Water Use Restrictions Ordinance

INTRODUCTIONIDISCUSSION
Staff forwarded the Water Use Restrictions ordinance to the City Council for adoption at
the August 16 City Council meeting. A motion was made to adopt the ordinance,
however there was no second, so the motion died.
As the City Attorney has previously indicated, the Water Board has the authority to
enforce Water Use Restrictions as a Water Board policy. It is staffs recommendation
that the Water Board adopt the Water Use Restrictions policy. It is recommended that the
policy be adopted for implementation in the year 2000.
BUDGET IMPACT
None at this time.
ACTION REOUESTED
Water Board consideration to adopt the Water Use Restrictions as a Water Board policy.

ORDINANCE NO.
AN ORDINANCE AMENDING TITLE 8, CHAPTER 3
OF THE FARMINGTON CITY CODE CONCERNING
WATER USE RESTRICTIONS
THE CITY COUNCIL OF THE CITY OF FARMINGTON ORDAINS:
SECTION 1. Section 8-3-21 of the Farmington City Code is amended in its
entirety to read as follows:
8-3-21: WATER USE RESTRICTIONS:
(A) Odd-Even Restriction. Use of the city water supply system for
lawn or garden sprinkling or other irrigation shall be limited to an
odd-even schedule corresponding to property address effective year
round. This odd-even water use restriction shall not apply to the
watering of new seed or sod for a period of three weeks from the
date of seeding or sodding.
(B) Emergency Restrictions. Whenever the Water Board or City
Council determines it in the public interest, the Water Board or
City Council may, by resolution, further limit the use, times and
hours during which water may be used from the City water supply
system, following public notice by publication or posting.
SECTION 2. Effective Date. This ordinance shall take effect January 1, 2000,
following its passage and publication.

Nextel Antenna Request

INTRODUCTIONIDISCUSSION
Attached is a draft lease agreement that would allow Nextel West Corp. install antennas on
the Daisy Knoll Water Reservoir. A meeting was held on Wednesday September 15, 1999,
to address lease language issues with Nextel's representative. In attendance at the meeting
was the Director of Public Works, the City Attorney, Marv Weir and Max Thompson, the
representative from Nextel. The attached lease document incorporates the revisions to the
boilerplate lease document that were agreed upon at the meeting.
. BUDGET IMPACT
At the last Water Board meeting, it was recommended that the lease amount for the site to be
used by Nextel be set at the same amount as Sprint's lease, which is $11,025 per year with a
5% increase each year. Upon further review and discussion with Nextel's representative, it is
recommended that the Water Board consider a lease amount that incorporates a cost per
antenna per month. Following is a table outlining lease amounts for Nextel based on Sprint's
lease amount and U S West's lease amount for comparison purposes.

Sale of Property to City of Farmington

INTRODUCTION & DISCUSSION
In January of 1997, the Water Board purchased approximately 23 acres from
Lawrence Wenzel for the purpose of locating a 1.5 million-gallon water reservoir
on 4.5 acres of the site. The Water Board agreed at the same time to sell the
balance of the property (approximately 18.5 acres) to the City at the original cost
of $15,000 per acre for a total cost of $277,500.
The sale agreement with the City called for an exchange of the value of City
project management services provided on the new water tower as a credit
against the cost of the land, with any difference to be paid to the Water Board.
As the tower is now essentially completed, the City submits the following for the
Water Board's consideration.

City Engineering (15%) $ 230,850
City Legal & Admin (10%) $ 153,900
Total City Project Mgmt Fees $ 384,750
Less: Consulting Fees Paid $ (110,000)

ACTION REQUESTED
Acknowledge the City's intent to pay the Water Board the balance of $2,750 for
the 18.5 acres of land per the 1997 agreement. Payment would be made at the

Well No.3 Maintenance and Pump Repair

INTRODUCTIONIDISCUSSION
Well No.3 is scheduled for maintenance and pump repair in 1999. It is proposed that
staff solicit quotations for the work and complete the work this fall.
BUDGET IMPACT
The estimated cost to perform routine maintenance and pump repair could be up to
$20,000. It should be noted however that the final cost is dependent on the condition of
the pump which can only be determined once the pump equipment is taken out of service,
removed from the well and inspected. The cost to repair the pump in Well No.4 in 1998
was approximately $10,000.
ACTION REOUESTED
Authorize staff to solicit quotations and award a contract for the Well No.3 maintenance
and pump repair.
