersweet to say goodbye to Chris Regis after tonight’s
meeting. Council approved the hiring of Kim Sommerland as our new Finance Directo r,
and we are excited to have her begin on October 23rd.
Director Powell: Public Works Staff held Snow Day 2023 last week. The Police
Department was also there to talk about how plow drivers and the Police Department
interact and reminders of who to contact if something happens. We also reviewed all
the plow routes and plow route updates, damage claims, reporting steps, and review
of equipment to be sure Staff have what they need once the season starts. In the
afternoon, they drove their entire routes and documented things, such as manholes
that need adjustment, gate valves, basketball hoops in the road, etc. To do that, they
used a new app that our GIS Specialist developed specifically for Public Works. They
were able to open the app on their phone and easily log the issue and location, which
saved a lot of time. Hats off to our GIS Staff and Public Works Staff.
Director Omlid: Homecoming is Wednesday, with the H omecoming Parade starting at
6 p.m., followed by the Tiger Cub Pep Fest outside the Rambling River Center.
The deadline to register your house for the 2nd Annual Halloween Havoc Tour is
Sunday. Houses must be ready by October 16th.
Thank you to Leon Orr for all he has done for the Parks and Recreation Department.
We wouldn’t be where we are today with the amenities we have , without him.
Congratulations to Chris Regis on his upcoming retirement. It’s been a pleasure to work
with you, and I hope you enjoy your retirement.

Director Regis: This is my last Council meeting. Thank you for the opportunity to come
here. It has been a great place to work, in a great city. I’ve really enjoyed working with
everyone and the Council. Thank you.
Chief Elvestad: Next week is Fire Prevention Week. We had our Open House early
because of the weather, and it was a great success. Fire Prevention Week is to
commemorate the Great Chicago Fire of 1871. This year’s theme is “Cooking Safety
Starts with YOU.” Reminder to everyone to be safe when you’re cooking and set timers.
Chief Rutherford: October is Breast Cancer Awareness Month. As part of that, and for
the last number of years, the Farmington Police Department has participated in the
Pink Patch Project. Over the years, we have sold several versions of our patch in pink.
This year, in addition to the patches and challeng e coins that we’re selling, we have a
replica of our K-9 Smoke, who also has our pink patch on his tactical vest. You can
pick these up in the lobby of the Police Department or at Fissan Training Kennels, who
very generously donated the money needed to purchase these replicas of Smoke.
Mayor Hoyt: Chris, it’s been a pleasure. You have been an asset to the team, and you
filled the void that we very much needed very quickly. You have been professional, and
you have been there in all the times that we’ve had questions. While your time here
with the City of Farmington was fairly short, we got to catch you on the tail end of what
I know is most certainly an amazing career. Enjoy it, you’ve earned it.
Leon Orr is one of the pillars of this community and has been for decades. A lot of
people would recognize him but wouldn’t know him, but they know and they feel his
legacy. He was involved in City Council, Parks and Recreation, and an unlimited
number of non-profits. He was the driver behind the vest for the K-9’s. He was always
the guy who showed up and showed up for the community first. He was very respectful,
very passionate, and he loved everything about this community. He is going to be
missed.
We had a very rare opportunity last week with Twin Cities Live, the show, the
production, and them coming to town. It was an unbelievable opportunity for the people
outside of the city of Farmington to get a picture of what we, as a city, have to offer. To
hear the enthusiasm in the host’s voice throughout the week in the segments that were
filmed, from Sweet Kneads, to Brand Farms, to Blue Nose Coffee, to Crazy Legs
Pumpkin Patch, including Ben’s trip on Wednesday and the tour we had, and he and
Elizabeth on Friday at Bourbon Butcher, they even joked about it this afternoon in their
lead-in. You can’t buy that coverage. The feedback I personally heard was the positive
light that it shed on everything that is great about this community. It was an
unbelievable way to showcase our community, and we very much appreciate KSTP
and the Twin Cities Live team for coming and being a part of that. Thank you.

