Department: Community Development
Subject: Conditional Use Permit to Construct a Community Solar Garden on PID: 14-
03400-87-010
Meeting: Planning Commission - Jul 08 2025
INTRODUCTION:
Dimension Energy has applied for a Conditional Use Permit (CUP) to construct a 4.95 mega-watt
community solar garden on PID: 14-03400-87-010 (subject property).
DISCUSSION:
Overview
Subject Property: PID: 14-03400-87-010
Applicant: Dimension Energy
Property Owner: Brian Murphy
Zoning: A-1 (Agriculture)
2040 Comp Plan Designation: Agriculture
Existing Use: Farmland
Surrounding Uses: Farmland to the north and south, single-family residence to the east, and vacant
industrial land (Lakeville) to the west.
Proposed Use: Ground mounted community solar garden and associated electrical appurtenances
across an 18.54-acre area of land on an approximately 30-acre parcel. Community solar gardens
are listed as a conditional use in the A-1 (Agriculture) zoning district.
Project Narrative: The purpose of the proposed project is to capitalize on the growing need to
provide clean and renewable energy as well supplement Xcel Energy's increasing requirements for
utility companies to obtain electrical power from renewable resources.
Review
Location
The subject property is located in the southwest corner of Farmington, generally located south of
County Road 50 and west of Flagstaff Avenue. There is no public access to the property. The only
access currently comes from a gravel driveway easement off Flagstaff Avenue that also serves the
single-family residence directly to the east.
Site Plan
Rows of ground mounted solar panels are proposed for a majority of the site. The panels are split
into two areas due to several property constraints:
There are two delineated wetlands in the center of the property, with trees surrounding the
larger wetland.
There's a gas pipeline easement that runs from the southwest corner to the northwest corner
of the site.
Xcel Energy service territory ends along the southern portion of the site. The project must be
located within Xcel Energy service territory.
Future extension of County Road 70 is proposed to go through the southwestern portion of
the site.
The site plan accounts for these constraints and no solar panels are proposed in these areas with
the exception of trees being removed along the northern edge of the larger wetland.
The solar panels meet all required setbacks in the A-1 (Agriculture) zoning district. These setbacks
are 50 feet from the front property line and 20 feet from the side and rear yard property lines.
Solar Panels
The proposed project will utilize 8,559 solar modules. Each module will be 94 inches in length by 45
inches in width. The modules will either be configured on a single axis tilt or a fixed tilt system. The
panels will be no more than 10 feet height from grade to the top of the panel at maximum tilt.
Decommissioning Plan
The applicant submitted a decommissioning plan which is typical for solar garden projects. The
decommissioning plan outlines the process for removing the solar panels from the site after their
usable lifespan (20-30 years). The plan ensures the user will restore the site to its previous state.
As a condition of approval, the decommissioning plan must be signed with the City prior to building
permit issuance.
Access
Access to the site will come from an existing driveway easement at the southeastern corner of the
property. An 18-foot-wide access road will run along the eastern property line up into the site. It will
serve both areas of solar panels with gated entrances at each location. In order to reach the solar
panels on the north side, the access road must cross the gas pipeline easement. A copy of the
encroachment agreement with the gas company will be required to be submitted to the City as a
condition of approval. The access road is currently proposed to be gravel but will be required to be
paved per City Code and is also listed as a condition of approval.
As mentioned above, future County Road 70 is proposed to extend from Lakeville and go through
the southwest portion of the site. This is not anticipated to occur for many years, but Dakota County
still needs the dedicated right-of-way on the site for the future expansion. Therefore, the applicant
and property owner will be required to plat the property as a condition of approval showing the
dedicated right-of-way for the future expansion of County Road 70.
Fencing/Screening
The entire project will be enclosed by a 7-foot tall, steel electric fence with locked access gates. No
additional screening is proposed. There is an existing tree stand along the eastern property line that
currently screens the single-family residential property from the site.
Landscaping
Once construction is complete, the ground underneath the panels will be reseeded with low growth
grasses. No other landscaping is proposed; however, a tree replacement plan will be required as a
condition of approval due to trees being removed along the northern edge of the larger wetland.
Utilities
No public utility infrastructure such as water and sewer is proposed for the project. The site will only
be served by private utilities including Xcel Energy.
There is no proposed stormwater management for the site. The applicant will work with Engineering
to ensure appropriate stormwater management will be in place. Meeting all Engineering comments
and requirements is listed as a condition of approval.

