PLANNING COMMISSION MINUTES
REGULAR MEETING
May 9, 2023
1. CALL TO ORDER
The meeting was called to order by Chair Rotty at 7:00 p.m.
Members Present: Rotty, Tesky, Windschitl,
Members Absent: Lehto, McAbee

APPROVAL OFMINUTES
a) Approve Planning Commission Minutes
MOTION by Windschitl, second by Rotty to approve the Regular Meeting minutes of
the Planning Commission from April 11, 2023. Voting for: Rotty, Windschitl.
Abstain: Teslcy. MOTION CARRIED.
PUBLIC HEARINGS

4. DISCUSSION
4.1 Vermillion Commons 2nd Addition Final Plat - Planning Manager Wippler
noted that this addition consists of 58 townhome lots. Staff recommends approval
of the Vermillion Commons 2nd Addition final plat contingent upon the following,
and forward that recommendation on to the City Council:
1. The plat must be revised as outlots need to be relabeled to eliminate duplicate
lettering.
2. The satisfaction of all engineering comments related to the construction plans for
grading and utilities.
3. A Development Contract between the applicant and City of Farmington shall be
executed and security fees and costs shall be paid. Submission of all other
documents required under the Development Contract shall be required.
MOTION by Tesky 2nd by Windschitl to recommend approval of the Vermillion
Commons 2nd Addition final plat and forward to the City Council. APIF, MOTION
CARRIED.
4.2 Findings of Fact - Amendment to Conditional Use Permit to Allow
Expansion of a School Within the B-2 Zoning District - The commission
reviewed the Findings of Fact. MOTION by Windschitl second by Teslcy to accept
the Findings of Fact as presented. APIF, MOTION CARRIED.
4.3 Discuss Possible Amendments to Section 10-6-29 (Chickens on Residential
Lots) - Planning Manager Wippler had some starting points. He reviewed how the
permit is approved or denied. Currently, a Public Hearing is held for

approval/denial of the permit. Then each year an administrative renewal permit is
issued. We could move it all to the "administrative" process.
Look at the number of hen chickens allowed. Originally it was at 6 when first
discussed and then the commission felt 3 was appropriate. Planning Manager
Wippler would be comfortable with a maximum of six.
Zoning district. Could open up to single family zones. Limiting only to single family
uses.
A Public hearing is necessary to approve the permit. If the permit becomes
administrative, there would be no need to hold a public hearing.
Adjacent property owners are notified of the public hearing and can provide input at
that time. If the permit becomes administrative, there would be no need to hold a
public hearing.
If an initial Urban Chicken Permit is granted by the Planning Commission, every
year after that chickens are kept on the subject property a Renewal Permit must be
administratively approved by the City's Planning Department. The Renewal Permit
is required to be submitted 30 days prior to the date the initial permit was approved
by the Planning Commission. We could remove the requirement for a Renewal
Permit entirely or change the duration of the permit (i.e., need to apply for a
renewal permit and have an inspection every two to three years that chickens are
kept on the property). Fees (per the 2023 City Fee Schedule): Urban Chicken Permit
fee - $100, Renewal Permit fee - $40. The fees would have to be reviewed based on
any changes to the ordinance that the Planning Commission may deem necessary.
Commissioner Tesky is open to increasing the number of hen chickens to four. If we
did issue permits administratively, how would we handle complaints by neighbors?
Planning Manager Wippler noted, he has not received any complaints with regard to
current permit holders. We could revoke the permit, issue warnings and do
reinspection for compliance. She also asked about the smaller lot size if it is opened
up to other zoning districts.
Commissioner Windschitl agreed with Member Tesky. He thinks the neighbors
should be notified.
Chair Rotty has visited every permitee's home to see the end result. He has not
received any complaints. He thinks it can be handled administratively. He would
want to know the purpose, i.e. eggs for family. The purpose was not "for sale". It
was felt that by increasing the number of hen chickens you could potentially start
seeing eggs "for sale" and that was not the purpose of the ordinance. Chair Rotty
would agree to no more than four hen chickens. His concern on smaller lots would
be the ability to comply with screening requirements. He also felt that they could
look at how the renewals are done. It may not be necessary to have the renewal
every year. He also noted that two commissioners were missing tonight and he likes
to have a full commission on potential ordinance amendments.

Planning Manager Wippler stated that the next step would be for him to draft an
ordinance to address the comments tonight as a starting point. He would bring it
back in June/July.