INTRODUCTION:
Approve the appointment of Scott Mattingly as Paid-on-Call Fire District Chief.
DISCUSSION:
The Fire Department went through an internal promotion process for the vacant District Chief
position at Fire Station 2. After careful consideration, Scott Mattingly was chosen for the position.
Scott has been with the Farmington Fire Department since 2018 and is currently in the role of
Captain. Prior to joining the Farmington Fire Department, Scott worked for the Apple Valley Fire
Department for 20 years and served in the role of Assistant Fire Chief.
BUDGET IMPACT:
Wages are included in the 2023 budget.

INTRODUCTION:
A donation was recently made to the Rambling River Center (RRC) by Happy Harry’s Furniture.
DISCUSSION:
A donation in the amount of $149.90 was recently made by Happy Harry’s Furniture to the RRC.
The donation was made through a program created in 2011 in which a customer of Happy Harry’s
Furniture can select a charity of their choice to receive a donation when merchandise is purchased
from the store. Then 10% from the sale to the customer is donated to the charity. The RRC is one
of the charities that can be selected by customers.
With these donations, Happy Harry’s Furniture has donated a total of $15,446.65 to the RRC since
the program’s inception. This partnership with Happy Harry’s Furniture has been very beneficial
over the long term given the funds that have been donated to the RRC.
The donation has been deposited into the RRC Capital Improvement Fund to fund future building
improvements and/or purchase new equipment and furniture.
Staff will communicate the City’s appreciation on behalf of the City Council to Happy Harry’s
Furniture for their generous donation to the RRC.
ACTION REQUESTED:
Adopt the attached resolution accepting the donation of $149.90 from Happy Harry’s Furniture to
the RRC.

A RESOLUTION ACCEPTING
A DONATION OF $149.90 FROM HAPPY HARRY’S FURNITURE
TO THE RAMBLING RIVER CENTER
WHEREAS, the City of Farmington is generally authorized to accept donations of real
and personal property pursuant to Minnesota Statutes Section 465.03 for the benefit of its citizens
and is specifically authorized to accept gifts, as allowed by law; and
WHEREAS, the following persons and entities have offered to contribute to the City:
Happy Harry’s Furniture has donated $149.90 to the Rambling River Center
; and
WHEREAS, it is in the best interest of the City to accept this donation.
NOW, THEREFORE, BE IT RESOLVED that Mayor Hoyt and the Farmington City
Council hereby accept with gratitude the generous donation of $149.90 from Happy Harry’s
Furniture to the Rambling River Center.
Adopted by the City Council of the City of Farmington, Minnesota, this 16th day of October 2023.

INTRODUCTION:
Attached for Council's review and execution is an easement agreement with Minnesota Energy
Resources Corporation [MERC] for the relocation of a gas main onto city property.
DISCUSSION:
Due to the construction of the Emery Apartment building at 310 Third Street. an existing gas main
owned and operated by MERC will have to be relocated. The gas main currently runs north and
south on the east side of the former right-of-way of 2nd Street. The current location of this gas main
interferes with the footprint of the apartment building that is under construction and must be
relocated. The gas main will be relocated within property owned by the city (2nd Street parking lot) -
as shown in blue on Exhibit A of the attached agreement.
The easement agreement has been reviewed by the City Attorney and has been found acceptable.
BUDGET IMPACT:
Undetermined. Staff is negotiating with MERC regarding the cost obligations for this initial
relocation and will bring back additional information on this at a later date.
Per the attached agreement, the grantee (MERC) is responsible for the cost of the first instance of
relocation moving forward and the grantor (City) will be responsible for each subsequent requested
relocation.
ACTION REQUESTED:
Approve the attached easement agreement and authorize its execution.