Community Solar Project Narrative
Farmington CSG 1 LLC (Applicant) proposes to construct and operate the Farmington CSG 1 Solar
Project (Project); a ground-mounted photovoltaic (PV) solar facility, 4.95 megawatts AC in capacity.
The Project is proposed to be located on a privately owned parcel, located in the City of Farmington,
Minnesota.
Purpose and Need
The purpose of the proposed Project is to construct and operate the PV solar facility, which will generate
clean and renewable solar energy. The Project was conceived in response to the growing need for
sustainable energy sources and Xcel Energy’s increasing requirements for utility companies to obtain
their electric power from renewable resources.
Based on its commitment to providing renewable energy, the Applicant proposes to develop the site
described below to maximize its solar energy potential. To best determine optimal location within the
site, the following factors have been analyzed:
• Significant solar radiation (insolation)
• Site accessibility
• Avoidance of environmentally sensitive areas
• Limited tree and vegetative clearing
Site Control
Applicant has executed a ground lease agreement with Brian P. Murphy and Tricia T. Murphy, jointly
the landlord. The lease pertains to a portion of land, approximately 30 acres, in Farmington,
Minnesota, where the applicant will develop and operate a solar electric generating facility. The lease's
execution date and development term begin on July 15, 2024, and lasts up to three years, with an
option to extend, followed by a 25-year operating term. The applicant will pay both development rent
and operating rent. Applicant is responsible for constructing, operating, and maintaining the facility,
while the landlord ensures access and cooperation throughout the lease term. Additionally, provisions
include easements for utility access, insurance requirements, and the applicant’s right to alter the
property as needed.
Site Setting
The Project site occupies 18.54 acres within a larger 30-acre parcel (PIN 140340087010) in Farmington,
MN. The site is bordered by industrial lands in the City of Lakeville to the west, farm fields to the north
and south, and a residential property to the east. The Project will be accessed via an upgraded farm
entrance from Flagstaff Avenue.
A wetland delineation was completed for the entire parcel. Two small, wetlands were identified, one is
a farmed wetland. Approval for the wetland boundary and type was granted by the Dakota County Soil
and Water Conservation District. The project was designed to completely avoid both wetlands. One of
the small, wetlands on the west side of the property has solar panels within the 25-foot buffer average
of the wetland, but is beyond the minimum 16.5-foot buffer requirement. This type of activity in a
wetland does not diminish its function and therefore qualifies for a “No-Loss” under the Wetland
Page 16 of 54

Conservation Act and is not regulated by the US Army Corps of Engineers. An application for
approval from the Dakota County SWCD is in process.
This project will have “no effect” on state or federally listed species, their habitats or their designated
critical habitat. No further consultation with MN Department of Natural Resources nor the US Fish and
Wildlife Service is anticipated.
Design Standards
The Applicant has reviewed the Farmington Code of Ordinances and intends to comply with each
requirement listed for Conditional Use Permits (§10-3-5) and all referenced criteria therein, such as A-1
Agricultural District requirements (§10-5-5) and Shoreland Management Regulations (§10-6-18).
Transportation and Access
The site will be accessed via an existing, upgraded entrance off Flagstaff Avenue. The Applicant
intends to enter into a Driveway Access Agreement with landlord to facilitate access to the Project
Materials for the proposed Project (e.g., solar modules, supporting racks, foundation materials,
electrical gear) will be brought to the site by truck over the course of construction. It is not expected
that the additional vehicles associated with construction will have an impact on the overall traffic in
Farmington. Once construction is complete, vehicles will be on site sparingly for operations and
maintenance activities. The Project will not be continuously attended once operational.
The permanent facility access road will be installed using gravel substrate. The road will also be wide
enough to accommodate emergency vehicles and designed in compliance with applicable standards.
Screening and Ground Cover
The solar array and all balance of system equipment will be enclosed in a minimum seven-foot-tall
fence in compliance with the national electric code. The fence will have at least one vehicle access
gate at the boundary of the array, which will always remain locked, except during operations and
maintenance activities. Vegetative ground cover is to be established per the enclosed Planting and
Restoration Plan (Sheet 06 of the Site Plan).
Dense, well-established vegetation on the east side of the Project on the neighboring property owner’s
west side consisting of mature evergreen trees and low shrubs will screen views of this project from
this adjoining property owner’s view.
