We arefully aware of the City Outside Water Usage, but we are having problems with our sprinkling system timer. It has not been operating according to the manufactures specifications. Enclosed are two invoicc;~ from two different companies attempting to fIX the problem. T.P. C landscape advises that think they have found the problem and have reset the unit to sprinkle on odd days starting at 3:00am Since this is our first offense we ask that you waive the fees due to problems we've been experiencing with our system. To Whom It May Concern: I'm writing this letter not to contest the citation I received on July 5th 2003 but to ask the city to take into consideration the special circumstance that created the violation. . On July 5th I was cited for a water ban violation at 12:52p.m. On this day I was on vacation in northern Minnesota As the office may have seen I do have an automatic sprinkler system, which is operated by a timer. On July 2nd the day I left for vacation, Mr. Rain had to make some repairs to the system. The gentleman making the repairs had to shut the system down after I left to make the repairs. When he reset the system he made an error and set the system to start up at 12:00p.m. instead of 12:00a.m. Being I was out of town I could not of caught the mistake and reset the timer. I have always followed the cities water ban regulations and had the system installed for that reason. I would like the city water board committee to take in consideration the circumstances of that day, and drop the violation and the fine. This citation states that on July 31,2003, the odd/even violation and 12-6 ban violation was observed at 5266 183rd St West. I feel that the accusing party has made a mistake in their observation. I say this because I have NOT watered my lawn this year, at all! One quick look at the brown, dormant grass around my house should prove this. I have lived in this house since the summer of 1998. I know that at least the last 3 summers if not more have had the odd/even watering ban. I do admit I'd like to have a nice green lawn. However, in order to maintain a nice lawn throughout a dry summer, it takes a dedicated watering schedule to stay on top of it. I have been and knew before summer started that I would be away from home a great deal this summer, therefore I did not even try to water my lawn. Judging by the brown condition of my lawn, it would take a great deal of watering to turn it around. Tome, a lot of watering equates to a larger water bilL A larger water bill and this $25 fine is something . am not willing to pay right now. This past spring I was laid off from my mechanics job at Northwest Airlines, which forced me to re-evaluate my spending habits. I had to decide which past practices were necessity and which were luxury. In my opinion, a green lawn is not a necessity. This is yet another reason I have not watered this year. The only logical reason I can come to as to why this citation was issued is that the accusing party observed my neighbor watering and mistook it for my yard. My neighbor directly to the west of my house has been watering recently. In my front yard from my driveway to my neighbors yard, I have a strip of grass that is approximately 8'-10' wide and runs the length of my driveway. This piece of grass has always proved difficult to keep green even in past years when I did water regularly. Trying to keep the water bill low, I did not even try to save it this year. Last week, on the day this citation was issued and late in the afternoon, as I was leaving the house, I noticed that about a 3' wide strip of my driveway running the entire length was wet including the strip of brown grass. My neighbors yard was also wet. I did not see anyone around or a sprinkler that was in use. But it was quite obvious that this area had been watered. I assumed my neighbors were either trying to be nice and do me a favor or they were trying to send me a subtle message that I should water. I haven't had the opportunity to discuss this with my neighbor for they are on vacation this week. To satisfy my curiosity, I would like to know exactly what my accuser observed? What part of my lawn was being watered and which spigot of my house was the hose attached to? Was it this brown strip of grass in question and was the sprinkler attached to my neighbors house or mine? I might add that this piece oflawn and Ay driveway is on the northwest comer of my lot. I have two outdoor water spigots, one on the northeast comer ~fmy house, the other on the southeast comer. Neither of them close this area. In order for me to water it, my accuser should have noted a hose running across my entire front yard and driveway. Or traced an even longer run of hose around the backside of the house to reach the other spigot. Ifmy lawn was being watered, the water 1 was not coming from my house. I have included some digital photos I took of my property this morning. Picture 229 is a view of this strip of .ass taken from the street. My driveway and garage is on the left it is rust colored with a tan door, my neighbors house is gray. You might note how brown this grass is compared to my neighbors. Picture 230 is taken from the side of the garage facing the street. Picture 231 is of my back yard. Note the only green grass in all pictures is where the grass is under the shade of trees. If indeed I had been watering my lawn, I wouldn't have a problem paying the fine and I wouldn't be investing my time to contest this citation. I'm sure you will come to the same conclusion that I have, that this has been an honest mistake. I'm hoping that you can void out this citation in a timely fashion. I made the attempt to clarifY the policy to the personnel that issued the citation. I also explained to her that I was busy completing my house chores and lost track of time. I requested my right to a verbal warning because it was ONLY 15 minutes past the restriction time. She refused because it was her duty to uphold the policy. I am requesting that this fine be dropped and reverted to a first offense warning because I was never given a warning. The city of Farmington should pardon my actions the way it pardoned my neighbors' incessant, .nability to restrain their dogs from eliminating their waste on my property. This incident occurred multiple times and they were issued two warnings, without any citation. As a responsible, tax-paying, conscientious, Farmington resident, I feel that my tax dollars can be better allocated to finance: environmental clean-up and crime reduction projects, improve conditions in schools for reducing class size, teacher or staff training, curriculum development, diversity workshops, and youth enrichment programs. Scope of Services Our approach to preparing a Vulnerability Assessment (VA} and Emergency Response Plan for the City of Farmington is to provide a performance-based assessment to fit the City's system profile and needs. We propose to utilize VSAT™ software as the basis of the assessment. VSATlM is widely used for preparing vulnerability assessments, and has been endorsed by the Minnesota Department of Health. We will supplement