As you can see from the attached violation, there was no date written on the form of when the alleged violation occurred. We contacted the City of Farmington to find out more details and after looking in the records, they concluded that this occurred on ' 5/24/06. Given that the time listed on the violation was 2:40PM and no one was home at our residence at that time, it is not possible that we had outdoor water running. We do NOT set up our watering system to run automatically and thus, there is no possible way that it could have been on when we were at work during the day. We have also not set it manually for several weeks due to the fact that we have been having a deck installed and thus have turned the water off in the event that the sprinkler piping could be hit during the post digging process. I would like to request a hearing, on behalf of Paragon Property Management Company, who manages Farmington Family Townhomes, located on Catalina Way. We were cited for a water use, during restricted hours. Farmington Family Townhomes did not turn on the water to be used. The contractor who did the landscaping for the new mall is the responsible party. We were not consulted with regards to water usage and this was done without our knowledge and consent. He was visiting here from my native Romania and decided that he should water the lawn while I was at work. He was not aware that there are water restrictions. When he told me that he watered I explained to him that he is not allowed to and he did not do it after that. I am asking you to reconsider the fine. My father's salary back in Romania is $100/month and he is very upset that his watering cost the equivalent of a quarter of his salary. To Whom It May Concern: . I am writing in regards to a violation of the City's Water Use Restrictions Policy for the property at 4810 187th Street West; this property is an investment property. There were two citations written for this address and we are asking that the second citation be waived. The first citation was issued to the address above on May 31 st and we were not made aware of the violation until June 5th when the renter dropped off his rent check. We contacted the irrigation company that we use on June 5th and they were to stop at the rental property on June 6th to make sure that the sprinkler system was programmed correctly. Before we could rectify the situation, a second citation (dated June 2, 2006) arrived in the mail at our office on June 5, 2006. We feel that this second citation should be waived as we were in the process of taking care of the situation. June 9, 2006 To Whom It May Concern: On June 7th at 5:35 p.m. a lady came on my property and handed me this paper regarding a watering fine. That afternoon my daughter had planted tomatoes in our garden and they were wilted and needed watering. My daughter hooked up the sprinkler to water them because I have a back injury and cannot carry water. I was washing my shoes off at the other hose and my two daughters were on the patio beside the garden. The lady said we could not leave the watering unattended but there were three of us out there. I had not planned to leave the hose running for a.."lY lengdl of th-ne just enough to water the new plants and prevent them from dying. The sprinkler was the only way for me to water because of my injury and she just apologized and left. I have the receipt for the tomatoes from Walmart and a letter from my doctor regarding the back injury. We are careful to follow the watering rules but due to the severe heat and wind on Wednesday thought the new plants should be watered and I could not physically carry water to them. Category: Chart Note Provider: Ensor E. Transfeldt, MD Patient: Suzanne B. Yauch Date of Birth: 03/20/1964 This pleasant 42 year old lady is seen today for evaluation of low back pain and neck pain. Neck pain started following a motor vehicle accident in 812002. She did subsequently have surgery with an ACDF (anterior cervical decompression and fusion) at the C6-7 level in 2/2003. She did have some initial improvement but later went on to develop more chronic pain with muscle spasms and then developed shooting pains in her arm especially on the left side. She has also however been experiencing severe headaches. Treatment to date has included some epidural steroids for episodes of severe neck pain but really has not been of great help. Her low back pain started approximately six months following the accident and has been associated with some radiation into the left leg. She has also had some numbness in the left foot. Treatment to date has also included a Medrol Dosepak, chiropractic treatment, Vicodin, physical therapy and Parafon Forte. She did give a history of some back pain before the accident when she had a lifting injury but this was not a persistent pain. PAST MEDICAL HISTORY: She gives no history of any significant cardiorespiratory problems, no GI/GU problems and no major medical illness. She has seasonal allergies. CURRENT MEDICATIONS: Vicodin, Parafon Forte and Zanaflex. PAST SURGICAL HISTORY: The ACDF, three elbow surgeries and a tubal ligation. PHYSICAL EXAMINATION: On examination she stands with a normal erect posture and has obvious discomfort with moving around. She has severe pain with attempted flexion of both the lumbar and cervical spines. She has significant increase in back pain with any attempted movement of the lower extremities. She does have quite significant paravertebral spasm in both the posterior cervical and lumbar regions. In the lumbar region, particularly on the left side, she does have fairly exquisite tenderness. She has no clear-cut objective motor weakness involving the lower extremities. She has no long tract signs. She does have altered sensation in a nondermatomal pattern involving the lower extremities. RADIOGRAPHIC REVIEW: X-rays of her cervical spine do show that she has a solid C6-7 fusion. There is no dynamic instability seen on the flexion extension views. X-rays of her lumbar spine show fairly well maintained disc height with mild anterior osteophyte formation but well maintained lordosis. MRI's of her lumbar spine show mild early lumbar disc degeneration involving the L2-3 and L3-4levels and to a lesser extent the LA-5level. MRI's of her cervical spine show multilevel disc degeneration of the cervical spine. Neither MRI shows any significant nerve root compression or spinal cord compression. DIAGNOSIS/ASSESSMENT: Disc degeneration, cervical and lumbar spines, without clear-cut evidence of nerve root dysfunction. This patient is quite frustrated by the ongoing severe pain. Unfortunately, I do not think that she is a candidate for any surgical intervention and I do feel that pain management is going to be a difficult course. I have basically discussed with her the importance of body mechanics and spine mechanics in particular. She needs to avoid holding her neck in positions of extreme flexion or extension for long periods of time and also avoid repeated neck motion. In regard to her lumbar spine she should avoid any repeated bending, lifting and twisting. It is very important to maintain good posture. Anti-inflammatories may help during episodes of more severe pain with analgesics for breakthrough pain similar to what she has had. . During episodes of severe disabling pain epidural steroids are an option. A standard perhaps ,more organized structured chronic pain management program may be indicated to help her. ANNOUNCEMENTS a) Introduce New Fire Captains - Fire Department Fire Chief Tim Pietsch introduced newly appointed Fire Captains Trent Larson, Dan Meyer, and Brad Parker. 6. CITIZEN COMMENTS Mr. Brian McDonald, 18406 Everest Circle, spoke regarding the watering restrictions. He agreed with the policy but it needs to be on a level playing field. His residence is an even number and there are odd/even restrictions all year long. The four hottest months- May - August - three of those months have 31 days. So the even number houses do not Council Minutes (Regular) June 5, 2006 Page 2 get to water for two days, and the odd number houses can water two days in a row. He asked Council to consider making the policy on a level playing field. One solution was . to allow everyone to water on the 31 st, but that would not be acceptable. His other solution was that no one is allowed to water on the 31 st and the fines double. He felt this option was fair. Everyone would have to wait for two days from the 29th to the 1 st and from the 30th to the 2nd. In May, July, August they wait four days and when it reaches 90, it is windy and it does not take more than a day for the grass to die and he wants to keep the community looking nice. He also felt the policy needs to be enforced. He notices there are times when the pavement is wet on the wrong side of the street and it has not rained. He would like the policy enforced stronger than what it is. He was aware there is someone from Public Works that drives around in a red truck and everyone knows it. On the weekends it is a free- for-all. People know that person is out from noon - 6 p.m. during the week. He suggested using a CSO that already drives around, to do enforcement. Mr. McDonald has not talked to the Water Board. Mayor Soderberg noted the Water Board sets the policy and is autonomous from the Council. Council can give them suggestions. City Attorney Jamnik suggested forwarding the minutes to the Water Board. The next meeting for the Water Board is June 26, 2006. Mr. Dave Berghuis, 19l25 Dunbury Avenue, stated he has sent some e-mails to Council regarding his evergreens being planted in the right-of-way. He stated the situation is at an impasse. The City was going to investigate moving the evergreens at the City's . expense rather than billing the residents for having them moved. However, he was not convinced that is the best use of the taxpayers' dollars. He also felt the issue is full of conflict. He and his neighbor drove around the City and within 20 minutes identified 50 evergreens that are as close to the road and a bigger sight hazard than their evergreens. Mr. Berghuis stated if the City is going to enforce the policy in his neighborhood, it needs to be enforced from one end of the City to the other. The evergreens have been established for 5 years so the roots are firmly imbedded. If moved, there is no guarantee the trees will survive. He noted there was an article in the newspaper regarding the tree ordinance and that it will not change. He felt this is a mirror image of their problem. He noted the article stated the Planning Commission agreed that property owners should have the right to do what they want with their property and the City would be interfering with their rights if the owner is required to save trees they wanted to remove. Mr. Berghuis felt a simple agreement could be made. There are three homes affected by this situation. Mayor Soderberg stated he has looked at the trees and spoke with one ofthe neighbors and the City Administrator. Evergreens are not an allowable boulevard tree because of sight issues. In 20 years there will be a visibility issue and if there is an accident, and the trees are allowed to remain, the City could be held accountable. Regarding the other 50 violations, these issues are handled on a complaint basis and Mayor Soderberg suggested Mr. Berghuis provide the list to the City Administrator. Mr. Berghuis stated there is a conflict saying they are handled on a complaint basis. To his knowledge no one has filed a complaint that his evergreens could be a risk when other evergreens throughout town .