Project Signage
Visible project identification and warning signs shall be posted at each ingress/egress point
associated with the Project. The Project emergency contact information and 911 address will be
clearly posted on all warning signage.

Interconnection
The Applicant has submitted an interconnection application with Xcel Energy and the project is currently
progressing through the study process. The proposed facility is planned to interconnect to Xcel’s three-
phase line on the east side of the Project
Key Project Components
The proposed Project will consist of the following key components:
• Solar Modules
• Underground Electrical Conductors
• Balance of System Equipment
• Access Roads
• Fencing
Solar Modules
The proposed Project will utilize approximately 8,559 solar modules. The modules are manufactured
offsite and will be delivered to the site by truck in wooden crates or cardboard boxes. Each module
will measure approximately 94” in length by 45” in width and will be rated at 605 Watts each. Solar
modules will be configured on a single axis tracking racking system.
The frames of solar modules will be mounted on steel posts, which would be driven or screwed into the
ground to a depth between 10 and 15 feet. The posts will be made from galvanized or corrosion-resistant
metal to minimize the potential for corrosion over the lifespan of the project. Appropriate spacing will be
maintained between each row of solar modules for operations and maintenance access.
Underground Electrical Conductors
Underground electrical conductors will be installed in trenches at depth in compliance with the National
Electric Code. Conductors will either be buried in a polyvinylchloride (PVC) conduit or equivalent.
Balance of System Equipment
Balance of System Equipment including but not limited to AC combiner boxes, transformers, and/or
medium voltage switchgear may be installed near the solar array within the Project’s fence line.
Balance of System Equipment will be installed on concrete pads and in compliance with equipment
manufacturer instructions. Full details of Balance of System Equipment will be included as part of the
Project’s electrical design plan set submitted for ministerial permits.
Summary of Construction Activities and Components
Site preparation will consist of clearing the existing vegetation in those areas where construction will
be undertaken, grading, and establishing temporary staging areas (including stockpile and laydown
areas). Once the site is prepared, the installation of racking equipment, modules, and balance of
system equipment can begin.

Clearing and Grading
Selected vegetation located on the proposed Project site may be removed in order to accommodate
the construction of the array and its appurtenances, as well as to prevent shading on the array during
operation. Because the solar modules will be placed approximately 2-3 feet above grade, any
vegetation taller than 2 feet or expected to exceed 2 feet in height will be removed. Grass and
groundcover may remain between rows and under the solar modules. After construction, the ground
underneath the array will be reseeded with low growth grasses to promote soil stability. All cleared
vegetation will either be chipped and spread on site or disposed of responsibly.
Construction equipment such as tractors, backhoes, loaders, dozers, and graders may be needed to
clear vegetation from the site, and to grade roads and areas where structures currently stand. While
the racking equipment can tolerate some slope, grading of the array area may also be required to
even out the terrain. Due to the pre-existing grade of the site, minimal grading is anticipated.
Staging Areas
A temporary staging area will be used as a laydown area for equipment and materials such as solar
crates, electric cable, structural supports, and Balance of System Equipment, as well as the location
for sanitary facilities and a construction trailer. The portion of the staging area containing equipment
and materials will likely be enclosed with a temporary construction fence with a lockable gate.
Racking and Modules
The foundations securing the solar modules will be designed to withstand high winds and snow loads.
Galvanized or corrosion-resistant steel piles will be driven into the ground between 10 and 15 feet,
depending on soil conditions and depth to bedrock. Modules will be aggregated into frames and
mounted on each supporting pile.
Balance of System Equipment and Conductors
Balance of System electrical equipment will be located on concrete pads within the Project’s fence line.
Balance of System equipment may include cabinet style equipment such as AC combiner boxes,
transformers, and medium voltage switchgear, which will be anchored directly to the concrete pad, as
well as smaller metering and controls equipment, which would be mounted on H-frames or other
supporting structures. Structural analysis will be performed to determine the size and thickness of the
concrete pads.
The low-voltage conductors connecting solar modules to the Balance of System (BoS) Equipment will
be supported using an above-ground cable management system, specifically the CAB (Cable
Aboveground) system. The CAB hangers will securely suspend and organize the conductors,
ensuring compliance with applicable standards for above-ground installations. Since the conductors
will be elevated, trenching will not be required, and there will be no need for underground conduit
installation.
This system will simplify maintenance access and provide enhanced protection for the conductors.
