INTRODUCTION:
U.S. Home, LLC has submitted the 2nd Addition final plat for the Vermillion Commons
development. The final plat contains a total of 58 townhome lots over 56.1653 acres. Vermillion
Commons is located at the northwest intersection of 220th S treet W and Denmark Avenue.
DISCUSSION:
The developer is proposing 58 townhome units in the second phase of the Vermillion Commons
development. Vermillion Commons is a private townhome development that will be maintained by
a homeowners association. The approved preliminary plat for Vermillion Commons proposes 276
townhome units over a total of 75.78 acres yielding 6.7 units per acre (this calculation excludes the
area of the development that is guided as Park/Open Space within the city's comprehensive plan).
The property is zoned R-3 (Medium Density Residential) and guided as medium density residential
in the 2040 Comprehensive Plan. This land guidance allows for 6 -12 dwelling units per acre.
Vermillion Commons is being developed as a Planned Unit Development [PUD]. The PUD
agreement for the development was approved with the initial phase in 2022. The PUD allows for
the use of private streets and reduces the side yard setback on a corner lot from 25 feet to 15 feet.
In addition to the 58 townhome lots, the 2nd Addition final plat consis ts of 15 outlots. Outlot A is
31.6764 acres and consists of future development and easements for four (4) natural gas pipelines.
Outlot B is 17.5508 acres and consists of wetland and floodplain and will be deeded to the city.
Please note that the remaining outlots within the plat will have to be relabeled C - O prior to
recording of the plat at the County as the plat currently shows two Outlot B's. The outlots currently
labeled as D, K, and N consist of private roads and storm water facility, respectively. The
remaining outlots consist of common areas around the townhome lots.
Access to this site will come from 218th Street W, via the extension of Denton Avenue to the north.
Denton Avenue consists of a 60 foot right-of-way with a 32 foot wide roadway. The private streets
which are to be constructed in the outlots currently labeled D and K are measured 27 feet in width
with curb and gutter.
An eight (8') foot wide bituminous trail will be constructed along Denmark Avenue to the extents of
the 2nd Addition within a twenty-five (25') foot wide trail, drainage and utility easement.
Additionally, a five (5') foot wide sidewalk will be installed on the West side of Denton Avenue.

The developer is proposing 31 off-street parking spaces within the 2nd Addition. Additionally, the
proposed townhomes will provide two-car garages and space for 2 cars parked in the driveway of
each unit.
Engineering Review
The Engineering Department has reviewed the Vermillion Commons 2nd Addition final plat and
recommends approval upon satisfaction of all engineering comments related to the construction
plans for grading and utilities as well as the applicant entering into a Development Contract with the
city and all security, fees and costs paid.

Request for an Amendment to Conditional Use Permit to
allow for the expansion of a Charter School within the B-2
Zoning District—115 Elm Street,Farmington,MN 55024
On March 14,2023,the applicant requested an amendment to a Conditional Use Permit to allow
for the expansion of the Great Oaks Charter School at the property located at 115 ElmStreet in
Farmington.The Planning Division for the City of Farmington now makes the following Findings of Fact
regarding the property addressed as 115 Elm Street,Farmington,MN 55024.

FINDINGSOF FACT
Theproperty is located at 115 ElmStreet and is zoned B-2 (Downtown Business).
The B-2 Zoning District conditionally allow school uses.
Per the 2040 Comprehensive plan,the subject property is guided for Commercial uses.
On January 11,2022 the Planning Commission granted a Conditional Use Permit to allow Great
Oaks Academy to occupy a portion of the property addressed as 115 Elm Street.
On February 10,2023 Great Oaks Academy applied for an amendment to the previously
approved Conditional Use Permit in order to expand the use at the premises.The expansion was
to include the following:
a.interior renovation of the northern most portion of the existing school building that had
been occupied by @Bat.This was to consist of converting the space into 3 additional
classrooms and restrooms.
b.Interior renovation of the existing strip center on the east side of the premises.This
was to consist of converting this space into 8 middle school classrooms,cafeteria,of?ce
space,science room,art room and restrooms.
c.Building addition to the northeast side of the existing strip center.The addition was to
include a lobby area,restrooms,storage areas and a 5,200 square foot gymnasium.
d.Removal of portions of the existing parking lotto create a courtyard to the south of the
proposed gymnasium addition along with adding greenspace on the southern end ofthe
existing strip center building adjacent to the right—of—wayof Elm Street.
The Planning Commission opened a public hearing for the February 10"‘application at their
regular meeting on March 14,2023 at which time public testimony was taken.The Commission
continued the public hearing to the April 11”‘regular meeting in hopes to have the property
owner in attendance to answer questions.
Section 10-3-5 of the City Code provides 6 criteria that must be satis?ed for the Commission to
grant a Conditional Use.
The Commission cited #2 of the aforementioned criteria,”The proposed use shall not involve any
element or cause any conditions that may be dangerous,injurious or noxious to any other
property or person and shall comply with the performance stands listed below”.The Commission
had concern with the lack of a full buildout plan for the entire campus and a traffic study that