this software by our training in Sandia laboratory's RAM- W" methodology, Cyber assessment methodology, and our long-term experience developing Emergency Response Plans. Specific tasks are outlined in the following paragraphs. . o Task 1 : Kick-off Workshop The project begins with a kick-off workshop. It is important that all team members come to a common understanding of recent water security Legislation, Vulnerability Assessment methodologies, and the operational philosophy and mission of the water utility. Specific objectives and criteria must be defined so that the vulnerability of each of the utility's facilities can be measured based on those objectives. Since these criteria become the foundation of the Vulnerability Assessment, it is important that key decision makers attend this workshop. Bonestroo will facilitate this workshop. Information technology system We will review data gathered in Task J, and supplement our knowledge of the system with interviews of key staff to make a list of assets, categorize the assets, and enter the assets into the VSl\TTM software. IdentifY the Design Basis Threats and Assign Threats to Assets This step takes into account the likelihood of man-made attack scenarios by examining the kinds of adversaries and probable modes of attack. Employing input from public safety and security officials is vital for this. The natural threats to the assets will also be included. Following completion, Bonestroo will assign the threats to the assets using the VSl\TTM software. . o Task 3: Determine Criticality of Assets WorkshoD 2 At this workshop, the threats to Water Utility assets will be evaluated in detail. The workshop will begin with a review of the assets and threats established in Task 2. Then, system processes, boundaries, and interdependencies between assets will be evaluated. Critical assets will be identified and ranked based on the consequences of damage or loss of the facility or resource. Four levels of criticality are typically sufficient. The exact definition of these levels will be tailored to the City of Farmington. Following the workshop, Bonestroo will enter the data into the VSAT™ software. o Task 4: Determine Asset Vulnerabilit;y In this step, existing countermeasures against threats are identified and their effectiveness rated. Combining this with asset information, we determine the level of asset vulnerability. . Prior to the workshop, Bonestroo will prepare descriptions identifying the existing security measure protections for each asset and prepare Adversary Path Diagrams for studying asset protection. Scope of SelV1ces Cily of Farmington - Water System Vulnerability Assessment , J' ( WorkshoD 3 We will review potential attack scenarios, and determine which are most likely. We will evaluate the effectiveness of existing countermeasures against possible attacks. We will combine this information with our other asset data to establish relative current values of asset vulnerability. . o Task 5: Risk Level Analysis Bonestroo will update the assets, threats, and existing countermeasures based on the discussion in Workshop 3. Based on the Criticality of Assets (determined in Task 3) and the Asset Vulnerability (determined in Task 4), we then determine the risk level associated with each asset threat. o Task 6: Risk Evaluation, Management, and Mitigation This is the point where the Farmington Water Utility and key decision makers answer the question, U Are the risks acceptable?" If they are, the vulnerability assessment process is completed. More likely, the VA Team will be able to identify several improvements that can reduce risk levels. Typically those vulnerabilities with the highest risks receive the highest priority. We will evaluate equipment, technology, structures, procedures, training, and communications activities that if enacted would effectively mitigate risks, through a reduction of criticality and/or vulnerability. . The improvement actMties will tie back to each of the five utility asset categories, including such actions as capital.investments, organizational changes, process reforms, improvements in information management, and enhanced communications. Implementation will follow priorities set earlier in this process, with the highest priority vulnerabilities addressed first. Finally, business continuity plans should include a schedule for periodic testing. WorkshoD 4 Bonestroo will provide a summary of the Risk Analysis to the VA Team. Based on the risk analysis, we will suggest improvements along with planning-level cost estimates. As a team, we will examine suggested improvements and brainstorm for additional improvements. The team will evaluate benefits from the improvements (in terms of reducing risk) and compare those to the improvement costs and other potential drawbacks (barbed-wire fences in residential areas for example). The outcome of this meeting will be a list of realistic improvement options and their associated costs and benefits. The team will then decide what (if any) improvements to recommend. At the end of this task, we will have finalized the evaluation phase, and we can complete the Vulnerability Assessment. . o Task 7: Report and Presentation This task represents the culmination of the planning effort. The final product will be a written report suitable to submit to U.S. Environmental Protection Agency (EPA). It will provide specific recommendations for reducing risks through improved deterrence, delay, detection, response capabilities, and/or improved operational procedures and policies. The report will include supporting documentation and background data. It will include planning-level cost estimates associated with the prioritized measures recommended to reduce risk levels. All documents will be stored and transmitted in secure confidential formats. Since the Vulnerability Assessment is being prepared using VSA TTM software, the entire analysis can be given to the City on CD. This allows the City to easily update the analysis to reflect system changes. The format can also be used to import asset data from other facility databases. o Task 8: Emergency Response Plan The 1996 Water Supply and Distribution Plan included a water system emergency preparedness plan. In this task, we will update and expand upon the foundation of that plan. The information collected in Task 1, along with the resulting Vulnerability Assessment, will be used as base data to develop the emergency response plans. The plan will be developed to comply with both EPA and Minnesota DNR requirements. Workshoo 5 ~ Define goals and expectations for the Emergency Response Plan ~ Identify key authorities, managers, responders. and resource providers ~ Identify the priority asset threats that the plan will provide responses for ~ Map out preliminary skeleton draft response plans for each asset threat Plan Preoaratlon and Certification Bonestroo will then compile a draft emergency response plan for review by city staff. Bonestroo will incorporate review comments into the final plan. We will print five copies of the plan for the City, and submit a certificate of completion form to EPA.