Medium voltage conductors will mostly run underground in a similar fashion to low voltage wiring. A
portion of the medium voltage conductor will ultimately come above ground and strung along new
distribution poles, ultimately terminating at three three-phase lines that will be extended to Base Line
Road.

Employment
A typical construction workforce for a solar facility of this size consists of approximately 25 construction
workers during the construction period, which should last approximately 6 months. Construction
personnel will be divided between civil and electrical services and, based on the phasing of
construction, it is not anticipated that all workers will be present on site at the same time. Workers will
be transported to the site via construction trucks and will park in the established staging area.
Water Use, Sewer, and Solid Waste
No water will be required for construction activities, and no water infrastructure is proposed in
association with the Project. Sewer services are not anticipated. Temporary sanitary facilities will be
placed on site during construction.

Introduction
Farmington CSG 1 proposes to construct and operate a ground-mounted fixed tilt photovoltaic (“PV”) solar
system, 4.95 MW (AC) in capacity. The Farmington CSG 1 Solar Project (“Project”) is proposed to be located
on a privately owned parcel, in City of Farmington, Minnesota (PIN: 140340087010).
Ground-mounted solar facilities are designed, engineered, and constructed to operate for at least 20 years and
can operate up to 30 years or more. During construction, portions of the site may be compacted, excavated,
and graded for optimal installation and operation. This decommissioning plan outlines the steps that will be
taken to remove the solar system and its associated appurtenances from the Project site and return the parcel
to conditions similar to pre-installation.
This Decommissioning Plan will be updated as necessary in the future to ensure that changes in technology
and site restoration methods are taken into consideration.
System Decommissioning
Farmington CSG 1 is responsible for decommissioning activities, as outlined in the conditions of permit
approval by the local regulatory agencies and pursuant to the guidelines provided in local county ordinance.
Decommissioning and restoration activities will align with current regulations at the time of decommissioning
and will be conducted in accordance with state and local regulations. At the end of its operational life, or if the
system is abandoned or upon cessation of activity, the entire system will be disconnected from the grid,
disassembled, and removed, and all materials will either be recycled or disposed of appropriately within a
period of 12 months and at the expense of the Facility Owner. Any necessary permits will be obtained from the
local AHJ and/or relevant State authorities prior to decommissioning activity.
During City of Farmington’s permitting process, or if none, then prior to the commencement of project
construction, Farmington CSG 1 shall file with City of Farmington a Deconstruction Plan. Farmington CSG 1
shall additionally file an updated Deconstruction Plan with City of Farmington on or before the end of the tenth
year of commercial operation.
Abandonment Definitions
Written notice will be provided to the AHJ’s Code Enforcement Officer within 30 days in the event the operation
of the system is discontinued. The Applicant acknowledges that the system must be decommissioned if the
Project has not been verified to be active or in continuous service for the prior year, and that decommissioning
notification will be provided by the Code Enforcement Officer.
Timing Requirements
Decommissioning and removal of the Project will be completed within a period of 12 months from the time at
which the Facility is determined to be abandoned or has reached the end of its useful life. Or, as noted above,
if the Code Enforcement Officer has deemed the Project to be inoperative or abandoned for the prior year, the
equipment both above and below ground, structures, and foundations will be removed. The soil and surface
grade will be restored and revegetated with native seed mixes and/or plant species, excluding invasive
species.

Equipment and Material Removal
Farmington CSG 1 will remove all above-ground equipment (solar modules, racking and support structures,
inverters, transformers, switchgear and other ancillary electrical equipment, meterological stations and
concrete pads for equipment) and underground equipment (buried electrical wiring and conduits, concrete
foundations), structures, fencing, and access roads. All equipment and materials will be evaluated to determine
the appropriate facility for salvage, recycling, or disposal.
Photovoltaic Modules
The photovoltaic (PV) modules, commonly known as solar panels, will be disconnected from the inverters and
removed from the steel racking system. The PV modules are made of silicon, glass, and aluminum and are not
considered hazardous waste. PV modules will be recycled or resold on the market if determined to still be
usable.
Associated Electrical Appurtenances
All associated electrical appurtenances (i.e. switchboards, transformers, disconnects, meters) will be removed
from their respective concrete pads and/or steel racking structures and sorted for salvage, recycling, or
disposal at an approved facility.
Electric Wiring
All electric conductors made of copper and aluminum can be recycled. Above-ground DC wires will be
removed between the modules and inverters. Underground AC conductors will be unearthed and removed.
