1. The satisfaction of all engineering comments related to the
construction plans for grading, streets and utilities.
2. A development contract between the developer and City of
Farmington shall be executed and security fees and costs shall
be paid. Submission of all other documents required under the
development contract shall be required.

The meeting was called to order by Chair Rotty at 7:00pm

2. APPROVAL OF MINUTES
MOTION by Tesky, second by Snobeck to approve minutes of Planning Commission for
November 12th, 2024, regular meeting. APIF, MOTION CARRIED
3. PUBLIC HEARINGS
Chair Rotty opened all public hearings.
3.1 Akin Knoll Combined Preliminary and Final Plat- Planning Coordinator Johnson
stated that the applicant has requested an additional continuation while they make final
adjustments to their plans.
MOTION by Windshitl, second by Lehto to continue until January Planning Commission
Meeting. APIF MOTION CARRIED
3.2 Ordinance amendments to Title 10, Chapters 2,5 and 6 of the Farmington City
Code as it relates to Cannabis Business- Planning Manager Wippler presented the
recommended amendments.
10-2-1: ZONING DEFINITIONS:
• CANNABIS CULTIVATION- A use involving the licensed growing and harvesting of
cannabis.
• CANNABIS OR HEMP MANUFACTURING- An establishment or use of land which
involves the compounding, processing, packaging, wholesaling, testing,
treatment, transportation, or delivery of cannabis or hemp products.
• CANNABIS RETAIL- A licensed establishment where cannabis flowers, immature
cannabis plants and seedlings, and related products as allowed by law are sold to
individual consumers who are at least 21 years of age.
• LOWER POTENCY HEMP EDIBLE RETAIL- A licensed establishment where lower
potency hemp edible products are sold to individual consumers who are at least
21 years of age.
SECTION 2. Title 10, Chapter 5, Sections 5, 11, 12, 13, 14, 15, and 17 of the Farmington
City Code is amended by adding the underlined language as follows:

• 10-5-11: B-1 HIGHWAY BUSINESS DISTRICT
o Conditional- Cannabis retail, lower potency hemp edible retail
• 10-5-12: B-2 DOWNTOWN BUSINESS DISTRICT
o Conditional- Cannabis retail, lower potency hemp edible retail
• 10-5-13: B-3 GENERAL BUSINESS DISTRICT
o Conditional- Cannabis Retail, lower potency hemp edible retail
• 10-5-14: SSME SPRUCE STREET MIXED USE DISTRICT-
o Conditional- Cannabis retail, lower potency hemp edible retail
• 10-5-15: MUCI- MIXED USE COMMERCIAL/INDUSTRIAL DISTRICT
o Cannabis retail, lower potency hemp edible retail
• 10-5-17: INDUSTRIAL DISTRICT
o Cannabis cultivation indoor, cannabis or hemp manufacturing
Creates 10-6-31- Cannabis Business Standards
Cannabis cultivation-
• All cannabis cultivation businesses must provide evidence of a state
license under Minnesota Statute 342.14 and be in compliance with the
provisions of the Zoning Code, City Code, and all applicable state laws and
regulations. B)
Cannabis or hemp manufacturing-
• All cannabis or hemp manufacturing businesses must provide evidence of
a state license under Minnesota Statute 342.14 and be in compliance with
the provisions of the Zoning Code, City Code, and all applicable state laws
and regulations. Ordinance 2024-13 Page 3 of 3
Cannabis retail-
• The City shall limit the number of cannabis retail businesses in the City to
no more than one business per 12,500 residents.
• Hours of operation for cannabis retail uses shall be between 8 am and 10
pm Monday through Saturday and between 10 am and 9pm on Sundays.
• All cannabis retail businesses must provide evidence of a state license
under Minnesota Statute 342.14 and be in compliance with the provisions
of the Zoning Code, City Code, and all applicable state laws and
regulations.
Lower potency hemp edible retail-
• Lower potency hemp edible retail uses shall be prohibited between the
hours of 2 am and 8 am Monday through Saturday and between 2 am and
10 am on Sundays.
• All lower potency hemp edible businesses must provide evidence of a
state license under Minnesota Statute 342.14 and be in compliance with
the provisions of the Zoning Code, City Code, and all applicable state laws
and regulations.
Chair Rotty opened public discussion. Windschitl asked if there is anything locally required
for licensing. Planning Manager Wippler explained it is all done through the state. He did say

enforcement will still go through the city. Ms. Trapp reiterated that the City is requiring
licensees complete registration with the City to assist with this.
MOTION by Windschitl, second by Snobeck to close Public Hearing. APIF MOTION
CARRIED
MOTION by Lehto, second by Tesky for favorable recommendation to City Council. APIF
MOTION CARRIED
4. ADJOURN

