To Whom It May Concern:
On June 26,2004 at 2:25pm, I received an Administrative Citation for Water Use
Restrictions. Please note that my address is 19886 Emperor Court not 19886 Emerson
Court as incorrectly listed on my original citation.
I certainly understand and appreciate the purpose of having a noon-6 PM no watering
policy. On this particular day, however, I had installed sod just prior to receiving this
citation. Enclosed I have attached a receipt showing that sod was delivered to me on
Saturday, June 26th. Also enclosed is a copy of "New Sod Care" instructions. On those
instructions it states: "New sod requires a lot of water. Immediately after installation,
soak the sod thoroughly so water goes through the sod into the ground below about 1-2
inches." I was attempting to keep my newly laid sod alive when I received this citation.

The enforcement officer told me had I been watering the new sod with a hose, I would
not have been in violation. If the goal is to ensure an adequate water supply for the
essential needs of the community, to conserve a natural resource and to fulfill
requirements ofthe State of Minnesota Department of Natural Resources, I have
difficulty understanding the difference between using a hose and turning on a zone of the
sprinkler system. In my mind, both are using similar amounts of water.
As the enforcement officer drove away she said "Perhaps it's worth $25 to keep your sod
alive." Perhaps it is, however, I believe there should be exceptions granted for the day a
person lays sod.
I wish to contest this citation and therefore request an administrative hearing before the
Farmington Water Board.

To whom it may concern (Water Board):
My name is Brenda Koenig and I live at 18911 Embers Ave Farmington, MN 55024. Recently I had to replace a large
portion on lawn in my front yard with new sod. I have been watering the new sod so it would not die. My neighbors
assured me that it was acceptable to water new sod outside of the normal watering ban before I left for vacation.
When I arrived home this weekend I found a citation for watering ban violation totaling $25.00. Enclosed was an Outside
Water Use policy reminder. I read that a permit was needed for new sod. Until this point I did not know that this was
required. The sod has taken to the yard now and I will not need to request a permit.
I am asking that the board take into account these circumstances and waive the fine, as it was not an intentional violation
and is my first violation. Please contact me with your decision either by mail or phone.

days.
Your penalty for this violation of the Water Use Restrictions Policy is:

I am writing in response to a citation I have received on July 14th, citing the notes
watering during the 12-6 ban. I don't feel that this citation is a valid offense on behalf,
due to a malfunction in my sprinkler system. It was the first time I have used the sprinkler
system since I moved in. I ran the system on manual; I turned the setting to off after
sufficient watering. Unfortunately, the system never turned off, even after I unplugged
the sprinkler box. Only to my surprise, I have to turn off the main water valve, until the
irrigation provider fixes this problem.
This is my first citation ever from the City of Farmington, and I expect it to be the last.
I am looking forward for a response from the Farmington Water Board regarding this
matter.