Above-ground AC conductors run to the utility point of interconnection will be removed from the poles by the
utility company.
Racking Equipment and Fencing
Metal fencing and racking equipment will be removed and recycled at an appropriate facility. All driven posts
will be removed.
Concrete Pads
Concrete pads will be excavated to a depth of two feet below grade, or the depth required to retrieve all rebar
and other structural elements. Clean concrete will be crushed and removed from the site. The remaining
excavation will be filled with clean material, of similar character to surrounding soils. The soil and surface grade
will be restored, and revegetated with native seed mixes and/or plant species, excluding invasive species.
Access Road
If allowable by City of Farmington, the access road will remain in place for future use on the site. If required to
be removed, gravel roads will be stripped of stone and any geotextile or underlying materials. Clean stone will
be reused if possible, or otherwise disposed of at a proper facility, along with geotextile materials. Any asphalt
roads will be broken up and similarly disposed of. If the underlying soils are compacted, these will be loosened
and stabilized. The soil and surface grade will be restored and revegetated with native seed mixes and/or
plant species, excluding invasive species.

Disposal and Recycling of Materials
All hazardous wastes will be disposed of in accordance with laws in effect at the time decommissioning is
performed. Any solid waste generated during system dismantling or demolition will be disposed of as
necessary to comply with the solid waste regulations then in place. All waste will be removed from the site.
Site Restoration
The site will be restored to a state consistent with its preconstruction condition. Any necessary construction
stormwater permits will be obtained prior to decommissioning, and erosion and sediment control best
management practices will be installed on site, as needed. After equipment is removed from site, soils will be
de-compacted, and excavations will be filled with materials similar to soils on site. Any disturbed areas will be
reseeded and erosion and sediment control BMPs will remain in place until the site is stabilized and then
removed upon confirmed stabilization. The soil and surface grade will be restored and revegetated with native
seed mixes and/or plant species, excluding invasive species.
Stakeholder Notification and Construction
Decommissioning activities will require the use of equipment and vehicles similar to those used in support of
construction activity. As necessary, interested stakeholders, such as adjacent landowners, will be notified prior
to the start of work on site. As noise may be temporarily elevated by construction equipment and vehicles
during decommissioning, activities will only be conducted during accepted Town work hours. The site will be
kept orderly and clean of refuse.
Decommissioning activity is anticipated to be completed within 12 months.
List of Stakeholders to be notified:
• City of Farmington – Code Enforcement Officer
• Neighbors owning the following adjacent parcels at the time of decommissioning, Parcel IDs:
o 140340086011
o 140340005014
o 221050000010
o 221050001010
o 221050000020
o 140340083010
Decommissioning Bond Estimate and Abandonment
Farmington CSG 1 will provide the AHJ with financial assurance, typically in the form of a decommissioning
bond, to provide for the decommissioning of the project and restoration of the site in accordance with the
decommissioning plan and any applicable state and local regulations. Provision of this assurance will be
phased in over the first 11 years of the Project’s operation in accordance with the requirements set forth in the
County Code
The decommissioning cost, as estimated by a state-certified third-party engineer, is $113,706.98 (attached as
Exhibit A). In the event the system is abandoned and/or upon cessation of activity for a period of one year, the
City of Farmington may issue notice to the Project. If no restorative action occurs within 12 months of such
notice the Town may use this decommissioning bond for removal of the system.

Change of Ownership
Farmington CSG 1 understands that the obligation to maintain a decommissioning bond is a continuing
obligation of the owner/operator (Farmington CSG 1).
Acknowledgement and Approval
The City of Farmington hereby acknowledges receipt of this Decommissioning Plan and affirms that the
Decommissioning Plan (assuming establishment of the form of surety agreed upon by the City of Farmington
and Farmington CSG 1) satisfies the conditions of the applicable permit approvals relevant thereto.

PLANNING COMMISSION AGENDA MEMO
To: Planning Commission
From: Tony Wippler, Planning Manager
Department: Planning Commission
Subject: Variance Request - Maximum Height Requirement for Fences - City of Farmington
Meeting: Planning Commission - Jul 08 2025
INTRODUCTION:
The City of Farmington is seeking a variance from the maximum height allowed for fences to
construct a fence eight (8') feet in height. The property is located at 19500 Municipal Drive
(Farmington Police Station) and is zoned R-1, Low Density Residential.