does hereby grant unto said Grantee, its successors and assigns, the perpetual right, permission, authority,
privilege and easement, to construct, install, operate, maintain, remove, and replace a pipeline or pipelines and all
necessary and usual appurtenant equipment thereto, all for the purpose of transmitting gas upon, over, across, within,
and/or beneath certain easement areas as shown below, or on the attached Exhibit "A", on land owned by said
Grantor in the Town of Farmington, County of Dakota, State of Minnesota, described as follows, to-wit:
Part of the Parcel described in Dakota County Register of Deeds Document Number 1122043,
being part of the Southwest Quarter of the Northeast Quarter (SW 1/4-NE 1/4) of Section 31,
Township 114 North, Range 19 West, Town of Farmington, County of Dakota, State of
Minnesota, as shown on the attached Exhibit “A”.
1. Access to Easement Premises. Grantee shall have the right to access the Grantor Property outside
of the Easement Premises for the purpose of gaining access to the Easement Premises in the event
direct access to the Easement Premises is not possible. Grantee shall notify Grantor, when possible,
before accessing Grantor Property, except in the event of an emergency.
2. Restoration. Grantor Property, including the Easement Premises, is currently a paved parking lot.
Upon completion of any work requiring the opening of the Easement Premises, Grantee shall, in
all cases, place the Easement Premises in, on, under or across which the same are located in as
good condition as they were prior to said operation. Grantee shall also maintain the same in good
condition for two (2) years thereafter. The work shall be completed as promptly as weather
permits, and if Grantee shall not promptly perform and complete the work, remove all dirt,
rubbish, equipment and material, and put the Easement Premises in the said condition, Grantor
shall have, after written demand to Grantee to cure and the passage of a reasonable period of time
following the demand, but not to exceed twenty (20) days, absent adverse weather conditions, the
right to make the restoration at the expense of Grantee. Grantee shall pay to Grantor the cost of
such work done for or performed by Grantor, including its reasonable administrative expense and

overhead. This remedy shall be in addition to any other remedy available to Grantor. All work
performed by Grantee on the Easement Premises will be performed in a proper workmanlike
manner, and that during the progress of the work, Grantee will properly safeguard said trench.
3. Permission for Excavation. Grantee shall not open or disturb the surface of the Easement Premises
for any purpose without first having obtained permission from Grantor, for which Grantor may
impose a reasonable fee. Permit conditions imposed on Grantee shall not be more burdensome
than those imposed on other utilities for similar facilities or work. Grantee may, however, open
and disturb the Easement Premises without permission from Grantor where an emergency exists
requiring the immediate repair of Utility Facilities. In such event Grantee shall notify Grantor by
telephone to the office designated by Grantor as soon as possible, and shall promptly obtain any
required permits and pay any required fees.
4. Vegetation. Grantee shall have the right to control all brush and trees within the Easement
Premises, by cutting, trimming and/or other means as determined by Grantee, which in its
judgment may interfere with or endanger the maintenance or operation of Grantee’s gas facilities.
5. Title to the Grantor Property. Grantor warrants it is the owner of the Grantor Property and has the
right, without title restriction, to execute and deliver this instrument.
6. Construction on Surface. Grantor agrees that it will not construct any improvements, including
buildings, concrete structures, or other objects, or change the grade more than four (4) inches over
any gas lines without first securing the prior written consent of Grantee. This agreement is to insure
the conformance of the use of the Easement Premises with the all applicable federal and state
natural gas safety codes and Grantee's construction standards. Grantor further agrees that all costs
incurred through the relocation of said facilities to avoid such buildings, concrete structures, or
other objects or to obtain proper depth of land cover shall be borne by Grantor.
7. Public Ways. Utility Facilities shall be located and constructed so as not to interfere with the safety
and convenience of ordinary travel along and over public ways and so as not to disrupt normal
operation of any facilities used for providing sewer, water, or any other public utility service
owned or operated by Grantor or an agency thereof ("City Utility System"). Grantee's
construction, operation, repair, maintenance and location of such Utility Facilities shall be subject
to other ordinances or regulations of Grantor.
8. Grantee Protection of Utility Facilities. Grantee shall take reasonable measures to prevent
Grantee's Utility Facilities from causing damage to persons or property. Grantee shall take
reasonable measures to protect the Utility Facilities from damage that could be inflicted on the
Utility Facilities by persons, property, or the elements. Grantee shall take protective measures
when Grantor performs work near the Utility Facilities, if given reasonable notice by Grantor of
such work prior to its commencement.
9. City Projects. In the event that Grantor desires to construct, in the proper exercise of its police power,
and with due regard to seasonable working conditions, when necessary, a City Utility System within
the Easement Premises, Grantee shall relocate its Utility Facilities, either to a mutually agreeable
location within the Easement Premises or to another location. Grantee shall be responsible for the
cost of the first relocation under this Section 9. Thereafter, the Grantor must be responsible for costs
for each requested relocation thereafter. To exercise its rights under this Section 9, the Grantor shall
give Grantee reasonable advance written notice (which shall not be less than one hundred eighty (180)
days) of its plans to construct or reconstruct a City Utility System in the Easement Premises, or to
grade or regrade the Easement Premises. Grantor agrees to use good faith efforts to identify an
alternative location for the Utility Facilities, in the event that they are relocated from the Easement
Premises.