includes full K-12 enrollment projections.Without that information,the Commission could not
be certain that this criteria has been met.*
9.The Commission cited #3 of the aforementioned criteria,”The proposed use shall be constructed,
designed,sited,oriented and landscaped to produce harmonious relationship of buildings and
grounds to adjacent buildings and properties”.The commission stated that by constructing the
gymnasium and a possible future high school in the middle ofthe parking lot it would block the
businesses to the north and could potentially obstruct traffic flow for these businesses and that
the layout wouldn't be harmonious in nature.
10.The Commission cited #5 of the aforementioned criteria,”The proposed use shall organize
vehicular access and parking to minimize trafficcongestion in the neighborhood”.The
Commission stated that the Conditional Use Permit Amendment will increase vehicular and bus
traf?c on Elm Street,one ofthe busiest in our community,and without suf?cient planning and a
full buildout plan this may be putting the city's residents at a greater risk in this area.
11.On April 11,2023,the Planning Commission voted to deny the requested Conditional Use Permit

INTRODUCTION:
After brief discussion at the April 11th regular meeting, the Planning Commission agreed to review
Section 10-6-29 of city code as it relates to chickens on residential lots. This section of code is
attached for your review.
DISCUSSION:
Review
The City Council adopted Ordinance 013-660 on March 18, 2013 establishing Section 10-6-29
(Chickens on Urban Residential Lots) within the city's zoning code. The ordinance was amended
on June 16, 2014 (Ordinance 014-668) to remove the minimum lot area requirement for keeping of
hen chickens on urban residential lots.
Since the inception of the ordinance in 2013, a total of 15 permits have been approved by the
Planning Commission of which 9 permits are still active.
Current Process for Permit (initial suggestions for amendments will be shown bolded below)
Generally the process for obtaining and maintaining an Urban Chicken Permit in the city is as
follows:
1. Submit application and all appropriate forms, information, documentation and fees.
Information and documentation includes, but is not limited to: Staff feels a permit should
still be required. Permit could be done strictly administratively.
a. Number of chickens to be kept on property (maximum of 3 hen chickens is currently
allowed); Consider amending the number of hen chicken allowed (increase
versus decrease). Staff originally recommended up to 6 hen chickens in 2013.
b. Scaled site plan or property survey showing the proposed location of the chicken coop
and/or run on the subject property;
c. To-scale building plan, including elevations and building materials, of the proposed
coop and/or run;
d. Zoning district for subject property. Must be located within the R-1 (Low Density
Residential) zoning district. Could open up the permit to single-family residences

within additional residential zoning districts such as R-2 (Low/Medium Density
Residential) and R-D (Downtown Residential). Limiting it to single-family uses
only. The R-2 and R-D zones allow for a minimum lot size of 6,000 square feet.
2. A public hearing will be held at the City's Planning Commission within 60 days following
receipt of a completed application. If permit becomes administrative there would be no
need to have a public hearing - this requirement could be removed.
3. A notice of public hearing is published at least ten (10) days prior to the public hearing. If
permit becomes administrative there would be no need to hold a public hearing - this
requirement could be removed.
4. All adjacent property owners to the subject property shall be notified by post mail ten (10)
days prior to the public hearing. If permit becomes administrative there would be no
need to have a public hearing - this requirement could be removed.
5. The Planning Commission may grant or deny the application after the close of the public
hearing based on information obtained at the hearing. If administrative permit, this could
be removed.
6. If an initial Urban Chicken Permit is granted by the Planning Commission, every year after
that chickens are kept on the subject property a Renewal Permit must be administratively
approved by the City's Planning Department. The Renewal Permit is required to be
submitted 30 days prior to the date the initial permit was approved by the Planning
Commission. Could remove the requirement for a Renewal Permit entirely or change
the duration of the permit (i.e., need to apply for a renewal permit and have an
inspection ever two to three years that chickens are kept on the property).
7. Fees (per the 2023 City Fee Schedule): Urban Chicken Permit fee - $100, Renewal Permit
fee - $40. The fees would have to be reviewed based on any changes to the ordinance
that the Planning Commission may deem necessary.

any suggested changes that the Commission may have.

10-6-29: CHICKENS ON URBAN RESIDENTIAL LOTS:
(A) Permit Required: An urban chicken permit shall be required for the keeping of any hen chickens on residential
property less than two and one-half (21/2) acres in size, provided said property is zoned R-1 (low density residential). The
keeping of chickens on lots two and one-half (21/2) acres and larger are regulated under section 6-4-2 of this code. An urban
chicken permit requires a public hearing be held by the board of adjustment after a fee, established by the city council, is
paid and all adjacent property owners are notified. Supporting information/documents to be submitted to the planning
division with an urban chicken permit application are:
1. Number of chickens to be kept on the property.
2. Site plan or property survey showing the proposed location of the chicken coop and/or chicken run on the subject
property.
3. To scale building plan, including elevations, of the proposed coop and/or run.
(B) Duration Of Permit: The urban chicken permit shall be valid for one year from the date of board of adjustment
approval. A renewal permit will be required every year after the initial board of adjustment approval that chickens are kept
on an approved residential lot. An application for a renewal permit shall be filed with the city thirty (30) days prior to the
expiration of the current permit. The urban chicken permit may be terminated or not renewed for violations of the ordinance
following notice to the permit holder and an opportunity for a hearing at the board of adjustment.
The renewal permit will be reviewed and approved administratively. The fee for a renewal permit will be established yearly
by the city council.
(C) Automatic Termination Of Permit: If the owner of hen chickens, who has an approved permit, moves from the
premises approved for said hens, the urban chicken permit shall automatically become null and void.
(D) Limitation On The Number Of Chickens: No person shall keep on any single-family residential property more than
three (3) total hen chickens.
(E) Three Or More Dwelling Unit Properties: Chickens are not allowed on properties that contain three (3) or more
dwelling units.
(F) No Roosters: No person shall keep roosters, or adult male chickens, on any residentially zoned property less than two
and one-half (21/2) acres in size.
(G) No Cockfighting: Cockfighting is specifically prohibited within the city.
(H) No Slaughtering: The slaughter of chickens is prohibited on residentially used or zoned properties.
(I) Ownership Occupancy: The owner of the chickens shall live on the property on which they are being kept.
(J) Confinement: Every person who owns, controls, keeps, maintains or harbors hen chickens must keep them confined
on the premises at all times in a chicken coop or chicken run while in the city. Chickens are not allowed to be located in any
part of the home and/or garage.
(K) Shelter And Enclosure Requirements: Chickens shall be properly protected from the weather and predators and have
access to the outdoors in an enclosure or fenced area. The shelter and/or enclosure shall meet all of the following
requirements:
1. Any chicken coop and run fencing must be consistent with building and zoning codes.
2. No chicken coop or run shall be constructed on any urban residential lot prior to the time of construction of the
principal structure.
3. One chicken coop and/or chicken run will be allowed per residential lot provided the maximum lot coverage of the
underlying zoning district is not exceeded.
4. Chicken coops and runs shall not be located in the front or side yards and shall not be placed within any drainage
and utility easements found on residential lots.
5. Any chicken coop or run shall be set back at least twenty five feet (25') from any principal structure on adjacent lots
and a minimum of ten feet (10') from all property lines.
6. Any chicken coop or run shall be screened from view with a solid fence or landscaped buffer with a minimum height
of four feet (4'). All fencing shall be in accordance with section 10-6-12 of this chapter.
7. All chicken coops must have a maximum size of ten (10) square feet per chicken and must not exceed eight feet (8')
in total height. Fenced in chicken runs must not exceed twenty (20) square feet per chicken and fencing must not exceed six
feet (6') in total height. Chicken runs may be enclosed with wood and/or woven wire materials, and may allow chickens to
contact the ground. Chicken runs must have a protective overhead netting to keep the chickens separated from other
animals.
8. Chicken coops must be elevated a minimum of twelve inches (12") and a maximum of thirty six inches (36") above
grade to ensure circulation beneath the coop.

9. Chicken grains and feed must be stored in a rodentproof container.
(L) Conditions/Maintenance And Inspection: No person who owns, controls, keeps, maintains or harbors hen chickens
shall permit the premises where the hen chickens are kept to be or remain in an unhealthy, unsanitary or noxious condition
or to permit the premises to be in such condition that noxious odors to be carried to adjacent public or private property. Any
chicken coop and chicken run authorized under this section may be inspected at any reasonable time by the city. (Ord. 014-