Meeting: Planning Commission - Jan 14 2025
INTRODUCTION:
Kerry Hanifl, the applicant, has requested a withdrawal of the Combined Preliminary and Final Plat
application for Akin Knoll.
DISCUSSION:
A public hearing was scheduled for the November 12th, 2024, Planning Commission meeting for
the Akin Knoll combined Preliminary and Final Plat located at 19927 Akin Road. The application
has been continued since that meeting to the January 14th, 2025, Planning Commission meeting
due to modifications being done to the plans.
Kerry Hanifl, the applicant, is now requesting a withdrawal of the application as some utility issues
are needing to be resolved. Due to the delay and that the application has been continued twice, the
applicant and staff agreed a withdrawal is appropriate at this time and the applicant can resubmit in
the near future once the issues are resolved.
BUDGET IMPACT:
Not applicable
ACTION REQUESTED:
Close the public hearing and accept the withdrawal of the application for the Akin Knoll Combined
Preliminary and Final Plat.

INTRODUCTION:
Summergate Development, LLC has submitted an application for final plat for the Meadowview
Preserve 2nd Addition. The development is located to the west of the Troyhill development and
north of Meadowview Elementary School off of 195th Street W. The final plat consists of 75 single-
family lots on 20.87 acres (see attached final plat).
DISCUSSION:
Meadowview Preserve 2nd Addition is the final phase of the development. The 75 single-family lots
are part of the 138 overall single-family lots that were proposed with the preliminary plat for this
project. The 2nd Addition final plat corresponds with the preliminary plat that was approved by the
Planning Commission on June 14, 2022 and the City Council on June 27, 2022.
The minimum lot area proposed with this phase is 7,764 square feet, with an average lot area of
9,476 square feet. The minimum lot width and depth proposed are 60 feet and 130 feet,
respectively (most lots exceed these minimums). There are no outlots associated with this final
plat.
The proposed setbacks for the development are as follows:
Front yard: 20 feet
Side yard (interior): 6 feet
Side yard (corner): 20 feet
Rear yard: 6 feet
With this final plat phase, Everfield Avenue and Everglade Path will be extended north with
Everglade Path connecting into the existing roadway within the Troyhill development on the east
side of this plat. In addition, 190th Street W is planned to be constructed with this phase from
where it currently terminates just west of Everest Path to the Everfield Avenue intersection. The
construction work associated with 190th Street W will be subject to separate review and further
discussion on costs. Right-of-way for 190th Street W was dedicated with the initial phase of
Meadowview Preserve. The street section for Everfield Avenue provides for a 60 foot right-of-way
with a 32 foot wide roadway. Everglade Path street section provides a 60 foot wide right-of-way
with a 28 foot wide roadway. The 192nd Street W street section provides a 60 foot wide right-of-

way with a 32 foot wide roadway.
Parks, Trails and Sidewalks
The city will be seeking to obtain cash-in-lieu of parkland dedication with this phase. The entire
Meadowview Preserve development (phase 1 and 2 combined) is required to dedicate 5.36 acres
of land for park purposes. The developer paid cash-in-lieu for 2.62 acres with in 1st phase. The
cash-in-lieu for the remaining 2.74 acres will be due with this phase.
Five foot wide sidewalks will be provided on the north and west side of Everglade Path, the west of
Everfield Avenue, and south side of 192nd Street W. A bituminous trail will be constructed within
an adjacent outlot (Outlot A, Meadoview Preserve). This trail will generally run north/south through
the outlot and will connect from an existing trail within the 195th Street W right-of-way up to the
190th Street W right-of-way.
Engineering Review
The Engineering Department has reviewed the Meadowview Preserve 2nd Addition final plat and
recommend approval upon satisfaction of all engineering comments related to the construction
plans grading, streets and utilities as well as the applicant entering into a development contract with
the city and all security fees costs paid.

Recommend approval of the Meadowview Preserve 2nd Addition final plat contingent upon the
following, and forward that recommendation on to the City Council:
