Mann, P.E., Director of Public Works/City Engineer SUBJECT: Water Use Restrictions - Citation Appeals DATE: September 26,2000 INTRODUCTION Per Water Board policy on water use restrictions, staff has been issuing administrative citations to residents in violation of the policy since August 1,2000. DISCUSSION The following residents who have received citations have chosen to exercise their right to appeal the citation (see attached letters). Hewitt 18040 Eventide Way Dave Herrmann 18000 Echo Drive Dale Bultje 18858 Exclusive Path For the Water Board's reference, the Water Use Restrictions Policy has been advertised as follows: · March/April Farmington Update, mailed the end of February · Farmington Independent, once as a press release and once as part of a paid advertisement for lawn care. · May 20 edition of Life and Times newspaper. · In the July utility billing, mailed at the end of June. · July/August Farmington Update, mailed the end of June. · Notice posted in new homes since the end of May. . · In the City's new resident guide. Several of the residents have indicated that they would be in attendance at the meeting. The residents that could not attend have forwarded letters with the basis for their appeals. I have just moved into my town home recently and I was unaware of a water shortage. My water bill or my association did not inform me of the city's situation. We have recently laid new sod so I was watering it so it would take a good hold. The citation says we do not have a permit but the association may have gotten one for all of the sod, but I do not know at this time. I appreciate your time in addressing my problem. Farmington MN. 55024 651 4639555 Dear Mr. Lee Mann I am writing in response to the water citation we received on September 7, 2000. That afternoon we planted three large trees in our back yard. The equipment used to move the trees caused some damage to our neighbors yard. (the area between our driveways is fairly small) Our neighbors spend a lot of time keeping there yard looking nice, our only effort in watering was to help repair the damage in our neighbors yard caused by the equipment. It is for this reason I feel the fine should be waved. We look forward to hearing from on this matter. Mann I asked the neighbor lady if my yard would be tore up when her additional telephone line was being placed. She said "No there would be on a small square hole by the box. Four or five days later Frontier came and placed the line across my side yard, front yard, under the drive way, and other side yard. The Frontier serviceman knocked on my front door and informed my disabled brother to water the damaged area immediately to keep it a live. My brother said he would pass it along when we got home. The line was placed early the morning of the 29th. . I came home from work at 3:30 P.M. and my brother told me to water the grass to keep it alive. I was so angry at seeing my yard tore up that I just thought of the need to water the damaged yard. I went out and turned on the sprinkler. My neighbor also had her sprinkler on her damaged lawn. Less than 20 minutes later while I was in the back yard with my brother, I asked him what day it was? He told me the 29th. I headed toward the front yard to turn off the water. During that 20 minutes the city employee stuck the watering ticket in the front door and left. I read in the paper of the odd/even restrictions with a 30-day wavier for new sod. It did not mention the need for a free permit. We installed sod on our entire yard on August 11 th; I'm attaching a copy of the invoice. We where one of the first to install sod on Exclusive Path, and after talking to other in the neighborhood who have yet to install sod, They also are not aware of the permit requirement.
