June 21,2004 City of Fannington 325 Oak Street Farmington, MN 55024 To whom it may conc~rn: On June 16,2004 we received an Administrative Citation for violating the Water Use Restrictions Policy. The letter states that on Jtme 14th at 2:20 p.m. we watered OUt lawn. Most of our sprinkler system had been installed the previous week and when *e installer left he told us the ponion of the system that was installed was shut off. There was no need for it to be on because we do not have our sod yet. We have never had a sprinkler system before and I have not been instrucled yet how to use it yet. Apparently the sprinkler went off on June 161h at 2:20 p.m. in the aftertloon. 1 did not know about it because J was at work. and my husband was out of town. . I realize that the city has to have rules and I fully intend to abide by them in the fUlure. However, we obviously did not mean to water our dirt on June 161h. J feel that the city should offer at least one wrinen warning to residents before fining them for what could be an unintentional error. T feel it was preny obvious tbat we were unaware that our system was on because why would we want to water our din? We had to wait to get OUT sprinkler system and sod installed due to the massive amount ofrain W~ had received in the last 4 weeks, the soil has been too wet. I feel the water board should reconsider its policies and give a warning notice instead of fIning on the first offense. Due to the circumstances I wish to contest this citation and would like to requesl an administrative hearing before the Farmington Water Board. I look forward to hearing from you in the near future. June 22, 2004 Farmington Water Board City ofFarInington Farmington, Minnesota 55024 Dear Water Board Member: This letter is being written to - express interest in the fountain and boulevard mowing issue. I have been in contact with the East Farmington Home Owriers' Association and have spoken to Mr. Mann, Director of Public Works, for the City of Farmington. I understand the issues with the fountain when it was initially installed and not installed properly with a metering system an<icompletely-detailed covenants. I also understand that this issue is not so easy to resolve since it involves financial issues, but I am requesting on behalf of myself and neighbors that some sort of compromise be obtained. My husband and I moved into the neighborhood a year ago last May. One of the attractions to the neighborhood was the fountain, the well-maintained boulevards, and the w~lking trails. Believe it or not, we can see the fountain from our residence between the two houses opposite us on the block and I enjoyed looking out my glass sliding door to see the fountain. _ It was about a month ago that I realized that the fountain was not on and that the grass surrounding the fountain has not been maintained. To date, a farmer could come in and bale-hay from it now, itis that long. Summer. in Minnesota is on average 3-4 months of good weather and seeing the fountain for those months was a treat. I hope that a compromise can be obtained between the Farmington'Water Board and the East Farmington Home Owners' Association so that the fountain can be enjoyed for_a little while yet this summer and that the grass can be mowed so that the fountain can be seen. . Mann, P .E., Director of Public Works/City Engineer SUBJECT: Wellhead Protection Plan DATE: June 28, 2004 INTRODUCTION & DISCUSSION The revised Wellhead Protection Plan Part 1 was submitted for approval to the Minnesota Department of Health (MDH) at the beginning of June. Once the plan is approved, the City will have 30 days to send results to local units of government and 60 days to conduct a public information meeting. . When that procedure is completed, a meeting will be set up with the MDH to outline tasks required to complete Part 2 of the Plan (which contains the management portion of the plan).