10. Indemnification. Grantee shall indemnify, keep and hold Grantor, its elected officials, officers,
employees, and agents free and harmless from any and all liability on account of injury or death
of persons or damage to property occasioned by the construction, maintenance, repair,
inspection, the issuance of permits, or the operation of Grantee's property located in, on, over,
under, or across the Easement Premises; provided, however, that Grantor shall not be
indemnified for losses or claims occasioned through its own negligence or willful misconduct.
11. Grantee to Defend Claims. In the event a suit is brought against Grantor under circumstances where
this agreement to indemnify applies, Grantee at its sole cost and expense shall defend Grantor in such
suit if written notice thereof is promptly given to Grantee within a period wherein Grantee is not
prejudiced by lack of such notice. If Grantee is required to indemnify and defend, it will thereafter
have control of such litigation, but Grantee may not settle such litigation without the consent of
Grantor, which consent shall not be unreasonably withheld. This section is not, as to third parties, a
waiver of any defense or immunity otherwise available to Grantor; and Grantee, in defending any
action on behalf of Grantor shall be entitled to assert in any action every defense or immunity that
Grantor could assert in its own behalf.
12. Insurance: Grantor acknowledges and accepts that Grantee is self-insured. Grantee shall require its
contractors, subcontractors, agents and assigns entering Grantor's land to maintain commercially
reasonable and/or statutorily mandated levels of insurance coverage, including but not limited to
commercial general liability, workers compensation, employer's liability and commercial automobile
liability. Commercial general liability and commercial automobile liability shall be in the amount of
not less than $2,000,000 per occurrence.
13. Compliance with Applicable Laws. Grantee shall at all times comply with all applicable laws,
ordinances, rules, regulations, and codes, federal, state, and local, whether now or hereafter
promulgated or enacted, pertaining to this Agreement and Grantee’s use of the Easement Premises.
Grantee shall, consistent with prudent utility practice, ensure that at no time shall the installation,
operation, or maintenance of the system endanger or interfere with the safety of persons or property
in the City of Farmington.
14. Covenants Run with the Land. This Agreement shall be recorded among the land records of Dakota
County, Minnesota, and shall constitute a covenant running with the land, and shall be binding on and
benefit Grantor and Grantee and their and successors and assigns.
15. Counterparts. This Agreement may be executed in multiple counterparts, each of which shall
constitute an original but all of which together shall constitute a single Agreement.
16. Miscellaneous. The rights conveyed to either party may be exercised from time to time as may
be necessary and convenient and the failure of either party to exercise any rights shall not limit or
extinguish such rights. Except as set forth in Section 9 above, the rights of the either party shall
only be extinguished or modified by written instruments executed by both parties and filed of
record in the County and State aforesaid. The laws of the State of Minnesota shall govern this
easement agreement. All legal proceedings derivi ng from this Agreement shall be venued in
Dakota County, Minnesota.