Planning Division Review
Applicant: City of Farmington, 430 Third Street, Farmington, MN 55024
Attachments:
1. Variance Application
2. Variance Request Letter
3. Fence Plans
Existing Zoning: R-1 (Low Density Residential)
2040 Comprehensive Plan: Public/Semi Public
Existing Land Use: Municipal Campus - Farmington Police Station
DISCUSSION:
Last year the City of Farmington received a Byrne Discretionary Community Project Grant in the
amount of $869,000. The grant was received for the installation of secure fencing around the City's
Police Station site. The fencing would consist of an eight (8') foot tall decorative metal fence that
would include brick columns to accent and break up the fencing. The brick would match the color
and material of the existing police station building. Section 10-6-12(D) states that a variance is
required for fences over six (6') feet and up to eight (8') feet in height when constructed within the
buildable areas of lots in residential districts. The project fencing as proposed would require a
variance of two (2') feet of additional fence height be approved by the Planning Commission.
As explained in the attached variance request letter,
"The City of Farmington proposes to implement the City of Farmington Police Department
Page 47 of 54
Infrastructure Security Project. The purpose is to better protect the critical infrastructure that is
housed in the police department building in the City of Farmington, including the city's fiber hub and
our evidence room. Project activities include the construction of a perimeter fence around police
department facilities to enhance security measures and fortify the integrity of critical infrastructure.
Expected outcomes include the establishment of a robust physical barrier that restricts
unauthorized access to the premises, thereby safeguarding sensitive areas, equipment, and
personnel. Although a barrier, the fence will be built in such a way as to blend in with the
neighborhood rather than appearing fortress-like. The intended beneficiaries are the residents of
the City of Farmington, as well as anyone that works or does business with the city. Additionally,
victims of crimes that occur in Farmington will benefit as the evidence stored in our evidence room
will be protected against breach or damage."
Attached, is a site map showing the proposed location of the eight (8') foot tall fencing. The fencing
will enclose the police station building, the parking areas along with additional property to the east
and west. The fencing is shown to be setback 20 feet from the right-of-way line of both 195th
Street W and Pilot Knob Road. The setback of the fencing from the right-of-way of English Avenue
would be approximately 40 feet.
Located on the site to the west of the Police Station building is a 100-foot-wide Northern Natural
Gas pipeline easement. The proposed fence will cross and enclose a portion of that easement. An
encroachment agreement with Northern Natural Gas will be necessary for the fence to be located
within the gas pipeline easement. This will be a condition of approval of the variance.
Section 10-6-12(F) states that an application for a building permit is required for all fences
exceeding six (6') feet in height. With the proposed eight (8') foot tall fence a building permit will
have to be applied for and approved prior to the installation of the fencing. This will be a condition
of approval of the variance.
The Planning Commission shall not approve the variance request unless they find that "practical
difficulties" exist using the following criteria:
1. Because the particular physical surroundings, or the shape, configuration, topography, or
other conditions of the specific parcel of land involved, strict adherence to the regulations of
this title would cause practical difficulties. Economic consideration alone does not constitute
practical difficulties.
2. That the variance would be consistent with the comprehensive plan.
3. That the variance would be in harmony with the general purposes and intent of this title.
4. The conditions upon which a variance is based are unique to the parcel of land for which the
variance is sought and are not applicable, generally, to other properties within the same
zoning classification.
5. The alleged difficulty or hardship is caused by this title and has not been created by any
persons presently having an interest in the parcel of land.
6. The granting of the variance will not alter the essential character of the locality or be injurious
to other property in the vicinity in which the parcel of land is located or substantially diminish
property values.
7. The proposed variance will not substantially increase the congestion of the public streets, or
increase the danger of fire, or be detrimental to the public welfare or public safety.
8. The requested variance is the minimum action required to eliminate the practical difficulties.
9. Variance may not be approved for any use that is not allowed under this title for property in
the zone where the affected person's land is located except that the temporary use of a one-
family dwelling as a two-family dwelling may be authorized by variance.
It is staff's recommendation that the above criteria have been met and that the Planning
Commission should approve the variance of two (2') feet of additional fence height.
BUDGET IMPACT:
Not applicable
ACTION REQUESTED:
Approve the variance request of two (2') feet of additional fence height, contingent upon the
following:
1. Submittal and approval of a building permit application for the proposed fencing.
2. Obtaining an encroachment agreement with Northern Natural Gas for locating the fence
within their gas pipeline easement.
