Mann, P.E., Director of Public Works/City Engineer SUBJECT: Water Use Restrictions Policy DATE: November 22, 1999 INTRODUCTION At the September Water Board meeting, the Water Board adopted a Water Use Restrictions Policy (attached). The policy will take effect January 1,2000. The next step is to establish the enforcement procedure. DISCUSSION As the subject policy is not a City ordinance, violations of the policy must be addressed with an administrative penalty. In contrast, City ordinances enable issuance of criminal citations for violations. It is proposed that all public works staff be authorized to issue administrative citations in regard to this policy. In the case of a violation, a notice of violation would be hung on the door and mailed to the offending property owner. The property owner would have ten (10) business days from the date of mailing of the mailed notice to remit the penalty amount to Farmington City Hall. If the property owner wishes to contest the violation, the property owner would need to request a hearing, in writing, within those same ten (10) business days. The Water Board would schedule hearings for regular Water Board meetings and the decision of the Water Board would be final. Penalties not remitted as appropriate would be certified to taxes. In 2000, it is proposed that an educational/warning period be observed since the policy is new. Warnings would be issued for first time violations of the policy until July 31, 2000. After July 31, or in the case of second and subsequent violations before July 31, the administrative citation would be issued with the related penalty. In subsequent years, no warning period would be forthcoming as the restrictions in place are year round and the policy will be well publicized in the City newsletter and water billings. The policy does not apply to the watering of new seed or sod for a period of three weeks from the date of seeding or sodding. Property owners wishing to water new seed or sod every day would need to pick up a permit from City Hall and post it in their front . . . window. The permit would valid for three weeks from the date of seeding or sodding, during which time the property owner could water at will. It is proposed that the penalty for violating the policy be set at $25 for the first offense in a calendar year, with a penalty of $50 imposed for subsequent violations in a calendar year. BUDGET IMPACT None at this time. The costs, if any, to produce administrative citation forms will be brought to the Water Board at a future meeting. ACTION REQUESTED F or Water Board consideration. The Water Board may wish to communicate this information to the City Council for review and feedback prior to adoption. This information could be placed on the Council agenda for December 6, 1999. WATER USE RESTRICTIONS: (A) Odd-Even Restriction. Use of the city water supply system for lawn or garden sprinkling or other irrigation shall be limited to an odd-even schedule corresponding to property address effective year round. This odd-even water use restriction shall not apply to the watering of new seed or sod for a period of three weeks from the date of seeding or sodding. (B) Emergency Restrictions. Whenever the Water Board determines it in the public interest, the Water Board may, by resolution, further limit the use, times and hours during which water may be used from the City water supply system, following public notice by publication or posting. (C) Enforcement. Administrative citations will be issued at the direction of the Public Works staff. 2. Effective Date. This policy shall take effect January 1, 2000. 72394 " . . . . . rnillill~rr City of Farmington Water Use Restrictions Policy The City of Farmington Water Board has instituted an odd-even watering policy. Properties having an odd numbered address are permitted to water lawns on odd calendar days. Properties having an even numbered address are permitted to water lawns on even calendar days. The Farmington Water Board has initiated this policy to ensure adequate water pressure during peak water usage. At times, the City experiences a very high demand for water. During these times of peak usage, it can be difficult for the City's pumping capacity to keep up with the demand. If, at any time, the demand for water exceeds the City's pumping capacity, a complete ban on watering within the City may need to be temporarily implemented to insure adequate supplies for fire and emergency conditions. Compliance with the odd-even Water Use Restrictions Policy should minimize and may eliminate the need to ever implement a complete ban on watering. The Water Use Restrictions Policy is in effect beginning January 1, 2000, until further notice. Failure to comply with the Water Use Restrictions Policy carries an initial administrative penalty of $25, with subsequent fines for violations within the same calendar year at $50.