INTRODUCTION:
The following report summarizes the new construction permits issued during the third quarter of
2023 and projected population estimate.
DISCUSSION:
Third Quarter Building Permit Information: During the third quarter of the 2023 building
construction season (July 1st through September 30th), the City issued 26 new single-family and
110 multifamily units building permits.
The average building valuation for single family homes during the third quarter of 2023 was
$228,861 slightly up from the second quarter of 2023. The multifamily unit's total valuation came to
$6,943,100. In addition, Ebert Construction was issued a building permit for a 74-unit multifamily
apartment building, adding an additional $12,210,000 to the valuation totals for multifamily housing.
Total multifamily valuation during third quarter $19,153,100.
Note that the valuation averages do not represent the average sale price or average market value
of the homes in question, since they do not include the value of the lot or any amenities added to
the home that are not part of the building code formula.
Projected 3rd quarter population estimate is 24,175 (Certificate of Occupancies x 2.93 factor)

INTRODUCTION:
The City experiences delinquent accounts similar to other businesses. Collection agencies are not
utilized to collect these accounts due to the cost involved. Municipal services (e.g., water, sewer,
storm water, streetlights, and solid waste) are not shut off, unless the property is vacant; then water
may be shut off to assist in preserving the property. Rather, in accordance with Minnesota State
Statutes 444.075, 429.101, and 443.015, delinquent amounts are certified to the County Auditor for
collection with a property owner’s real estate taxes.
DISCUSSION:
Notices were mailed to property owners with delinquent utility invoices as of July 31, 2023, as well
as delinquent mowing invoices and code violations. Recipients were advised they could avoid
certification by paying the delinquent amount in full by October 13, 2023. The notice also advised
that the City Council would consider this matter at a public hearing on October 16, 2023.
At the time of the notice, 462 utility accounts, as well as unpaid invoices for mowing and code
enforcement, were sent. The total for the delinquent accounts was $243,933.72. This number will
be further updated at the October 16, 2023 City Council meeting for payments received by the
Friday, October 13, 2023 deadline.
BUDGET IMPACT:
Delinquent utility bills do not directly impact the City’s budget. The City continues to pay its bills on
time but experiences a significant lag (up to 18 months) in collection of its utility bills. Amounts
certified this fall reflect delinquent balances through July 31, 2023. Some of these customers have
not made any payments on their utility account since it was certified last fall. The City will not collect
these amounts until the 2024 tax settlements are received in July and December of 2024. This
negatively impacts the City’s internal cash flow and negatively impacts Staff time.
ACTION REQUESTED:
Conduct the public hearing and, once the City Council has heard from those who wish to speak,
close the public hearing and adopt the attached resolution certifying the delinquent accounts as an
addition to the 2024 real estate taxes of the appropriate properties.

A RESOLUTION CERTIFYING DELINQUENT MUNICIPAL
SERVICE ACCOUNTS TO DAKOTA COUNTY TREASURER-AUDITOR
WHEREAS, the City of Farmington (“City”) has provided sewer, water, storm water,
streetlight, and solid waste removal services to users of municipal utilities; and
WHEREAS, the City has provided mowing, snow removal, and other services to
property owners; and
WHEREAS, the City has invoiced these users for the services, and payment on some of
these invoices is delinquent; and
WHEREAS, Minnesota State Statutes 444.075, 429.101, and 443.015 allow the City to
certify charges associated with the aforementioned municipal services for collection with the
County Auditor as other taxes are collected.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Farmington that:
1. Delinquent charges associated with the municipal services and an administrative fee,
as defined in the City’s Fee Schedule, shall be certified to the County Auditor for
collection as other property taxes are collected; and
2. The amounts shall be due and payable from the date of adoption through
December 31, 2024, at an annual rate of eight percent (8.0%).
