and infrastructure
• $0.02 supports special districts, watershed, mosquito control,
and Metro Council
External Factors & Unknowns:
• Fiscal Disparities
• Compensation and classification study results
• Health insurance premium renewals
• Worker's compensation and liability insurance rates
• Financing approach (shift from leasing to purchase vehicles)
• Bond issuance timing & debt service structure for major
projects
• Grant awards and funding changes
Key Drivers in 2027 Budget:
• Rising operational costs to maintain current service levels
• Capital reinvestment needs across multiple funds
• Major projects in motion that require levy support (street
projects, fire engine, Police Department Expansion
• Departmental requests exceed revenue growth from sources
other than levy (non -levy revenue not keeping up)
• Fund balance strength varies by fund, limiting flexibility in
several capital areas
• Timing of future debt issuance influencing when levy impacts
occur

REGULAR COUNCIL AGENDA MEMO
To: Mayor, Councilmembers and City Administrator
From: Kellee Omlid, Parks & Recreation Director
Department: Parks & Recreation
Subject: Accept Bids and Award Contract for the Jim Bell Park and Preserve Trail
Project and Joint Powers Agreement with Dakota County for Engineering
and Construction
Meeting: Regular Council - Aug 17 2026
INTRODUCTION:
Plans and Specifications for the Jim Bell Park and Preserve Trail Project were approved by
the City Council at its July 6, 2026, meeting.
The project includes reclamation of the main trail from just south of 189th Street through the
Jim Bell Park and Preserve to 195th Street. The trail will be widened to 10 feet to meet
Dakota County Greenway standards.
In addition, local trail connections from the park to Dunbury Avenue and 190th Street will
be reclaimed. A root barrier will also be installed along the pond side of the trail in areas
where existing willow tree roots have damaged the pavement.
As part of the project, a mid -block pedestrian crossing with Rectangular Rapid Flashing
Beacon ("RRFB") traffic control devices will be installed east of the intersection of 195th
Street and Embers Avenue. The crossing will connect to the existing trail on the south side
of 195th Street and the future final segment of the North Creek Greenway between Mystic
Meadows and Riverview Elementary School.
The City Council also authorized the Advertisement for Bids at its July 6, 2026, meeting.
DISCUSSION:
An Advertisement for Bids was posted in the Dakota County Tribune on July 10 and 17,
2026. Notice was also posed on the QuestCDN website.
Bids were opened and publicly read at 11 am on July 29, 2026. Five (5) bids were received.
The apparent low bidder is Dreamland Contracting LLC of Taylors Falls, Minnesota, with a
bid of $482,798.12. The Engineer's Estimate of Costs for the project was $667,974.50,
excluding the 10% contingency. The bid abstract is attached and a summary of bids is
provided below.
Contractor Bid Amount
Dreamland Contracting LLC $482,798.12
Bituminous Roadways Inc. $541,760.50
Urban Companies $589,290.40
JL Theis, Inc. $630,995.92
McNamara Contracting $639,825.00
Bolton & Menk reviewed references for Dreamland Contracting LLC and determined the
company is qualified to perform the work required by the contract. City and Dakota
County staff recommend awarding the contract to Dreamland Contracting LLC in the
amount of $482,798.12. If awarded the contract, Dreamland Contracting LLC has
indicated that they will complete the project this fall.
Also attached is a Joint Powers Agreement (JPA) with Dakota County for Engineering and
Construction for the North Creek Greenway Jim Bell Park and Preserve Segment. The City
will be the lead agency for this project. However, the City and County will share project
responsibilities and jointly participate in the project costs.
Dakota County will fund 85% of the North Creek Greenway trail design and construction
costs, with the City responsible for the remaining 15%. Costs associated with the local trail
connections to the Greenway will be shared equally, with Dakota County and the City
each paying 50%. Dakota County will also fund 100% of the RRFB traffic control system.
The City Attorney reviewed the attached JPA and found it to be acceptable.
BUDGET IMPACT:
Funding for the City's share of the project will come from the Trail Maintenance Fund. The
2026 adopted budget includes $350,000 for trail maintenance and specifically identifies
this project for funding.
Based on Dreamland Contracting LLC's bid of $482,798.12, the City's estimated share of
the construction cost is $120,005.85.
With construction projects there might be issues requiring a change that can't wait for the
next City Council meeting for approval. Thus, Staff is requesting approval of change orders
for a total amount of $50,000 with this also being the maximum amount allowed for any
single change order increase without prior City Council approval.
ACTION REQUESTED:
The City Council is being asked to:
•Accept the bids and award a contract for
the
Jim Bell Park and Preserve
Trail
Reclamation Project to Dreamland Contracting
LLC
of Taylors Falls, Minnesota, in
the
amount of $482,798.12 and authorize the Mayor
and
City Administrator to execute
the

same.
•Approve change orders for a total of $50,000 with this also being the maximum amount
allowed for any single change order increase without prior City Council approval.

Construction for the North Creek Greenway Jim Bell Park and Preserve Segment along with
the cost share.

reimburse the City for the City's out-of-pocket construction project costs and easement
acquisition costs attributable to the relocation of the displaced NCGW Trail Improvements.
Alternatively, in the event that the relocation of displaced NCGW Trail Improvements
reasonably necessitates the acquisition of additional easements, the County may choose to
acquire said additional easement rights using the County Attorney's Office, and the County
may also choose to separately contract for the reconstruction of the displaced NCGW Trail
Improvements. The City agrees to provide the County with reasonable notice of a pending
displacement of the NCGW Trail Improvements that cannot be practically relocated within
existing City right-of-way or permanent easement, and the County agrees to provide the
City with written confirmation of how the County wants to effectuate the relocation of the
displaced NCGW Trail Improvements outside of existing City right-of-way or permanent
easement in a timely manner that does not unreasonably delay the City construction project.
ARTICLE 7
Ownership and Maintenance
The County shall own the NCGW Trail Improvements and associated improvements related to
greenway corridor, including the RRFB traffic control device of 195th Street (County Road 64).
The City shall own all local trail connections and city road crossings installed as part of the Project.
The Parties may enter or amend the separate agreement addressing maintenance of the NCGW
Trail Improvements and any shared maintenance responsibilities for the Parties' infrastructure that
may be connected to the NCGW.
ARTICLE 8
TERMINATION
8.1 Termination for Cause. This Agreement may be terminated for cause following a material
breach of the Agreement by a Party by providing thirty (30) days written notice of
termination. Such notice of termination shall not be effective unless the non -breaching
Party has provided the other Party with notice of material breach and a reasonable
opportunity to cure. The actions giving rise to a material breach shall be limited to the
failure by the City to undertake or complete construction of the Project as required by this
Agreement and failure by the County to comply with its obligations under Article 6.
8.2 Non -Appropriation of Funds. Notwithstanding any provision of this Agreement to the
contrary, either party may terminate this Agreement immediately in the event the County
determines that sufficient funds from City, County, State, or Federal sources are not
appropriated at a level sufficient to allow for the performance of this Agreement.

REGULAR COUNCIL AGENDA MEMO
To: Mayor, Councilmembers and City Administrator
From: John Powell, Public Works Director
Department: Engineering
Subject: Industrial Park Ditch Cleaning - Change Order 1 and Final Payment
Meeting: Regular Council - Aug 17 2026
INTRODUCTION:
The Industrial Park Ditch Cleaning project is complete and the contractor, Apex Drainage,
LLC has requested final payment.
DISCUSSION:
A construction contract was awarded to Apex Drainage, LLC in the amount of $141,392.75
on January 5, 2026; the following summarizes the proposed final payment amount:
Original Contract Amount $ 141,392.75
Change Order No. 1 (Deduct) $ 18,699.44
Final Contract Amount $ 122,693.31
As the final quantities do not always match the estimated bid quantities, a
"compensating" change order is prepared at the end of construction. By doing this, the
final amount paid to the contractor matches the final contract amount. The final contract
amount reflects a contract decrease of approximately 13% primarily due to the reduced
disturbance area needing to be restored.
As this is the final payment, the contractor is preparing the following required documents
and will submit them prior to the city processing this final payment:
• Consent of Surety to Final Payment
• Minnesota IC-134 Confirmation
• Lien Waivers
Approval of the final payment commences the two-year warranty period.
BUDGET IMPACT:
The final construction cost is below the amount approved for this contract.
ACTION REQUESTED:
Staff recommends approval of Change Order No. 1 and the Final Payment in the amount
of $9,549.28 to Apex Drainage, LLC for the Industrial Park Ditch Cleaning.

The contract also includes the bituminous overlay of the new parking surface near the Salt

DISCUSSION:
An advertisement for bids was posted in the Dakota County Tribune on July 24 and 31,
2026 and on the QuestCDN website. Bids were opened at 10 am on August 11, 2026. Five
(5) bids were received. The low bidder is McNamara Contracting of Rosemount, in the
amount of $580,185.00. The Engineer's Estimate of Construction Costs for the project was
$613,480. McNamara Contracting has successfully completed many similar projects in the
past. A complete tabulation of bids is attached and is summarized below:
Contractor Bid Amount
McNamara Contracting Inc. $580,185.00
S. M. Hentges & Sons Inc. $628,346.60
Bituminous Roadways Inc. $631,442.20
Valley Paving Inc. $656,409.30
GMH Asphalt Corporation $679,173.90
BUDGET IMPACT:
Funding for this project, as identified in the approved 2026-2030 Capital Improvement Plan,
included the following:
Street Maintenance Fund $ 680,000
Sewer Fund $ 25,000
Storm Water Fund $ 25,000
Water Fund $ 25,000
Total $ 755,000
The low bid is about 5.4 percent lower than the Engineer's Estimate of Construction Costs.
Based on the low bid and estimated quantities, the construction cost will be funded using
$549,635 in Street Maintenance Funds and $30,550 in Sewer Funds.
Public improvement contracts are based on estimated quantities of materials and work
types; the final contract amount can vary (increase or decrease) from the original amount.
Additionally, construction issues arise which require an immediate decision and cannot
wait for the next City Council meeting for formal approval. For these reasons, Staff is also
requesting approval of a change order contingency of $50,000 (about 10% of the
contract) be established as an aggregate of all change order increases with a maximum
amount of $20,000 allowed for any single change order increase without prior City Council
approval.
ACTION REQUESTED:
Staff recommends acceptance of the bids and award of a contract for construction of
the 2026 Mill & Overlay project to McNamara Contracting of Rosemount in the amount of
their bid $580,185.00 and authorize the Mayor and City Clerk to execute the same. This
includes approval of a change order contingency of $50,000 be established as an
aggregate of all change order increases, with a maximum amount of $20,000 allowed for
any single change order increase without prior City Council approval.
